Harry Potter And The Trouble With Tort Theory, Scott Hershovitz Oct 2010

Harry Potter And The Trouble With Tort Theory, Scott Hershovitz

Law & Economics Working Papers

Economists argue that tort law promotes an efficient allocation of resources to safety, while philosophers contend that it dispenses corrective justice. Despite the divide, the leading tort theories share something in common: They are grounded in an unduly narrow view of tort. Both economists and philosophers confuse the institution of tort law with the rules that are distinctive of it. They offer theories of tort’s substantive rules, but for the most part ignore the procedures by which those rules are implemented. As a consequence, both miss and misconstrue much about tort law.

The problem is particularly acute for economists. They …

Brief For Amici Curiae National Immigration Project Of The National Lawyers Guild, National Police Accountability Project, And Legal Services For Children In Support Of Petitioner, Betsy Ginsberg

Amicus Briefs

Amici have a substantial interest in the outcome of this case. The Federal Tort Claims Act ("FTCA" or the "Act") provides compensation for victims of government negligence and abuse. All too often, those cases arise in the immigration and law enforcement contexts, like the case at issue here. They arise when American citizens are unlawfully detained or deported. They arise when people in immigration detention are mistreated or denied proper medical care. And they arise when immigration officials engage in unlawful home raids.

A robust and uniform Federal Tort Claims Act is essential both to compensating victims and to preventing …

Oral Dissenting On The Supreme Court, Christopher W. Schmidt, Carolyn Shapiro Oct 2010

Oral Dissenting On The Supreme Court, Christopher W. Schmidt, Carolyn Shapiro

All Faculty Scholarship

In this Article we offer the first comprehensive evaluation of oral dissenting on the Supreme Court. We examine the practice in both historical and contemporary perspective, take stock of the emerging academic literature on the subject, and suggest a new framework for analysis of oral dissenting. Specifically, we put forth several claims. Contrary to the common assumption of scholarship and media coverage, oral dissents are nothing new. Oral dissenting has a long tradition, and its history provides valuable lessons for understanding the potential and limits of oral dissents today. Furthermore, not all oral dissents are alike. Dissenting Justices may have …

This investigation focuses on the history of security in the mining sector of Chile, and attempts to do so from the perspective of the miners’ and workers’ unions. The aim of the investigation was to explore specifically the changes coming regarding security in mining in the aftermath of the accident in the San José mine of August 5, 2010; changes in the government, changes in the country’s legislation, and what role the workers’ organizations are playing in these changes, and what changes it is that they are asking for.

At the end of the investigation it still remained to be …

Reform Of The United Nations Security Council: A Rope Of Sand, Alice Minor Oct 2010

Reform Of The United Nations Security Council: A Rope Of Sand, Alice Minor

Independent Study Project (ISP) Collection

For nearly two decades the international community has debated how to address reform of the United Nations Security Council. Many argue that it is imperative that the United Nations Security Council be reformed for the body to maintain its relevance and legitimacy in the Twenty-first Century. The original United Nations Charter endowed special voting privileges and permanent membership to the five powers that emerged victorious from World War Two. These five powers no longer describe the international world order. Various reform groups such as the Group of Four, The United for Consensus movement, and the Africa Group have proposed reform …

Protecting Indigenous Identity And Culture In The Modern Nation-State: A Case Study Of The Sami In Norway, Claire Lockerby Oct 2010

Protecting Indigenous Identity And Culture In The Modern Nation-State: A Case Study Of The Sami In Norway, Claire Lockerby

Independent Study Project (ISP) Collection

The plight of indigenous peoples around the world is a serious one, and without significant international action, many valuable cultural and linguistic traditions are in grave danger of disappearing altogether. Many of these indigenous groups have experienced detrimental consequences from the history of slavery, colonialism and imperialism, and the emergence of nation-states that stripped them of their autonomy and greatly threatened their way of life. Today, there are some positive examples of international and national efforts to protect indigenous peoples, but unfortunately, most indigenous populations remain dispossessed and underrepresented. Although the international community has established principles of unalienable human rights, …

El Futuro De La Inmigración En España - (“Future Of Immigration In Spain”), Joshua Bruno Oct 2010

El Futuro De La Inmigración En España - (“Future Of Immigration In Spain”), Joshua Bruno

Independent Study Project (ISP) Collection

The following argument is about the highly disputed theme of Immigration. Like all countries around the world, Spain manages a population of foreigners that have turned up in search of a new opportunity. If these migrants are able to enter the European Union, they still face many obstacles, including racism and extreme poverty. Yet, their contributions to a struggling European economy are undeniable. The following paper attempts to highlight these important contributions and demonstrate how in a liberal democratic society, such as Spain’s, a more accepting immigration policy where more sanitary conditions provided to immigrants could work. Furthermore, these arguments …

El Papel De La Educación Y Las Ong’S En Mejorar El Acceso A Derechos Para Inmigrantes: El Caso De Los Derechos Sexuales Y Reproductivos = The Role Of Education And Ngo’S In Helping Immigrants Obtain Better Access To Their Rights: The Specific Case Of Sexual And Reproductive Rights, Amy Torres

Independent Study Project (ISP) Collection

In January of 2004, Argentina approved a new immigration law that guaranteed the protection of human rights for all immigrants in the country regardless of their legal status with the State. Among the rights explicitly guaranteed by this law were the right to migrate, the right to education and the right to health care. While this law represents a significant advance by the Argentine government in protecting the human rights of immigrants, oppressive mechanisms still remain in everyday practices that inhibit actual access to their rights.

Considering the changes in the law and the breach between the laws and everyday …

A Modest Appeal For Decent Respect, Jessica Olive, David C. Gray Oct 2010

A Modest Appeal For Decent Respect, Jessica Olive, David C. Gray

Faculty Scholarship

In Graham v. Florida, the Supreme Court held that the Eighth Amendment prohibits imposing a sentence of life in prison without the possibility of release for nonhomicide crimes if the perpetrator was under the age of eighteen at the time of his offense. In so holding, Justice Kennedy cited foreign and international law to confirm the Court’s independent judgment. In his dissent, Justice Thomas recited now-familiar objections to the Court’s reliance on these sources. Those objections are grounded in his originalist jurisprudence. In this short invited essay, which expands on prior work, we argue that Justice Thomas should abandon these …

Is Our Economy Safe? A Proposal For Assessing The Success Of Swaps Regulation Under The Dodd-Frank Act, Michael Greenberger

Faculty Scholarship

On July 21, 2010, President Barack Obama signed the Dodd-Frank Wall Street Reform and Consumer Protection Act into law. The central goal of the Dodd-Frank Act is to ensure that all standardized derivates products are regulated. The Act requires these trades be fully transparent and backed by adequate capital. The central question for evaluating the success of the Dodd-Frank Act is simple but profound: Has the Dodd-Frank Act made the economy any safer from the threat of another economic meltdown? This paper introduces a number of metrics that can be used to assess the success of the Dodd-Frank Act.
