Safety Concerns, Fear And Precautionary Behavior Among College Women: An Exploratory Examination Of Two Measures Of Residency, Adam J. Pritchard, Carol E. Jordan, Pamela Wilcox

Office for Policy Studies on Violence Against Women Publications

This study examines the impact of two distinct measures of residency on college women's perceptions of safety, fear of crime and precautionary behaviors within both on-campus and off-campus areas. A student's current residency either on- or off-campus and a student's prior residency in a metropolitan, micropolitan or rural county prior to college are compared across these three aspects of campus safety. Current residency is found to be significantly related to a student's perceptions of safety in off-campus areas around campus, as well as the likelihood of engaging in precautionary behaviors such as avoiding specific locations on campus or carrying or …

Sherlock Holmes And The Problem Of The Dead Hand: The Modification And Termination Of "Irrevocable" Trusts, Richard C. Ausness Jan 2015

Sherlock Holmes And The Problem Of The Dead Hand: The Modification And Termination Of "Irrevocable" Trusts, Richard C. Ausness

Law Faculty Scholarly Articles

This Article is about the modification and termination of so-called “irrevocable” trusts. A trust may be made irrevocable at the time of its creation or it may become so at a later time. A testamentary trust is one that is embodied in a will and becomes effective at the testator’s death. Since the testator will be dead by the time the trust becomes effective, he will not be in a position to modify or revoke it. For the same reason, a revocable trust will become irrevocable when the settlor dies or when the power to revoke is released. Finally, an …

Student Press Law: Past, Present, And Future, David R. Wheeler Jan 2015

Student Press Law: Past, Present, And Future, David R. Wheeler

Theses and Dissertations--Communication

This dissertation will identify and describe the state of the law regarding student speech and press freedom. The following questions will be explored: What rights do young people have? What standards have state and federal courts established? To what extent and how clearly have state statutes defined student expressive rights? What do state laws say about this topic? What issues have yet to be addressed, either because a case has not raised certain issues or because the issue does not lend itself to compromise or a clear solution? How does the capacity of social media for widespread and rapid dissemination …

(Mis)Trusting States To Run Election, Joshua A. Douglas Jan 2015

(Mis)Trusting States To Run Election, Joshua A. Douglas

Law Faculty Scholarly Articles

This Article critically examines recent Supreme Court election law jurisprudence, with a particular eye toward cases involving state election administration—a hotbed of litigation at the Court in recent years. Election administration entails the rules of operating an election and encompasses laws such as voter identification requirements, regulation of primaries, and other "nuts-and-bolts" aspects of the voting process. The Article focuses primarily on the last decade, mainly because that is when states have increasingly enacted stricter election regulations, supposedly in the name of "election integrity," but more likely to gain partisan advantage for the ruling party. In addition, during the first …

Joseph Grodin's Contributions To Public Sector Collective Bargaining Law, Alvin L. Goldman

Law Faculty Scholarly Articles

The Labor Law Group, established in the early 1950s, is a unique consortium of labor law professors, and usually a practitioner or two, devoted to improving labor and employment law teaching and scholarship. Its primary activities have been publication of course books and sponsorship of conferences on important new developments. All royalty income goes into a trust fund used solely for carrying on the Group's work. By luck more than by merit, I was invited to join the Group around 1969. Because I had practiced labor law for only a few years on the East Coast before entering law teaching …

Leaping Language And Cultural Barriers With Visual Legal Rhetoric, Michael D. Murray Jan 2015

Leaping Language And Cultural Barriers With Visual Legal Rhetoric, Michael D. Murray

Law Faculty Scholarly Articles

This Article discusses the scholarship of popular culture, cognitive studies and brain science, data visualization studies, modern argument theory in rhetoric, the rapid development of technology in the production of documents, and technology in the reading and reception of documents, which all point to one outcome: the tools of legal education and law practice must become more visual by following principles of visual legal rhetoric and visual narrativity. Visual has become the "new normal" in communication, and legal rhetorical communication in law school and law practice must not let itself fall behind the times.

Law, Legitimacy, And The Maligned Adverb, James M. Donovan Jan 2015

Law, Legitimacy, And The Maligned Adverb, James M. Donovan

Law Faculty Scholarly Articles

The standard rules for good writing dictate that adverbs should be avoided. They undermine the effectiveness of the text and detract from the author’s point. Students and teachers of legal writing have incorporated this general rule, leading them not only to avoid adverbs in their own writings, but also to overlook them in the writings of others, including statutes and cases. However, as Michael Oakeshott has argued, law happens not in the rules but in the adverbs. To become desensitized to the power of adverbs, or to presume that they are weak and unnecessary, leads the reader not only to …

Social Capital At The Capitol: A Social Network Analysis Of Interest Group Influence In The 111th Congress, Steven A. Martin Jan 2015

Social Capital At The Capitol: A Social Network Analysis Of Interest Group Influence In The 111th Congress, Steven A. Martin

Theses and Dissertations--Political Science

This dissertation builds on existing scholarship in political science and political sociology to explore the influence of interest groups in legislative action networks. The primary theoretical insight is that as the number of interest group affiliations between two members of Congress increases, so does the frequency with which they forge other sorts of social ties necessary to advance the interests of their interest group constituencies. In particular, the analysis looks at interest group donation strategies, legislative co-sponsorships, and roll-call votes during the 111th Congress (2009-2010). The analysis uses social network analysis methods to create network models of 19 different …

Impact Of Intellectual Property Promotion For Small And Medium Sized Enterprises (Smes) In South Korea: An Examination Of Ip Star Program Impact, Jongseok Yoon

MPA/MPP/MPFM Capstone Projects

The creation of new processes and technology - in a word, innovation - is a powerful factor that determine s the progress of economies. The creation of new processes and technology can be accelerated by Intellectual Property Rights (IPRs).

