Cultural Property And Ownership: Antiquities, Clemency Coggins Oct 2001

Cultural Property And Ownership: Antiquities, Clemency Coggins

Connecticut Journal of International Law

The following are thoughts on the ownership of antiquities or ancient objects from the perspective of an archaeologist. This is an unpleasant exercise since, from my point of view, modem ownership is totally irrelevant to our involvement with the ancient world. Property law, as has just been observed in the introduction, is a kind of cultural product itself. This is an interesting side consideration. Howard Spiegler spoke of the ownership of art and of relatively modem paintings. It is clear this is a very complicated topic, particularly when more than one country and more than one legal system is involved. …

Protecting Debtor's Subsidiaries: Extending The Automatic Stay Of 11 U.S.C. § 362 To Foreign Subsidiaries, William J. Kambas

Connecticut Journal of International Law

To protect or not to protect... On one hand, a viable business is valuable to society and such a business should be assisted if financial hardship jeopardizes its future.' On the other hand, if a business is unable to cope on its own, it should not be put on life support, and if that business is truly valuable to society another will take its place The United States Bankruptcy Code (the "Code") has taken the kinder, gentler road. Chapter 11 of the Code facilitates the reorganization of viable businesses. Although the reorganization process cannot ensure that a once strong business …

The Transnational Insolvency Project Of The American Law Institute, Jay Lawrence Westbrook Oct 2001

The Transnational Insolvency Project Of The American Law Institute, Jay Lawrence Westbrook

Connecticut Journal of International Law

In May 2000, the American Law Institute (hereinafter "ALI") completed its Transnational Insolvency Project (hereinafter the "TIP") with the membership's approval of Principles of Cooperation in Transnational Insolvency Cases Among the Members of the North American Free Trade Agreement.' The approval marked the end of a unique five-year cooperative effort by experts in bankruptcy law from Canada, Mexico, and the United States. The resulting text is an authoritative statement of basic principles (hereinafter the "ALl Principles") for the conduct of multinational bankruptcy cases.

The TIP was important both for its results and for its significance in the life of the …

Germany: Lessons To Learn From The Implementation Of A New Insolvency Code, Christoph G. Paulus Oct 2001

Germany: Lessons To Learn From The Implementation Of A New Insolvency Code, Christoph G. Paulus

Connecticut Journal of International Law

The new German Insolvency Code (Insolvenzordnung = InsO) went into force on January 1, 1999, thereby replacing two sets of insolvency laws. In the western part of Germany, there was the time-honored 1877 Bankruptcy Law (Konkursordnung) and a 1935 Composition Law (Vergleichsordnung); in the eastern part the 1991 General Execution Law (Gesamtvollstreckungsordnung) had replaced a former GDR statute and was applicable only in the territory of the former East Germany.

Despite its youth, the new Code is at this moment subject to some amendments. They are felt to be necessary since the practical experience of some two and a half …

A Global Approach For Multi-Creditor Out-Of-Court Restructurings - A New Initiative And The Wider Issues, Terry Bond Oct 2001

A Global Approach For Multi-Creditor Out-Of-Court Restructurings - A New Initiative And The Wider Issues, Terry Bond

Connecticut Journal of International Law

Insolvency regimes differ widely around the world, some can be described as highly developed and sophisticated, based as they are on many hundreds of years of experience, constantly being updated and refined in the light of constant usage and practice. The systems of countries such as the United States, the United Kingdom, Canada and various European countries would spring to mind as examples. Equally, there are many jurisdictions where the evolution of insolvency systems is much less advanced, ranging down to those where they are largely ineffective, whether through lack of modem commerciality, or because implementation or predictability are lacking, …

Symposium - International Insolvency: Introduction, Richard A. Gitlin Oct 2001

Symposium - International Insolvency: Introduction, Richard A. Gitlin

Connecticut Journal of International Law

The concept of saving and restructuring a troubled business, and making it a stronger competitor, is a relatively new phenomenon to global commerce, whether it be a purely national enterprise, or one that does business in more than one jurisdiction. However, the global community has finally come to realize how important this is to economic well-being.

Rethinking The Discharge Of Pre-Petition Attorney Fees In Chapter 7 Bankruptcy: A Debtor Oriented Perspective, James L. Neher Sep 2001

Rethinking The Discharge Of Pre-Petition Attorney Fees In Chapter 7 Bankruptcy: A Debtor Oriented Perspective, James L. Neher

University of the District of Columbia Law Review

The courts are split over a provision of the Bankruptcy Code,' in which the majority courts hold that upon the filing of a Chapter 7 bankruptcy, 2 unpaid attorney fees, for pre-petition work in connection with preparing and filing bankruptcy, are discharged. In contrast, the minority view holds that attorney fees in connection with preparing and filing a bankruptcy are not dischargeable whether prepaid or not, as long as they are not excessive.4 The problem with the majority view is that indigent debtors may be deprived of access to legal counsel unless they can pay all or most of their …

Black Plaintiffs And Class Action Employment Discrimination Lawsuits In Corporate America, Michael Green Sep 2001

Black Plaintiffs And Class Action Employment Discrimination Lawsuits In Corporate America, Michael Green

University of the District of Columbia Law Review

Class action lawsuits initiated by black employees against corporations have been commonplace in the United States in recent years. Why has there been an influx of litigation targeted to corporate America? Is there an epidemic of discrimination directed toward black employees in many companies- or is this legal action a result of a phenomenon that is coincidental? Although many argue that there is no "systematic" approach or policy to hinder the development of blacks in corporations, it is evident that serious problems do exist in many companies that have the propensity to curtail the advancement of black employees. In essence, …

The Internet Opens Its Doors For .Biz-Ness, Corey Ciocchetti

Duke Law & Technology Review

Starting on October 1, 2001, .BIZ will become active as the Internet's newest top-level domain; its space reserved solely for businesses engaging in "bona fide" commercial activities. This space has the potential to reinvigorate, at least partly, the immense economic potential of the Internet by stimulating a multitude of e-commerce transactions so common only a few years ago. This iBreif explores the history of how and why this new top-level domain came into being. Following this history lies a discussion of the current .BIZ registration process as well as an analysis of the corresponding Intellectual Property Claims system.

Health Insurance Family Style: Public Approaches To Reaching The Uninsured, Jennifer Ryan

National Health Policy Forum

This issue brief explores existing and potential opportunities to further expand the availability of health coverage for the uninsured and the underinsured, given downturns in the economy and the resulting state budget shortfalls. It also considers the implications of the Health Insurance Flexibility and Accountability (HIFA) initiative announced in August 2001 by the Centers for Medicare and Medicaid Services. Finally, the issue brief describes legislative options for health care reform being debated in Washington, including tax credit incentives, employer-based coverage subsidies and the potential for additional federal funding for public coverage expansions through Medicaid and the State Children's Health Insurance …
