Over the last generation, state governments have undertaken a major disinvestment in higher education. The questions raised by these funding reductions go beyond matters of crowded classrooms, dilapidated facilities, and altered pedagogies to challenge the basic function of college and university education in the United States. Will higher education continue to be the gateway to equality and provider of broad horizons for citizens, or will it be transformed into a bulwark of social privilege and narrow conveyor of vocational skills for private consumers? These are the ultimate questions posed by the funding priorities of the state legislatures in America today.

Higher education’s financial crisis is being resolved largely through a politics of privatization, changing patterns of financing that increasingly shift responsibilities to individual students and their families. The politics of privatization makes it ever more difficult for low income students to attend college and has become a major financial burden for middle income people. Beyond cost shifting, privatization has increasingly subordinated the research and educational missions of higher education to imperatives of economic growth and competitiveness. In sports, especially baseball, there is a lot of talk about contract year performance. Beginning in spring training and continuing throughout the season, sports journalists and fans converse about how players in the last year of their contract will perform. Experts in the media, often ex-baseball players themselves, speculate contract year players will have break-out seasons in order to secure a better contract in upcoming contract negotiations. This leads to the question: do baseball players increase their effort and performance during their contract year to increase the value of their next contract?

This Essay examines U.S. Supreme Court Justice Sonia Sotomayor’s important role in shaping U.S. sports law. As a judge on the U.S. District Court for the Southern District of New York and later on the U.S. Court of Appeals for the Second Circuit, Sotomayor authored opinions that resolved two major sports law disputes: whether Major League Baseball (“MLB”) owners could unilaterally impose new labor conditions on MLB players during the 1994 baseball strike and whether Ohio State University sophomore Maurice Clarett was obligated to wait three years from the completion of high school to become eligible for the National Football …

The working-class in the United States has been, and continues to be, systematically excluded from normative political representation and is allowed little opportunity to contribute to the terms and conditions of its social existence (Henwood, 1987; Moberg, 1992). While few workers today resist such marginalization, this has not been always the case. During the formative period of U.S. labor consciousness (from the end of the Civil War until the First World War), the political alienation of labor was routinely challenged by workers who relied extensively (and illegally) on collective self-help in their pursuit of economic justice. Each year, the National Basketball Association (NBA) conducts its annual entry draft (NBA Draft), which is the exclusive process by which premiere amateur players gain entrance into the NBA. To the dismay of many commentators, a number of drafted players will have just completed their senior year of high school. Routinely, these players are dismissed as immature, unprepared, and ill-advised, even though most will sign guaranteed, multi-million dollar contracts before their college educations would have begun. This paper examines the rise and fall of Eastern Airlines from 1928 to 1991. lt outlines the carrier's development under a succession of leaders and discusses the major events of each leader's reign. From a small contract mail carrier known as Pitcairn Aviation, Eastern grew to become one of the largest airlines in the free world. But after 26 years of growth and prosperity under the leadership of Eddie Rickenbacker, the airline began to stumble in the early 1960s.
