Putting The Brakes On Private Transfer Fee Covenants, R. Wilson Freyermuth

Faculty Publications

This article will discuss private transfer fee covenants, using one popular model as an example. After explaining how a private transfer fee covenant operates, the article will review the background legal principles relevant to its enforceability As this article will argue, sound policy does not justify the enforcement of private transfer fee covenants. The article concludes with a discussion of recent state legislative efforts to invalidate private transfer fee covenants and highlights a new model statute that, if adopted, would declare such covenants void as contrary to public policy.

Redesigning The American Law School, David R. Barnhizer Jul 2010

Redesigning The American Law School, David R. Barnhizer

Law Faculty Articles and Essays

American law schools are an integral part of a vertically integrated system of production in which the end product is lawyers. Law schools are having rapidly increasing problems “selling” their “products” to potential employers/purchasers. Even if the law schools do not voluntarily cut back on the numbers of admitted students some states will decide there should be no public subsidy for educating students for employment areas such as law where there is no demand. Even though many private law schools will be affected negatively, publicly-funded law schools will also be dramatically affected due to declining state budgets and competition for …

Nation, Corporation Or Family? Tribal Casino Employment And The Transformation Of Tribes, Theodor Gordon

Occasional Papers

Since its modest beginnings in the early 1980s, tribal gaming rapidly developed into a $25 billion industry that generates over a quarter million jobs. However, the increasing employment of non-Indians in tribal casinos prompts new cultural and political challenges. This paper analyzes tribal and commercial casino trade publications in order to demonstrate how tribal casino employee relations play a significant role in transforming public policy and perceptions of tribal government in the United States.

The Plea Jury, Laura I. Appleman Jul 2010

The Plea Jury, Laura I. Appleman

Indiana Law Journal

This Article argues that it is time to reform the much-criticized plea-bargaining process by restoring the Sixth Amendment jury trial right back to criminal adjudication. My proposal would incorporate the local community into the guilty-plea procedure through the use of a plea jury, thus solving a multitude of problems within the criminal justice system. In a plea jury, a lay panel of citizens would listen to the defendant's allocution and determine the acceptability of the plea and sentence, reinvigorating the community's right to determine punishment for offenders. My goal is to return the Sixth Amendment community-jury right to its proper …

Shaping Parental Authority Over Children's Bodies, Alicia Ouellette Jul 2010

Shaping Parental Authority Over Children's Bodies, Alicia Ouellette

Indiana Law Journal

In the health-care setting, parental decisions to size, shape, sculpt, and mine children's bodies through the use of nontherapeutic medical and surgical interventions are a matter of parental choice except in extraordinary cases involving grievous harm. This Article questions the assumption of parental rights that frames the current paradigm for medical decision making for children. Focusing on cases involving eye surgery, human growth hormone, liposuction, and growth stunting, I argue that by allowing parents to subordinate their children's interests to their own, the current paradigm distorts the parent-child relationship and objectifies children in violation of the moral principle, deeply embedded …

Seeing The State: Transparency As Metaphor, Mark Fenster Jul 2010

Seeing The State: Transparency As Metaphor, Mark Fenster

UF Law Faculty Publications

When applied as a public administrative norm, the term and concept “transparency” has two intertwined meanings. First, it refers to those constitutional and legislative tools that require the government to disclose information in order to inform the public and create a more accountable, responsive state. Second, it operates as a metaphor that identifies and decries the distance between the public and the state, and that drives and shapes the desire for a more perfect democratic order. Viewed together, these two meanings both demand efforts to impose legal obligations on the state to be “open” and suggest that such efforts are …

Antitrust, Institutions, And Merger Control, D. Daniel Sokol Jul 2010

Antitrust, Institutions, And Merger Control, D. Daniel Sokol

UF Law Faculty Publications

This Article makes two primary contributions to the antitrust literature. First, it identifies the dynamic interrelationship across antitrust institutions. Second, it provides new empirical evidence from practitioner surveys to explore how the dynamic institutional interrelationship plays out in the area of merger control. This Article provides a descriptive, analytical overview of the various institutions to better frame the larger institutional interrelations for a comparative institutional analysis. In the next Part it examines mergers as a case study of how one might apply antitrust institutional analysis across these different kinds and levels of antitrust institutions. The Article utilizes both quantitative and …

