Killing, Letting Die, And The Case For Mildly Punishing Bad Samaritanism, Ken M. Levy

For over a century now, American scholars (among others) have been debating the merits of “bad-samaritan” laws – laws punishing people for failing to attempt “easy rescues.” Unfortunately, the opponents of bad-samaritan laws have mostly prevailed. In the United States, the “no-duty-to-rescue” rule dominates. Only four states even have bad-samaritan laws, and these laws impose only the most minimal punishment – either sub-$500 fines or short-term imprisonment.

This Article argues that this situation needs to be remedied. Every state should criminalize bad samaritanism. For, first, criminalization is required by the supreme value that we place on protecting human life, a …

This article analyzes how the execution of business strategy for global enterprises is shaped by the dual challenges of communicating in a different national culture and working in a changing economic environment. The article develops a framework from the UPS case in China to illustrate the key components of strategy for US companies operating businesses in China. The article proposes that Chinese-American communication effectiveness can be achieved through overcoming five obstacles: cultural multiplicity, relationship/ task orientation, time concept, business style difference, and language use, while utilizing five facilitators:pragmatism, gender equality, English, American pop culture, and a "big country mentality."

The purpose of this chapter is to explore the trends and challenges in teacher education and teacher professional development in the context of recent Argentinean educational reforms. This chapter synthesizes several of our studies on the matter. Zebulon Pike is known in history books as one of America’s heroes—a great explorer whose adventures in the American West rivaled the Lewis and Clark Expedition and who became the namesake for Colorado’s Pike’s Peak. But what if the history books got it wrong, and Pike was actually not the hero everyone thinks he is? What if he was actually a spy carrying out a secret mission, or a scoundrel interested in overthrowing the American government and helping to carve a new empire out of the North American Southwest? Theriodopteryx ephemeraeformis commonly known as bag worms produce ultrafine silk fibers that are remarkably different than the common domesticated (Bombyx mori) and wild (Saturniidae) silk fibers. Bag worms are considered as pests and commonly infect trees and shrubs. Although it has been known that the cocoons (bags) produced by bag worms are composed of silk, the structure and properties of the silk fibers in the bag worm cocoons have not been studied. According to a standard characterization of dispositions, when a disposition is activated by a stimulus, a manifestation of that disposition typically occurs. For example, when flammable gasoline encounters a spark in an oxygen-rich environment, the manifestation of flammability—combustion—occurs. In the dispositions/powers literature, it is common to assume that a manifestation is an effect of a disposition being activated. (I use “disposition” and “power” interchangeably). I address two questions in this chapter: Could all manifestations be effects that involve things acquiring only dispositional properties? And, is thinking of manifestations as contributions to effects preferable to thinking of them as effects? I …

Research on women in the workplace tends to conflate categories of hourly workers, part-time employees, and middle- and upper-management careers. Yet, the literature on balancing career and family life does not adequately portray the experiences of executive women. Middle-school male students currently face a disadvantage in reading comprehension compared to female students. Research suggests the problem is that more male students score below grade level in reading comprehension because they require more cognitive scaffolding. The purpose of this study was to evaluate the effectiveness of text-to-self reading instruction and to compare the comprehension achievement of male and female students in 6th-grade reading and language-arts classes using guided reading of text-to-self instruction and guided reading using novels. The relevant literature consistently suggests that understanding citizen participation in community action programs is needed to maximize network governance efforts. Yet, there is no empirical evidence demonstrating a relationship between levels of network governance (NG) and citizen participation rates. The purpose of this study was to determine the degree to which levels of NG is correlated with levels of citizen participation in community action agency (CAA) programs, and whether variations in NG or variations over time in average income level is more strongly related to participation. In this thesis I set out to determine the possible motivations in response to which Diotima agreed to teach Socrates the arts of love. In the process I develop a broader understanding of Diotima and her natural, feminine complexity. This understanding of Diotima suggests an interpretation of her teaching to show that, for all that can be said of love it is, importantly a re-orientation from self-centred interest to other-centred interest and it is this re-orientation which impacted on Socrates and by which he was persuaded.

At his death at age one hundred in 2005, Ernst Mayr was hailed as the greatest evolutionary biologist of the twentieth century. His definition of species, published in 1942 in Systematics and the Origin of Species and known as the “biological species concept,” is familiar to every tenth grader: “Species are groups of interbreeding natural populations that are reproductively isolated from other such groups.” That definition, together with Mayr’s and Theodosius Dobzhansky’s theory of speciation, enabled the integration of modern genetics and Darwinian evolutionary theory. After all, whether as practitioner or scholar a person cannot begin to ask or answer questions about international law until he or she has some sense of what the law is. This requires in turn a basic grasp of the processes whereby international legal norms and regimes come to exist. The question can be raised whether the category or discipline of philosophical aesthetics existed before the eighteenth century. Unlike "logic:' "ethics:' and "physics:' a traditional Stoic division of philosophy with great staying power, "aesthetics" is clearly a product of modernity. As Paul O. Kristeller demonstrated in "The Modern System of the Arts:' it was in the eighteenth century that the idea of the aesthetic as a distinctive human capacity and the parallel consolidation of the notion of the fine arts crystallized in the writings of (mostly) French, German, and English philosophers and critics. Neither John Chrysostom’s efforts to evangelize in Sasanid Persia nor the conflict fought between Rome and Persia in 421 have drawn a great deal of attention.¹ So this paper will attempt to navigate the 20 years from John’s initial efforts up to the outbreak of the war without much modern support. This study explores how second language (L2) learners perceive indirect (hedging or indirect speech acts) and direct written teacher feedback. Though research suggests that indirect speech acts may be more difficult to interpret than direct speech acts (Champagne, 2001; Holtgraves, 1999), using indirect speech acts is often encouraged in the learning process, with the idea that it helps students discover their own errors (Ferris, 2007; Riley and Mackiewitz, 2003;). However, it may not be effective with L2 learners who often need more explicit instruction to understand how to revise their writing (Ferris, 2002). To examine the effect of different directness …
