Vat Fraud - Technological Solutions, Richard Thompson Ainsworth Sep 2010

Vat Fraud - Technological Solutions, Richard Thompson Ainsworth

Faculty Scholarship

Every VAT/GST allows missing trader fraud. The fraud is simple, and can be simply prevented (with technology). The fraud arises when a business makes a purchase without paying VAT, collects VAT on an onward sale, and then “disappears” without remitting the tax. Missing trader fraud is common in high-value/low-volume goods sold across borders – computer chips and cell phones are the classic examples. But the fraud easily migrates when pursued. It operates well with goods as wide ranging as xenon bulbs, automobiles, and earth moving equipment.

The recent appearance of MTIC fraud in tradable CO2 permits and VoIP is a …

Cityland – Vol. 7, No. 8, Center For New York City Law

CityLand - 2010

The September 2010 issue of CityLand covers significant land use, zoning, and preservation developments across New York City. The City Council approved Vornado Realty Trust’s 15 Penn Plaza commercial tower, despite concerns about its impact on the Empire State Building and MWBE participation. The City Planning Commission approved large rezonings in northeast Queens (Auburndale, Oakland Gardens, Hollis Hills) and Rosedale, as well as the Culver El rezoning and housing project in Borough Park. A supportive housing project for women in Prospect Lefferts Gardens was debated. The Commission also approved a zoning text amendment regulating car-share parking. The Board of Standards …

Act 60: The Past, Present, And Future Of School Consolidation In Arkansas, Nathan C. Jensen, Gary W. Ritter

Policy Briefs

The law requires school districts to be consolidated if their enrollment drops below 350 for two consecutive years. This policy brief will report on the numbers and types of schools and districts that have closed since the passage of Act 60. Moreover, the brief will evaluate the enrollment trends to predict which school districts are “at-risk” of being consolidated for dropping below the 350 student threshold established by Act 60. The data for this policy brief is excerpted from a …

Salazar V. Buono: The Cross Between Endorsement And History, Mary Jean Dolan Sep 2010

Salazar V. Buono: The Cross Between Endorsement And History, Mary Jean Dolan

NULR Online

The striking image of a white cross on stark rock, silhouetted against the desert sky, now symbolizes not only Christianity and, arguably, World War I military sacrifice, but also the equally dramatic, prolonged saga of the Salazar v. Buono litigation. The photos invoke the most recent Supreme Court battle in the legal and cultural war to define religion’s role in the public square. Competing approaches stress either preserving history or avoiding government endorsement of religion; this brief article analyzes a potential new synthesis suggested by Buono.

The original cross war memorial was erected in 1934 by a local group …

‘The Grass That Gets Trampled When Elephants Fight’: Will The Codification Of The Crime Of Aggression Protect Women?, Beth Van Schaack Sep 2010

‘The Grass That Gets Trampled When Elephants Fight’: Will The Codification Of The Crime Of Aggression Protect Women?, Beth Van Schaack

Faculty Publications

This article analyzes the outcome of the Kampala process with an eye toward the rarely-considered gender aspects of the crime of aggression, whether or not the provisions adopted represent an advancement for women, and how aspects of feminist theory might interpret the new regime. The Article concludes that any impact of the provisions will inevitably be limited by gaps and ambiguities in the definition of the crime and the jurisdictional regime, which is premised on state consent and exempts non-states parties altogether. At the same time, the insertion of the crime of aggression in the Rome Statute enables the prosecution …

The 2010 edition of Uniform Maine Citations continues the effort to provide guidance for the location and proper form for citation to Maine-specific primary and secondary sources of legal research and writing. This edition represents a significant departure from the previous three editions in several important respects. First, it will be published on the Maine Law Review web site and updated at least annually to recognize new developments and new sources of Maine-related legal research. Because Uniform Maine Citations will be published and regularly updated on-line, and can be downloaded and printed from the web site, no separate print publication …

Salazar V. Buono: Sacred Symbolism And The Secular State, Ian Bartrum Sep 2010

Salazar V. Buono: Sacred Symbolism And The Secular State, Ian Bartrum

NULR Online

After oral argument, Salazar v. Buono looked like it might be a dud. As Adam Liptak observed in the New York Times, the Justices spent most of their energy pressing then-Solicitor General Elena Kagan and her opponent, Peter Eliasberg of the ACLU, on the case’s tangled procedural history, and “only Justice Antonin Scalia appeared inclined to reach the Establishment Clause question” that gave rise to the legal controversy. But, in the intervening months, the case has gotten more and more interesting. First, most members of the Court did—in at least some way—reach the substantive merits in the decision; …

United States V. Blagojevich: A Standard Bait And Switch, Timothy J. Letizia Sep 2010

United States V. Blagojevich: A Standard Bait And Switch, Timothy J. Letizia

Seventh Circuit Review

In United States v. Blagojevich, the Seventh Circuit addressed the issue of whether the presumption in favor of disclosure of jurors' names had been rebutted. The Seventh Circuit began its analysis by recognizing three bases by which judicial proceeding information is made available to the press and the public: (1) the First Amendment right of access, (2) the common law presumption of openness, and (3) the Jury Selection and Service Act. While each of these bases functions primarily to make information available to the press and public, each also carries its own distinct standard by which the presumption of …
