Candidates Shouldn’T “Cruz” Through Political Campaigns: Why Asking For Permission To Use Music Is Becoming So Important On The Campaign Trail, 16 J. Marshall Rev. Intell. Prop. L. 457 (2017), Courtney Willits
UIC Review of Intellectual Property Law
Music has always been used by candidates running for political office as a way to advertise themselves to potential voters. Throughout the years, a battle between political candidates and musicians has grown due to problems caused by music licensing. Currently, an issue in law exists between politicians who obtain proper music licenses versus musicians who have a right of publicity, stating they do not want to be associated with certain candidates' political views. This comment analyzes the recent copyright case against former 2016 presidential candidate Ted Cruz, and the role it could play in this area of law. Additionally, this …
Living To See His Glory Days: Why Hamilton's Lin Manuel Miranda Is Not Liable For Copyright Infringement, But Other Writers And Composers Are, 17 J. Marshall Rev. Intell. Prop. L. 92 (2017), Deidre Davis
UIC Review of Intellectual Property Law
This comment discusses the idea of individuals receiving preliminary permissions of copyrighted works before using the work as a component of their own. By doing so, an individual has a better opportunity to avoid copyright infringement. Lin Manuel Miranda, the writer of the musical Hamilton, took preliminary measures to avoid copyright infringement, and these measures will be examined throughout this comment. Copyright infringement cases and other infringement cases will be addressed, as well as a proposal to simplify obtaining preliminary permissions in copyrighted works.

Lessons From The Dramatists Guild For The Platform Economy, Matthew T. Bodie
Lessons From The Dramatists Guild For The Platform Economy, Matthew T. Bodie
All Faculty Scholarship
Are platform workers part of a firm or are they working as individual businesses? Are they providing their labor as part of a team, or do they hold on to individual capital throughout their transactions? This essay explores the question of employee versus independent contract through the specific examples of dramatists and screenwriters. Dramatists have chosen to conduct their work as separate artists; they maintain copyright over their work, and they retain control over its use. Screenwriters, on the other hand, work as part of a team; they hand over their copyright to the production company and cede control over …

Incidental Intellectual Property, Brian L. Frye
Incidental Intellectual Property, Brian L. Frye
Law Faculty Scholarly Articles
As Mark Twain apocryphally observed, “History doesn’t repeat itself, but it often rhymes.” The history of the right of publicity reflects a common intellectual property rhyme. Much like copyright, the right of publicity is an incidental intellectual property right that emerged out of regulation. Over time, the property right gradually detached itself from the regulation and evolved into an independent legal doctrine.
Copyright emerged from the efforts of the Stationers’ Company to preserve its members’ monopoly on the publication of works of authorship. Similarly, it can be argued the right of publicity emerged from the efforts of bubblegum companies to …
The Reflection And Reification Of Racialized Language In Popular Media, Kelly E. Wright
The Reflection And Reification Of Racialized Language In Popular Media, Kelly E. Wright
Theses and Dissertations--Linguistics
This work highlights specific lexical items that have become racialized in specific contextual applications and tests how these words are cognitively processed. This work presents the results of a visual world (Huettig et al 2011) eye-tracking study designed to determine the perception and application of racialized (Coates 2011) adjectives. To objectively select the racialized adjectives used, I developed a corpus comprised of popular media sources, designed specifically to suit my research question. I collected publications from digital media sources such as Sports Illustrated, USA Today, and Fortune by scraping articles featuring specific search terms from their websites. This experiment seeks …
Brexit, Art Loans And Contracts Left In Limbo, Geoffrey Bennett
Brexit, Art Loans And Contracts Left In Limbo, Geoffrey Bennett
Journal Articles
It may not be as widely appreciated as it should be that loans of art within the European Union (the EU) are not simply a fortuitous product of the fact that the EU has led to closer relationships, both economic and political, between its Member States. It could be said that they are integral to the cultural policy of the EU. Article 167 of the Lisbon Treaty states that: "The Union shall contribute to the flowering of the cultures of the Member States while respecting their national and regional diversity..." and that action shall be aimed at supporting, "non-commercial cultural …
