The effectiveness of monitoring and incentive alignment as mechanisms for controlling agency costs have been explored separately and in combination, with monitoring substituting for weaknesses in incentive alignment and vice versa; this equates to positive substitution when describing how monitoring and incentive alignment interact to influence shareholder agency costs. We draw upon behavioral agency theory and findings from finance research to offer further theoretical insight into how these mechanisms interact to influence agency costs. Our results suggest that CEO earnings management aimed at preserving their equity wealth (an incentive alignment mechanism) is accentuated by higher levels of concentrated institutional ownership, …

This chapter describes a pilot study of student research-based writing in a technical and professional writing course designed for college-level juniors and seniors across the curriculum; fifteen analytical research papers are coded based on the rhetorical move John Swales (1990) calls "reference to previous research" to increase our understanding of how students use sources to introduce, support, or compare/contrast ideas and previous research. Student papers in this study overwhelm­ingly used sources to support main ideas, occasionally used sources to introduce ideas, often in the form of topic sentences, but rarely used sources to compare/contrast ideas. Multi-stakeholder sustainability alliances (MSSAs) have recently emerged to reduce externalities in the agri-food sector; creating a new dimension to bargaining power. This paper describes the new dimension to market power, and quantifies the governance rules effects to bargaining power and sustainability outcomes in MSSAs. Sustainability initiatives are simulated in U.S. corn and soybean production using the APEX model.  Shapley values are then estimated to quantify bargaining power changes given alternative governance rules in a MSSA. The results demonstrate with transferable eco-label benefits, and proper governance rules, MSSAs can achieve cooperative sustainable outcomes.

In 2012, the World Organisation for Animal Health adopted 10 ‘General Principles for the Welfare of Animals in Livestock Production Systems’ to guide the development of animal welfare standards. As part of a larger project to determine if there are animal-welfare-related values shared by some commercial food–animal producers and non-producers in Canada, open-ended, semi-structured interviews were conducted to elicit opinions about animal welfare among 24 urban and rural residents not involved in commercial animal production. All participants possessed a self-described interest in food animal well-being and were therefore assumed to represent the views of Canadian non-producers most apt to engage in efforts to shape the animal welfare policies of governments and businesses. Commercial beef production in western Canada involves raising cows and calves on large tracts of grassland, plus grain-based ‘finishing’ of animals in outdoor feedlots. This study used open-ended, semi-structured interviews to explore views on animal welfare of 23 commercial beef producers in this system. Although wary of the term ‘animal welfare’, participants understood the concept to encompass three well-known elements: (i) basic animal health and body condition; (ii) affective states (comfort, contentment, freedom from hunger or thirst); and (iii) the ability to live a ‘natural’ life. As part of a larger study eliciting Canadian producer and non-producer views about animal welfare, open-ended, semi-structured interviews were used to explore opinions about animal welfare of 20 Canadian pig producers, most of whom were involved in confinement-based systems. With the exception of the one organic producer, who emphasized the importance of a ‘‘natural’’ life, participants attached overriding importance to biological health and functioning. They saw their efforts as providing pigs with dry, thermally regulated, indoor environments where animals received abundant feed, careful monitoring and where prospective disease outbreaks could be minimized and controlled. curvilinearity, and confounding, all attempt to dissect an XY simple linear effect into various components.

In FTC v. Actavis, Inc., the Supreme Court considered "reverse payment" settlements of patent infringement litigation. In such a settlement, a patentee pays the alleged infringer to settle, and the alleged infringer agrees not to enter the market for a period of time. The Court held that a reverse payment settlement violates antitrust law if the patentee is paying to avoid competition. The core insight of Actavis is the Actavis Inference: a large and otherwise unexplained payment, combined with delayed entry, supports a reasonable inference of harm to consumers from lessened competition.This paper is an effort to assist courts and …

In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The Supreme Court’s opinion in Federal Trade Commission v. Actavis, Inc. provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. In our previous article, Activating Actavis, we identified and operationalized the essential features of the Court’s analysis. Our analysis has been challenged by four economists, who argue that our approach might condemn procompetitive settlements.As we explain in this reply, such settlements are feasible, however, only under special circumstances.
