If It’S Broke, Fix It: Fixing Fixation, Megan M. Carpenter

The fixation requirement, once an intended instrument for added flexibility in copyrightability, has become an unworkable standard under modern copyright law. The last twenty-five years have witnessed a dramatic expansion in creative media. Developments in both digital media and contemporary art have challenged what it means to be fixed, and cases dealing with these works reveal how inapposite current interpretations of fixation are for these forms of expression. Yet, getting fixation “right” is important, for it is often the juridical threshold over which idea becomes expression. Chapter Summary: A 2009 exhibition at the Fitzwilliam Museum on the confluence of science and the visual arts included a plate from a nineteenth-century encyclopedia owned by Charles Darwin showing a tarantula poised over a dead bird (figure 3.1).1 The genesis of this startling scene was a work by Maria Sibylla Merian (German, 1647–1717), and the history of this image says much about how knowledge of the New World was obtained, and how it was transmitted to the studies and private libraries of Europe, and from there into popular works like Darwin’s encyclopedia. The Godey Quilt: One Woman’S Dream Becomes A Reality, Sandra L. Staebell

The Godey Quilt is a 1930s appliqué quilt composed of fifteen fabric portraits of men and women clothed in fashionable mid-nineteenth century attire. The dream of Mildred Potter Lissauer (1897−1998) of Louisville, Kentucky, this textile is a largely original design that is not representative of the majority of American quilts made during the early 1930s. Notable for the beauty and quality of its workmanship, the quilt’s crafting was, in part, a response to the competitive spirit that reigned in quiltmaking at the time. In recent years, the Government of the HKSAR has updated its policy to improve urban greenery and landscaping. According to the greening plan of the Greening, Landscape, and Tree Management Section (GLTMS) under the Development Bureau, there are new requirements in place to provide a minimum of 20-30% of greenery to both government and private developments. Hence, the demand for landscape and horticultural management, in particular aspects related to arboricultural maintenance and management, has increased largely. Daniel Dean and Ben Moren are both longtime contributors to MAW. Sharing an interest in experimental filmmaking, they formed Mobile Experiential Cinema (MEC) in 2011 for a Northern Spark commission to explore site-specific projection. They have subsequently collaborated on several works that explore comparable themes and ideologies. MEC makes use of the Mobile Broadcasting Unit developed by MAW as a platform for their own work, but Dean and Moren make significant changes to the outfit to facilitate their divergent approach to site-specific, responsive projection.

Four faculty researchers, two from Virginia Commonwealth University in Qatar, and two from Weill Cornell Medicine in Qatar developed a one semester workshop-based course in Qatar exploring the connections between art and medicine in a contemporary context. Students (6 art / 6 medicine) were enrolled in the course. The course included presentations by clinicians, medical engineers, artists, computing engineers, an art historian, a graphic designer, a painter, and other experts from the fields of art, design, and medicine. To measure the student experience of interdisciplinarity, the faculty researchers employed a mixed methods approach involving psychometric tests and observational ethnography. Data …

This chapter discusses the implications of wearable technologies like Google Glass that function as a tool for occupying, commodifying, and profiting from the bio- logical, psychological, and emotional data of its wearers and those who fall within its gaze. We argue that Google Glass privileges an imaginary of unbridled exploration and intrusion into the physical and emotional space of others. The art environments of Spain – like those the world over – display an astounding conceptual creativity and a vernacular, seat-of-the-pants approach to construction that makes use of locally available found, natural, and recycled objects as well as fabricated components built from scratch. Each result is unique, revealing each creator-builder’s interests, challenges, and concerns as they have developed over the course of a lifetime; as such, it is easy to understand why art environments are so complex.
