Texts, Language, And History In The Madhab-Law Tradition: A Study Of The ShāfiʿĪ School, Tarek Ghanem

This thesis advances the study of the legal literature from the madhhab-law tradition by way of studying the Shāfiʿī literary tradition and its two most authoritative classics. These two works are al-Nawawī’s (d. 676/1278) digest Minhāj al-ṭālibīn and Ibn Ḥajar al-Haytamī’s (d. 974/1567) commentary on it, Tuḥfat al-minhāj. This study will provide a typology of the development of the Shāfiʿī juristic texts. The typology is based on an indigenous and coherent periodization centered around an analysis of the intellectual and social developments within the Shāfiʿī legal tradition, not the classical Eurocentric periodization scheme. This thesis examines the way in which various groups have used religion as a justification for violent action towards political ends. From the Irgun, which carried out terrorist acts in Palestine, to the Palestinian Islamist organization Hamas, which has waged war on Israel, to the Buddhist leadership of Myanmar, which has waged a genocidal campaign against Rohingya Muslims living in the country, these groups have employed a narrow interpretation of their religious texts as a means to justify the actions they take. What is the Muslim conception of the Divine? To answer this question, we first must look to the Qur’an, since Muslims consider it God’s self-revelation to human beings. However, when we look to the Qur’an for guidance, we are presented with a God who describes Himself using Names that indicate both His incomparability to creation (tanzīh) and His similarity (tashbīh) to the created order. For example, God refers to Himself as the Hearing (as-Samī), the Seeing (al- Baṣīr), and the Living (al-Ḥayy), but also says He is the Unique (al-Ahad). The paper examines democracy and secularism in Malaysia, a state rooted in Islam, and how it has been implemented in a country with a majority Muslim population. It briefly outlines how Islam was brought to the region and how British colonialism was able to implement secularism and democratic practices in such a way that religion was not wholeheartedly erased. This study examines the role that Islamic law has played thus far in reforming the Moroccan Family Code, also known as the Moudawana. When King Mohammed VI reformed this law in 2004, Morocco received immediate international praise for its liberal strides towards gender equality. Through this study I investigated the hermeneutical tools and methods of ijtihad employed both by the drafters of the Moudawana and by activists leading up to the 2004 reforms. This article explores ways in which film expresses “internal history” in the context of Muslim cultures. As such, it enquires how film can work as both Islamic art and historical contemplation. The films discussed here, Nacer Khemir’s Wanderers in the Desert and Muhammad Rasoulof’s Iron Island, inhabit and explore the borderline between imagination and reality. In his 2005 film The Willow Tree (Bīd-i Majnūn), Majid Majidi offers a complex moral commentary on the faculty of sight. To do so, the filmmaker draws from Sufi theories of gazing, in which desire must be for ultimate meaning (maʿnā), as conveyed through the vehicle of perceivable form (ṣūra), a distinction with both metaphysical and ethical implications. Copulative phraseological units (CPU) occupy a special place in the Persian phraseological fund. These include fixed phrases which built on the model name+and+name, name+and+adjective, belonging to the same grammatical row. In these phrases, the linking conjunction واو عطف vāv-e a’tf is used as a connecting element. The linking conjunction واو عطف vāv-e a’tf is always pronounced “о” "in both fixed and free phrases.
