Journal of Collective Bargaining in the Academy

This paper is intended to provide a foundation for further discussion and debate at the plenary panel on “Civility and Academic Freedom” at the National Center’s annual conference on April 20, 2015. The discussion, below, sets forth a structure for evaluating university policies seeking promote “civility” in faculty and student discourse. In particular, this paper evaluates the asserted justifications for civility-related policies and their implications for academic freedom. The paper provides, as well, a list of AAUP materials useful for considering the academic freedom implications of civility-related policies in universities.

Boom & Bust: The Perils Of Guaranteed Long Term Contracts. Evidence From Ops100 Performance Over The Contract Cycle, Heather M. O'Neill

This study focuses on panel data of 256 MLB free agent hitters under the 2006-2011 Collective Bargaining Agreement (CBA) to demonstrate that hitters, on average, increase their offensive production, measured by OPS100, during the last year of their contract and subsequently underperform the first year of the newly signed long term contract. The contract year phenomenon arises from the incentive to land a lucrative guaranteed contract for players not intending to retire. Signing a long term guaranteed contract creates an incentive to shirk (underperform) the first year of the new contract because performance and pay become unlinked and the need …

Educational services, particularly higher education, has slowly and methodically become one of the most heavily unionized segments, with much greater representation than traditional labor segments. Despite these changes, the increase in academic collective bargaining has not been well documented. Consequently, the purpose of the current paper is to examine recent trends in academic collective bargaining and to compare these trends with the current unionization and collective bargaining situation in other major industries in the United States. Post-Recession Cbas: A Study Of Wage Increases In The Agreements Of Four State-Wide Faculty Unions, Steve Hicks

Journal of Collective Bargaining in the Academy

The article looks at the post-Recession (2011) agreements of four state-wide faculties: California State system, SUNY, Minnesota and Pennsylvania. Focusing on wages, the study starts with the context of state appropriations after the Recession and after ARRA. It finds that the agreements took longer, yet without job action, and each had a year with no salary increase, and some agreements include both no salary increase AND no seniority-based increase.

Collective Bargaining In Higher Education: Observations From An Ace Fellow, José Antonio Rosa Phd

The author, a member of the 2013-2014 American Council on Education Fellows Class, offers observations and synthesis on factors affecting the viability and execution of collective bargaining in higher education. Building on the history of the academy, and taking into account environmental factors such as technology and social trends, the author proposes that greater senior leadership involvement, transparency, and flexibility may be needed for collective bargaining units in colleges and universities to be successful, as change continues to assail higher education.

Wage Distribution Impacts Of Higher Education Faculty Unionization, Charles S. Wassell Jr., David W. Hedrick, Steven E. Henson, John M. Krieg

Economics Faculty Scholarship

The literature on the effects of unions on the distribution of wages at the macroeconomic and inter-industry levels has given little attention to the effects at the firm level. At the same time, research on collective bargaining impacts in higher education has focused on the overall wage level rather than on the distribution of salaries. Using panel data on individual faculty members, we find faculty unionization to be associated with a significant flattening of the wage distribution across academic disciplines. This has implications for why faculty might choose to unionize, even in the absence of an overall wage premium.

This study focuses on 256 MLB free agent hitters playing under the 2006-2011 CBA to determine whether they boost their offensive performance in their contract year. Prior studies’ results are mixed, depending on the econometric technique used and the choice of the offensive performance measure.

Having multiple year observations per player, one can incorporate the unobserved traits of the players (ability, risk aversion, work ethic, etc.) by using Fixed Effects (FE) estimation. Since these unmeasured player traits are likely to be correlated with observed predictors of performance (games played, playoff contention, age, etc.), traditionally used Ordinary Least Squares (OLS) and …

This study focuses on 256 Major League Baseball free agent hitters playing under the 2006–2011 collective bargaining agreement to determine whether players engage in opportunistic behavior in their contract year, i.e., the last year of their current guaranteed contracts. Past studies of professional baseball yield conflicting results depending on the econometric technique applied and choice of performance measure. When testing whether players’ offensive performances increase during their contract year, the omitted variable bias associated with OLS and pooled OLS estimation leads to contrary results compared to fixed effects modeling. There is no question; nurses play a key role in healthcare. Nurses provide direct care, coordinate health promotion activities, educate, and provide support and advocacy to patients. Today, there are over two million registered nurses in the United States. My research aims to determine the variables that influence some nurses to be more politically active and more engaged in unionization than their counterparts. I analyze The National Sample Survey of Registered Nurses 2004 looking at a variety of potential explanations for union participation. The significance of the disinvestment in American baccalaureate, Ph.D. and community college institutions in recent years can hardly be exaggerated. The quandary posed by the attendant reduced funding goes beyond issues of crowded classrooms and dilapidated facilities; ultimately it questions whether our higher education will continue to be a gateway to equality and guarantor of opportunity, a path to broader horizons for citizens—or if it will be transformed into a bulwark of social inequality and vehicle for narrow vocational instruction.

The fiscal crisis of higher education currently is being resolved largely through a financing policy of privatization, a pattern that increasingly shifts responsibility to individual students and their families. The politics of privatization makes it ever more difficult for lower-income students to attend college and has become a major financial burden for middle-income people. Beyond the direct financial consequences, privatization has increasingly subordinated the research and educational missions of higher education to the countervailing imperatives of economic growth and competitiveness.
