Ending Surprise Liens On Real Property, Chad J. Pomeroy Oct 2010

Ending Surprise Liens On Real Property, Chad J. Pomeroy

Nevada Law Journal

Academics, lawmakers, and the general public have long believed that “secret liens” are problematic. In real property, these are liens that are not recorded in the real property filing system. Secret liens become especially problematic when they are enforced, despite their secrecy, against subsequent purchasers of the property. If the purchaser does not satisfy the lien by paying the underlying debt, the lien holder can foreclose on the property. One of the main purposes of having real property recording statutes was to avoid “surprise liens’’ (secret liens afforded priority over subsequent purchasers) and ensure that real estate purchasers and investors …

Abraham Lincoln As A Legal Writer, Judith D. Fischer Oct 2010

Abraham Lincoln As A Legal Writer, Judith D. Fischer

Nevada Law Journal

Abraham Lincoln wrote renowned speeches, yet he had only about a year of formal schooling. How did he become such an eloquent writer? Drawing on the recent collection of his legal papers as well as on secondary sources, this article discusses how Lincoln developed his craft as a writer by diligently studying great speeches and writing. It then discusses characteristics that made Lincoln’s writing so eloquent. It concludes that today’s lawyers might profitably emulate Lincoln’s close study of great literature as well as his clear, succinct writing style.

The Knowledge Guild: The Legal Profession In An Age Of Technological Change, Paul F. Kirgis Oct 2010

The Knowledge Guild: The Legal Profession In An Age Of Technological Change, Paul F. Kirgis

Nevada Law Journal

In The End of Lawyers? Rethinking the Nature of Legal Services, Richard Susskind predicts that lawyers will suffer the fate of other guild-members—the artisans and craftsman of an earlier age—who saw their livelihoods wiped out by the potent mix of technological advancement and market forces that is modernity. He argues that the commoditization of legal services will make much traditional legal work unnecessary, dramatically reducing the demand for the one-on-one client service that has sustained the growth of the legal profession. This Review challenges Susskind’s assumption that the work of lawyers is analogous to the work of the mechanical craftsmen …

Space Age Love Song: The Mix Tape In A Digital Universe, Megan M. Carpenter Oct 2010

Space Age Love Song: The Mix Tape In A Digital Universe, Megan M. Carpenter

Nevada Law Journal

Mix tapes are the classic, iconic form of music sharing. Mix tape creators of the past believed they were making a piece of art larger than the sum of its parts. And even in the face of technological development so rapid and far-reaching as to remove the literal “tape” from “mix tape,” there are nonetheless modern incarnations that crop up on a regular basis, from mix CDs to mix-sharing websites. The technology is different, but the song remains the same.

Toward A Cosmopolitan Ethic In Debt Restructuring, Carmen Amalia Corrales

Law and Contemporary Problems

Corrales discusses the sovereign debt restructuring process. Process -- or the series of actions, actors, and influences involved in a transaction -- is rarely examined in law. But the dynamics of process and the unspoken codes that affect it are, nonetheless, key to complex transactions and sovereign debt restructuring.

Competition In The Underwriting Markets Of Sovereign Debt: The Baring Crisis Revisited, Juan H. Flores

Law and Contemporary Problems

Flores discusses the bargaining power of Argentina's federal government relative to that of the underwriting banks. It examines how the financial intermediaries' gatekeeping function eroded when faced with increased competition. Under normal circumstances, underwriters should have impeded Argentinean access to capital markets or at least hardened the terms under which Argentina could borrow.
