Federalism Values And Foreign Relations, Michael Greve Sep 2001

Federalism Values And Foreign Relations, Michael Greve

Chicago Journal of International Law

In attacking the orthodox view of an exclusive, incontestable federal monopoly over foreign relations, Edward T. Swaine argues, revisionist scholars have so far failed to address the "ultimate challenge [of] locating new functions and values for the states in a globalized, yet federal, world." Both the criticism and the underlying intuition strike me as substantially correct. The revisionist attempt to rehabilitate federalism and the states presupposes that federalism serves some important value or values. In light of the momentous changes wrought by a global, interconnected world, those values cannot simply be assumed; they have to be identified and defended. That …

Prosecuting Genocide, Maria T. Vullo Sep 2001

Prosecuting Genocide, Maria T. Vullo

Chicago Journal of International Law

The arrest of Slobodan Milosevic and his eventual trial before the International Criminal Tribunal for the Former Yugoslavia ("ICTY") certainly is a good thing for humankind. So too is the recent conviction of Bosnian Serb General Radislav Krstic for committing genocide in Srebrenica. But we cannot accept these few events as the full response to what happened in Bosnia-Herzegovina. No efforts to prosecute a few "soldiers" will be truly meaningful until the international community calls what happened genocide and compensates the many victims of the genocide for the injuries caused by the despicable Serbian policy of "ethnic cleansing." I had …

The Future Of Offshore Tax Havens, Taylor Morgan Hoffman Sep 2001

The Future Of Offshore Tax Havens, Taylor Morgan Hoffman

Chicago Journal of International Law

Recently, the Organization for Economic Cooperation and Development ("OECD") issued a report targeting "harmful tax regimes"-preferential, low tax regimes that are primarily tailored to rap into the tax bases of other countries. The report, Towards Global Tax Cooperation: Progress in Identifying and Eliminating Harmful Tax Practices, ("Towards Global Tax Cooperation"), identified a list of tax practices the OECD deemed harmful, such as "ring-fencing" (where foreign customers are subject to rules different than those applied to citizens which encourages the establishment of foreign entities with no substantial activities), a lack of transparency, and the absence of information exchange regarding tax practices. …

The Costs Of International Human Rights Litigation, Curtis A. Bradley Sep 2001

The Costs Of International Human Rights Litigation, Curtis A. Bradley

Chicago Journal of International Law

Many international law scholars have assumed that the rise of international human rights litigation in US courts is an unequivocally positive development. In this essay, I will suggest that, notwithstanding its understandable appeal, this litigation entails significant domestic costs, and possibly international costs as well. These costs, like the benefits of international human rights litigation, are difficult to measure and probably vary from case to case. If nothing else, however, the existence of these costs may suggest that courts should await specific guidance from Congress before allowing further expansions of this litigation.

Brussels I: A Race To The Top, Nicole Goldstein Sep 2001

Brussels I: A Race To The Top, Nicole Goldstein

Chicago Journal of International Law

The idea for Brussels I sprang from a concern by European justice ministers that e-commerce was lagging in Europe. The European Commission attributed the dearth of online purchases to consumer fear, an opinion about which they have been very forthright in press statements as well as at the debates over the law. Given that consumer groups in Europe have been pushing for the right to sue companies in the consumer's home country, the EU ministers hope that the elasticity of the new jurisdictional regulation will spur e-commerce by bolstering consumer confidence. Many business owners, however, see Brussels I as a …
