The American people first became aware of the issue of mental retardation and the death penalty around the time of this Court’s decision in Penry. In the intervening years, all available forms of evidence demonstrate an unmistakable national consensus that people with mental retardation should not be executed. Petitioner, as well as other supporting amici, will present this Court with the compelling clinical, moral, and constitutional reasons why such executions violate the Eighth Amendment. Amici American Association on Mental Retardation (AAMR) et al. offer a somewhat different perspective. Since the Court’s evaluation of whether a national consensus exists is essentially …

This "marital presumption" permitted courts to assume a set of biological facts in the name of preserving the sanctity and stability of what was assumed to be the cornerstone of a healthy society — the traditional family of husband, wife and children. In the last decades of the 20th century, science developed paternity testing with results approaching certainty. Despite the availability of DNA testing, the marital presumption is still used in many courtrooms to answer the question of who is the legal father. What one scholar has called "the law's struggle to preserve the fiction of an older moral order" …

Federal And State Perspectives On Gme Reform, Karen Matherlee

National Health Policy Forum

This issue brief examines financial support of graduate medical education (GME), a standard budget item in the federal Medicare program and in some state Medicaid programs. It looks at objections to the way in which GME dollars are distributed, especially in terms of variations in Medicare GME payments across states. It explores various reform proposals that are circulating to address this and other GME problems and the odds for major reform.

In Our Backyards: Analyzing Local Authority To Adopt Environmental Laws, John R. Nolon

Elisabeth Haub School of Law Faculty Publications

While the authority of municipalities to partake in land use decisions is a well-established concept, a question often arises concerning local legislative authority to adopt environmental laws. This article discusses some of the arguments advocating local environmental authority by highlighting the correlation between land use law and environmental law. Also discussed in this article, is the authority granted to local governments by the state legislature and court decisions to mitigate adverse environmental impacts.

The Clone Wars: The Growing Debate Over Federal Cloning Legislation, John Garvish Jun 2001

The Clone Wars: The Growing Debate Over Federal Cloning Legislation, John Garvish

Duke Law & Technology Review

As readers of science fiction are well aware, the term "clone" refers to asexually produced offspring, that is, offspring produced by a process of cell-division which does not begin with the union of two sex cells. A clone is the genetic twin of the cell donor. Propagation of plants by this method is, of course, commonplace, but mammalian reproduction in this fashion would indeed be a revolutionary accomplishment, with profound and disturbing implications.
