Adversaries And Experts: Legal Tradition Versus Empirical Science, André M. Peñalver

The modern courtroom can become a battleground between two epistemologies: the adversarial logic of law and the empirical rigor of science. Using a case involving a neuropsychological exam under Washington Civil Rule 35, this Article explores the tension between these traditions. While medicine embraced the Scientific Revolution, law remains tethered to its medieval Scholastic roots. The Article argues for humility and integration of evidence-based reasoning within the adversarial process.

Since the 1970s, governments and organizations across the globe have achieved tremendous progress against sexual harassment (SH), especially in the workplace. However, the number of organizations suffering from this crisis has increased significantly over the past few years. Based on an overview of SH crises -that have received extra media coverage since 2014- this paper explores whether organizations managed to learn from these crises. Compared to other crises, SH scandals produce a higher magnitude of provocation within society. Natural polysaccharides, such as chitosan, offer promising avenues for drug delivery due to their cytocompatibility and ability to interact with cell surfaces. However, the endothelial glycocalyx, a glycan-rich extracellular matrix, presents a barrier that must be navigated for effective intracellular delivery. This study investigates how cationic poly(glucosamine)-based polymers, functionalized with guanidinium or ammonium groups, interact with key glycocalyx components including hyaluronan (HA) and heparan sulfate (HS). We demonstrate that these cationic polymers form tunable biomolecular condensates with glycans, with stronger binding observed for sulfated glycans, HS and heparin, than unsulfated HA. Business is commonly understood as a parent discipline of tourism research, making business journals essential for epistemological inquiry. This paper reviews tourism literature in business journals, analysing the presence of Critical Tourism Studies, which addresses limitations of management-oriented approaches. Our analysis reveals limited engagement with Critical Tourism Studies in business journals, only 27% of reviewed articles aligning with its tenets. We propose a framework for Critical Tourism Business Studies that identifies knowledge gaps and highlights future directions for scholars publishing tourism-related topics in business journals. During the fall of 2023, Utah Women & Leadership Project (UWLP) researchers conducted a statewide study to establish a baseline for public perceptions related to the awareness, understanding, and attitudes about challenges that Utah women and girls face. This study examines the extent to which Indian technology equities generate sufficient returns relative to their inherent volatility and assesses whether intra-sector diversification can improve outcomes in this dynamic, high-risk sector. Drawing on data from January 2020 to April 2025, ten leading firms are analyzed using an integrated approach that incorporates traditional risk-adjusted indicators, downside-sensitive metrics, and a six-factor model featuring momentum. The results show clear heterogeneity in performance. Mid-cap innovators such as Persistent Systems and Coforge deliver positive and, in some cases, statistically significant alphas, while large-cap stocks including Infosys, Tata Consultancy Services (TCS), and Wipro provide stability but …

The general public and even some scholars challenge the legitimacy of levying the property tax under conditions where land is state-owned and multi-year land-use fees have already been collected at the time of house sales. This challenge points to the legal- theoretical foundations of property taxation: the core issue is whether the rights and economic utility of China's construction land-use-rights (CLUR) are sufficient to be treated as the object of property tax levy. Job Stress, Emotional Exhaustion, And Work-Family Conflict: A Moderated Mediation Model, Sina Eslamdoust, Jeeyoon Jeong, Ji Hoon Lee, Ye Dai

Despite extensive research on work-family conflict (WFC), questions remain about when and why job stress translates into family domain interference. Drawing on Conservation of Resources (COR) theory (Hobfoll, 1989), this study examines whether emotional exhaustion mediates the relationship between job stress and WFC, and whether authoritarian leadership moderates this process. Using data from 1,095 U.S. employees, we find that emotional exhaustion serves as a key mediating mechanism, consistent with resource depletion arguments. More importantly, we demonstrate that authoritarian leadership significantly amplifies the stress-exhaustion relationship through mechanisms identified in prior research: reduced autonomy, increased monitoring, and blocked recovery. To identify the main barriers and challenges faced by LGBTQIAPN+ leaders in the workplace and examine their relationships with leadership self-efficacy. Methodology: Data collection involved LGBTQIAPN+ individuals in leadership positions, resulting in responses from 1,156 participants. To test the proposed theoretical model, Structural Equation Modeling analysis was performed. Main results: The findings highlighted issues related to group composition and diversity in sexual orientation and gender identity as the main barriers and challenges. The validation of the hypotheses supported the notion that the difficulties experienced by LGBTQIAPN+ individuals at work can provide them with valuable skills that lead to leadership, making …

Including technology in the accounting curriculum encourages the adoption of active learning whereby students explore accounting from an individualized manner that better engages students, motivates them to problem solve, and hopefully, allows them to enjoy the learning process and gain more from it. From a curriculum planning standpoint, the introduction of active learning-based technology curriculums also provides information about the perceptions students have about themselves, the accounting profession, and the role technology plays in accounting. This comprehensive study of Dayton, Ohio’s minority entrepreneurial ecosystem was supported by the Ewing Marion Kauffman Foundation. Based on a multi-year research effort and in-depth interviews with business support organizations (BSOs) and ecosystem stakeholders, the study examines how Dayton’s extensive network of entrepreneurial services supports minority and underrepresented entrepreneurs, identifies persistent gaps, and documents how the ecosystem has evolved amid COVID-19 disruptions, declining federal funding, and shifting approaches to diversity, equity, and inclusion. We examine whether the SEC’s XBRL-formatted financial reporting mandate allows investors to better process public financial information, reducing the extent to which managers learn private information from stock price. We find a significant decrease in the investment-price sensitivity for firms that started to file their 10-Ks in an XBRL format, consistent with a reduction in the cost of information processing crowding out private information in stock price. We also find that the decrease in the investment-price sensitivity associated with XBRL adoption is more pronounced for firms with higher business and information complexity and for firms with higher incentives for managers …

Prior studies have shown that women possess unique personality traits that cause them to communicate differently than men do. Hence, we investigate whether the presence of female CEOs affects the use of visual expressions in a firm’s ESG report (“ESG visual expressions”). Using detailed disclosure data from ESG reports in China, we find that firms with female CEOs use more ESG visual expressions. This result is stronger when the firm prioritizes ESG performance, when the female CEO is more powerful, and when there are more women on the top management team. Using audit hours from firms listed on the Korea Exchange as a direct proxy for audit effort, this study examines whether non-audit services (NAS) purchased from audit firms improve audit efficiency. Our results reveal that the ratio of NAS fees to total fees paid to audit firms is associated with lower audit hours and audit fees, but it is not significantly related to audit billing rates. The reduction in audit effort associated with NAS is more pronounced when NAS provided are audit-related, and for clients who hire Big 4 auditors, have short-tenured auditors, and report a profit. Since the 1990s, the faculty of U.S. colleges and universities has shifted from a workforce dominated by full-time tenured and tenure-track positions to one in which contingent appointments predominate. According to the American Association of University Professors, contingent faculty grew from about 47 percent of the national workforce in 1987 to roughly two- thirds by 2021 (AAUP, 2023). Business schools faced the same pressures, including cost constraints, a shortage of doctorally qualified faculty, ranking competition, and revised accreditation standards, but they responded differently.
