Toward The Feminization Of Collective Bargaining Law, Gillian L. Lester
Faculty Scholarship
Canadian collective bargaining law is flawed because it fails to address the concerns of a substantial segment of the work force and overlooks women as a rich source of insight into the dynamics of the bargaining environment. The author begins by exploring the problems inherent in the classical contractualist model, arguing that current collective bargaining law reflects these weaknesses and echoes a morality and ideology which are stereotypically masculine. By analyzing the legal and practical structures of collective bargaining, the author illustrates the ways in which the "morality of the workplace" is manifested differently between men and women. The Illinois Educational Labor Relations Act (IELRA) took effect on January 1, 1984. By the 1988-89 school year, the number of Illinois public school districts with negotiated contracts had increased by nearly 68%, from 507 to 850. The effect of the Act on multi-district special education cooperatives is not as easily determined.
Directors of Illinois' 54 multi-district special education cooperatives outside Cook County were surveyed to obtain demographic data and information on the collective bargaining experiences of these cooperatives. Responses were received from 41 directors (76%).
These directors reported geographic sizes ranging from 144 to 4,000 square miles, with enrollments …

This study examined the current status of collective bargaining between boards of education and classified educational employees in eighteen selected Illinois public schools. The collective bargaining agreements from the respondent school districts were examined and data were researched and collected concerning items currently impacting the negotiations process. The results of the study indentified information with regard to the following areas of the collective bargaining agreements: 1. Union affiliation of the employee bargaining units. 2.
