Rational Choice And Rat Choice: Some Thoughts On The Relationship Among Rationality, Markets, And Human Beings, Edward L. Rubin
Rational Choice And Rat Choice: Some Thoughts On The Relationship Among Rationality, Markets, And Human Beings, Edward L. Rubin
Chicago-Kent Law Review
For about 2,500 years, the term rationality has been used in the Western world to describe the application of human reason to a wide range of problems or issues. In the past thirty years, however, the term has been appropriated by microeconomists and microeconomically-oriented social scientists to mean something quite different—the application of instrumental rationality to the particular problem of material self-interest maximization. This Article will attempt to recapture the original meaning of the term rationality, and explain the place of the microeconomic model within it. Using Weber's distinction between instrumental rationality and values rationality, it will argue that all …
The Legal Function Of Ritual, Geoffrey P. Miller
The Legal Function Of Ritual, Geoffrey P. Miller
Chicago-Kent Law Review
This Article offers a theory of ritual as social control. It argues that an important function of rituals is to align personal identities with social roles. Within the framework of this theory, rituals can be classed into three general types: rituals of reformation (e.g., marriage, initiation, and installation) help align identity and role; rituals of renewal (e.g., religious …

Wilmer Cutler Pickering Hale and Dorr Antitrust Series
In May 2005, the Food and Drug Administration (FDA) issued draft guidance on the type of information to be posted on its new “Drug Watch” website—a site intended to identify drugs for which it is actively evaluating early safety signals. At this time, the FDA plans only to post information on drug products regulated by the Center for Drug Evaluation and Research, therefore vaccines, blood products and medical devices shall be excluded.
Unilateral Effects: The Enforcement Act Under The Old Ec Merger Regulation, Claus-Dieter Ehlermann, Axel Gutermuth
Unilateral Effects: The Enforcement Act Under The Old Ec Merger Regulation, Claus-Dieter Ehlermann, Axel Gutermuth
Wilmer Cutler Pickering Hale and Dorr Antitrust Series
The reform of the EC Merger Regulation was preceded by an animated debate about whether the traditional "dominance" test allowed the Commission to challenge mergers that did not lead to single firm or collective dominance in the traditional sense, but nevertheless may have reduced competition to the detriment of consumers. The authors submit that the dominance test failed to reach such situations of "unilateral" or "non-coordinated" effects. The old Merger Regulation therefore suffered from a potential "enforcement gap" that was closed only by the legislative change to the "significant impediment of effective competition" test. National jurisdictions still using variants of …

They say that first impressions are important, and Ron Cass was an important element of my first impression of Boston University School of Law. In December, 1983, fresh out of University of Chicago Law School and clerking for a federal judge, I attended the annual law school job fair, held at a hotel near O'Hare airport in Chicago. My appointment with Boston University was early on the first day, and the B.U. delegation consisted of Professors Ira (Chip) Lupu and Ron Cass, who was a relatively new member of the B.U. faculty. I was impressed immediately by the enthusiasm they …