Asking The Man Question: Masculinities Analysis And Feminist Theory, Nancy E. Dowd Jul 2010

Asking The Man Question: Masculinities Analysis And Feminist Theory, Nancy E. Dowd

UF Law Faculty Publications

Masculinities scholarship is an essential piece of feminist analysis and of critical equality analysis. It requires that we "ask the man question" to further unravel inequalities. This symposium marks one of several movements toward examining and considering what masculinities scholarship can offer. In this introduction, I suggest a framework of masculinities analysis and describe its relationship to feminist theory. First, I consider why we should ask the "man question," and how we should ask it. Second, I explore how masculinities analysis might be useful in our examination of the "man question." Masculinities work can be used to understand more clearly …

Putting Their Money Where Their Mouth Is: The Case For Denying Qualified Immunity To University Administrators For Violating Students' Speech Rights, Azhar Majeed Jul 2010

Putting Their Money Where Their Mouth Is: The Case For Denying Qualified Immunity To University Administrators For Violating Students' Speech Rights, Azhar Majeed

Cardozo Public Law, Policy & Ethics Journal

The article argues that courts should deny qualified immunity to public university administrators when they violate students' First Amendment rights, particularly through unconstitutional speech codes or censorship of protected speech. It contends that the law on student expressive rights is clearly established, making it unreasonable for administrators to claim immunity. By holding administrators personally liable under 42 U.S.C. § 1983, the judiciary can better protect students' constitutional freedoms and deter future violations.

A Theoretical Justification For Special Solicitude: States And The Administrative State, Matthew S. Melamed Jul 2010

A Theoretical Justification For Special Solicitude: States And The Administrative State, Matthew S. Melamed

Cardozo Public Law, Policy & Ethics Journal

The article examines the Supreme Court's decision in Massachusetts v. EPA, focusing on the doctrine of special solicitude in standing analysis for states. It argues that the Court's recognition of Massachusetts' quasisovereign interest to challenge the EPA's denial of a rulemaking petition reflects a federalist concern, ensuring states can hold federal administrative agencies accountable. The analysis critiques the Court's reliance on special solicitude, highlighting tensions between traditional standing requirements and the unique role of states in constitutional adjudication. The article posits that the special function model of standing, which emphasizes states' roles as protectors of citizens' interests, provides a …

Nato At Sixty: American Between Law And War, Mary Ellen O'Connell Jul 2010

Nato At Sixty: American Between Law And War, Mary Ellen O'Connell

Indiana Journal of Global Legal Studies

NATO was founded to counter the Soviet Union and the Warsaw Treaty Organization. Both have been gone for over twenty years. So why is NATO still here? Part of the explanation may lie in Americans' strong belief in the efficacy of military force. NATO remains associated in Americans' minds with the greatest time of U.S. military power. Yet, the United States also has a strong commitment to the rule of law. The country appears overdue for a return to this other commitment. We should not be surprised to soon see the United States promoting international law again-and that could mean …

Love Thy Neighbor: The Tampere Convention As Global Legislation, Allison Rahrig Jul 2010

Love Thy Neighbor: The Tampere Convention As Global Legislation, Allison Rahrig

Indiana Journal of Global Legal Studies

The Internet, 24-hour news sources, and a host of other telecommunications advances have allowed global citizens to become instantaneously informed. With the privilege of real-time updates and acute awareness of the world's events comes the responsibility of being more than a passive observer. Specifically, this Note focuses on the technological improvements in communication during natural disasters-improvements that can be used to assist and aid the victims of catastrophes. In the aftermath of a natural disaster, the country affected is rarely able to provide for its citizens; tsunamis, hurricanes, tornadoes, and earthquakes can (and often do) cripple an entire nation. This …