However, many Small and Medium-sized Enterprises (SMEs) do not get the most out of their use of the intellectual property, even though they represent over 90 percent of enterprise s in South Korea. As a result, the Korean Intellectual Property Office (KIPO) has initiated support services for Small and Medium-sized Enterprises.

This study 's main focus is to examine the impact …

Building The Case Against Human Trafficking: Developing And Evaluating A Training Module For Law Enforcement Officials, Katie Sanders Jan 2015

Building The Case Against Human Trafficking: Developing And Evaluating A Training Module For Law Enforcement Officials, Katie Sanders

MPA/MPP/MPFM Capstone Projects

Since the passage of federal legislation to address human trafficking in the United States, efforts to measure and combat the crime have continued to grow (Victims of Trafficking and Violence Prevention Act of 2000). Measuring human trafficking has continued to be a difficult task for researchers, law enforcement, and victim services providers. The combined efforts of these groups has lead to the recognition that without more widespread identification of victims and perpetrators of human trafficking—a crime referred to as modern-day slavery—estimates will continue to be inaccurate. In order to improve the identification process, this specific proposal focuses on law enforcement …

Analyzing Charges And Payments Received For Discharged Patients At Teaching Hospitals In Relation To Patient Satisfaction And Overall Medicare Charges, Rob Sutter Jan 2015

Analyzing Charges And Payments Received For Discharged Patients At Teaching Hospitals In Relation To Patient Satisfaction And Overall Medicare Charges, Rob Sutter

MPA/MPP/MPFM Capstone Projects

The affordability of healthcare is a major, recurring topic in the media. One of President Obama’s cornerstone policies has been the attempt to make health care affordable. Part of the concern lies in cost differences for similar procedures. The cost for a standardized procedure such as abnormal cardiac dysrhythmia without complication varies greatly between hospitals. The cost difference of a patient getting treated for such an event can be an average of $30,000 depending on which hospital you go to. There is no immediately apparent reason for such a large difference. Another noticeable item is that all the hospitals receive …

Campaign Finance And The Ecology Of Democratic Speech, Michael Kent Curtis, Eugene D. Mazo Jan 2015

Campaign Finance And The Ecology Of Democratic Speech, Michael Kent Curtis, Eugene D. Mazo

Kentucky Law Journal

Biologists have contributed to our understanding of the world's ecosystems, explaining how the natural world is populated by different species, which are able to thrive and blossom because of the existence of other species in the rightproportion. In similar fashion, the authors of this article believe that the political world has an ecosystem. It is an ecosystem where free speech may thrive or wither, and its fate rests on the delicate balance of political influence between citizens and corporations. This balance is disturbed when concentrations of wealth funnel into the democratic process through campaign spending. The Supreme Court, through its …

Tactical Police Officers, Romantic Attachment And Job-Related Stress: A Mixed-Methods Study, Natalie Fagan Jan 2015

Tactical Police Officers, Romantic Attachment And Job-Related Stress: A Mixed-Methods Study, Natalie Fagan

Theses and Dissertations--Sociology

Stressors stemming from tactical policing such as social isolation and increased work responsibilities often spill over into the home and affect personal relationships. Using attachment theory as the guiding framework, this mixed methods study aimed to obtain a better understanding of the factors involved in maintaining long-term relationships between tactical officers and their romantic partners. Phase I consisted of surveys administered to tactical officers in Kentucky and measured romantic partner attachment, organizational and operational police stressors. Research questions examined how operational and organizational stress correlated with attachment while controlling for demographics. Analysis indicated that holding a rank above an officer …

Should Paris Hilton Receive A Lighter Prison Sentence Because She's Rich? An Experimental Study, Josef Montag, Tomáš Sobek Jan 2015

Should Paris Hilton Receive A Lighter Prison Sentence Because She's Rich? An Experimental Study, Josef Montag, Tomáš Sobek

Kentucky Law Journal

The "equal punishment for the same crime" principle is generally agreed upon--yet its implementation differs radically depending on whether the punishment is measured purely in nominal terms or whether the subjective perspective of the punishee is accounted for. This is simply because different people may experience the same punishment with differing intensity.

Legal scholars have recently proposed that improvements in scientific knowledge and advancements in technologies (such as Functional magnetic resonance imaging), which allow us to measure subjective perceptions and feelings, need to be and should be incorporated in our penal systems. This would facilitate calibrating the punishment not only …

Once We're Done Honeymooning: Obergefell V. Hodges, Incrementalism, And Advances For Sexual Orientation Anti-Discrimination, Jeremiah A. Ho

Kentucky Law Journal

Undoubtedly, the Supreme Court's marriage equality decision in Obergefell v. Hodges is the watershed civil rights decision of our time. Since United States v. Windsor, each recent victory for same-sex couples in the federal courts evidenced that the legal recognition of same-sex marriages in the United States was becoming increasingly secure. Meanwhile, momentum was growing for the visibility of sexual minorities nationally. Yet, is marriage equality the last stop in the pro-LGBTQmovement, or should we expect sexual minorities to advance in other legal arenas? Should we expect that the recent strides in marriage equality from Windsor to Obergefell can …
