A Framework Of Norms: International Human-Rights Law And Sovereignty, Douglass Cassel Jan 2001

A Framework Of Norms: International Human-Rights Law And Sovereignty, Douglass Cassel

Journal Articles

The international legal boundary between states; rights and human rights is not fixed. Long ago, the Permanent Court of International Justice - the judicial arm of the League of Nations and the precursor to the present International Court of Justice - recognized that "the question whether a certain matter is or is not solely within the jurisdiction of a State is an essentially relative question; it depends on the development of international relations." In recent decades international relations concerning both sovereignty and rights have developed quickly. An examination of those rights and the evolving realities of sovereignty are examined.

On Castles And Commerce: Zoning Law And The Home Business Dilemma, Nicole Stelle Garnett Jan 2001

On Castles And Commerce: Zoning Law And The Home Business Dilemma, Nicole Stelle Garnett

Journal Articles

Most zoning laws severely restrict residents' ability to work from home. Some prohibit it outright. These regulations serve the ostensible purpose of protecting neighbors from externalities that might be generated by home businesses. But, home occupation restrictions also reflect in a particularly sharp way the central motivating ideology underlying all zoning laws - namely, that the good life requires the careful segregation of work and home. Today, home business regulations are being challenged by both planning theory and economic reality. At the same time that many in the academy and planning professions are calling into question zoning's pervasive segregation of …

One Of A Kind - Professor Emeritus Charles E. Rice, Robert E. Rodes Jan 2001

One Of A Kind - Professor Emeritus Charles E. Rice, Robert E. Rodes

Journal Articles

In the spring of 1959, when I was faculty advisor of the law review (then called the Notre Dame Lawyer), and my future colleague Bob Blakey was the student associate editor, we worked together on an article called A.I.D.—An Heir of Controversy. The subject, artificial insemination from a donor, was interesting, the treatment was at once lively, rueful, and orthodox, and the conclusion was an engaging shrug of the shoulders: "Upon that note . . . your writer respectfully throws in the towel.'' The author, a graduate of Boston College Law School taking an advanced degree at New York University, …

Backdoor Liability From Internet Telecommuters, Mark J. Maier Jan 2001

Backdoor Liability From Internet Telecommuters, Mark J. Maier

Computer Law Review and Technology Journal

Internet telecommuters work from home and access their employer's internal network over the Internet. This relatively new style of work has increased in popularity through the years, with an estimated 4.5 million workers Internet telecommuting in 1999. While employers enjoy compelling benefits such as reducing overhead costs, Internet telecommuting raises new security concerns for employers by exposing their internal networks to "backdoor attacks" that exploit the telecommuter's connection. The recent backdoor attack on Microsoft's source code illustrates the extent to which such attacks threaten confidential information. If such confidential information belongs to a client or third party, then the telecommuter's …

Judges, Ideology, And Policy In The Administrative State: Lessons From A Decade Of Hard Look Remands Of Epa Rules, William S. Jordan Iii Jan 2001

Judges, Ideology, And Policy In The Administrative State: Lessons From A Decade Of Hard Look Remands Of Epa Rules, William S. Jordan Iii

Akron Law Faculty Publications

In this empirical and doctrinal study, William S. Jordan III investigates how judicial ideology influences administrative law outcomes, focusing on a decade's worth of D.C. Circuit Court decisions that remanded Environmental Protection Agency (EPA) rules under the "hard look" doctrine. The article analyzes whether patterns in judicial reasoning reflect ideological biases or whether decisions were grounded in principled application of administrative law standards. Jordan finds evidence suggesting that judicial ideology does play a role in shaping outcomes, particularly when evaluating the adequacy of agency justifications. However, he also explores institutional and doctrinal checks that may constrain overt politicization. The article …

Changing Role Of The Company Secretary In Malaysia, Cheng Luan Ooi Jan 2001

Changing Role Of The Company Secretary In Malaysia, Cheng Luan Ooi

Student Works (2000-2009)

The role and responsibilities of the company secretary may not be so well known as that of the other profession like the accountants, advocates and solicitors, architects and doctors. It is also not well defined in company legislation nor does the Act in its present state distinguish between full time and professional company secretary. Thus the role of a company secretary in this context is somewhat confusing to outside parties as far as the scope of responsibilities is concerned. From the traditional role as a mere keeper of company's documents, in recent years, the role of company secretary calls for …
