Civil Procedure - Discovery Of Medical Records In A Corporate Negligence Action - Shelton V. Morehead Memorial Hospital, G. Bruce Park
Civil Procedure - Discovery Of Medical Records In A Corporate Negligence Action - Shelton V. Morehead Memorial Hospital, G. Bruce Park
Campbell Law Review
This Note will examine the impact of the Shelton decision on requests for the production of hospital records. The Note will emphasize the application of Shelton to corporate negligence actions against a hospital for breach of a duty owed by the hospital directly to the patient. The Note will suggest that, although the Shelton court limited the availability of discovery, diligent plaintiffs may find trial courts less likely to allow a blanket privilege for hospitals claiming immunity from discovery for records conveniently labeled as products of medical review committees. This Note will argue that the plaintiff in a corporate negligence …

Competitive Reform In Health Care: The Vulnerable Revolution, Thomas L. Greaney
Competitive Reform In Health Care: The Vulnerable Revolution, Thomas L. Greaney
All Faculty Scholarship
This article, written at the dawn of the era of "competitive reform" in health care examines the case and prospects for the introduction of competition in health care delivery and financing. It observes the failures of the ancienne regime of fee for service payment and professional sovereignty and discusses the benefits of market-oriented policy. Its contribution, still salient today, is the lesson that competition cannot succeed without regulation. It identifies legislative, professional, and cultural hurdles to effective implementation of competitive norms and policies that have impeded the success of competition policy in health care.
Testing For Drugs Of Abuse: Methods And Reliability, Edward A. Kaufman
Testing For Drugs Of Abuse: Methods And Reliability, Edward A. Kaufman
Journal of Law and Health
The purpose of this paper is to discuss the entire testing process, from specimen collection and preparation (vital processes that are often beyond the control of the laboratory) to test methods, quality assurance measures, medico-legal documentation, and result reporting and interpretation. Each of these steps demands careful attention, and the hallmark of a responsible, quality-conscious laboratory is that it can offer a complete testing system that focuses not only on the assays themselves but also on each of the necessary precautions and transactions so crucial to the viability of test results.
Executive Order 12,564: Toward A Drug-Free Federal Workforce, Robert M. Kruger
Executive Order 12,564: Toward A Drug-Free Federal Workforce, Robert M. Kruger
Journal of Law and Health
For all of these reasons, the President issued an Executive Order on September 15, 1986, designed to achieve a drug-free federal workplace. Consistent with the President's views, it focuses on helping, not punishing, drug users. Time does not permit me to go into each of the Order's provisions in great detail. I would, however, like to offer an overview of the major provisions of the Order. In deference to the occasion, I will concentrate on the provisions of the Order which authorize the use of drug testing to achieve that objective. The Executive Order calls upon "agency heads," the chief …

A Management Perspective On The Controlled Substance Testing Issue: Management's Newest Pandora's Box, Jan P. Muczyk, Brian P. Heshizer
Journal of Law and Health
A new literal meaning has been given to the adage of offering one' sweat and blood to the employer - to which is added as well, one's urine. Little wonder then that so many private and public employers have rushed into drug screening programs. Given the trend of recent events, it would seem that an imperative does exist for drug testing at the workplace. However, before organizations establish testing programs, management should consider the known problems associated with substance testing and the organizational implications of such testing.

Ten Years After: Evolving Mental Health Advocacy And Judicial Trends, Michael L. Perlin
Ten Years After: Evolving Mental Health Advocacy And Judicial Trends, Michael L. Perlin
Fordham Urban Law Journal
"Address to the Mental Health Legal Advocacy Symposium, "Current Issues in Law and Psychiatry," New York, New York, May 30, 1985." This speech provides an overview of trends in mental disability law as they evolved from 1972 to 1982. It also explores social, economic, and political developments impacting on mental health advocacy, and looks at both seminal supreme court cases and lower courts' responses. It finds an ambivalent Supreme Court without a clear position on many issues related to mentally disabled individuals.
