Habermas And The Postal Rule, Peter Goodrich
Habermas And The Postal Rule, Peter Goodrich
Cardozo Law Review
It seems somewhat churlish at the end of so much discussion, at the terminus of the circulation of so extensive a commentary and critical appraisal of a single text, to offer further doubts, to intimate certain additional, and worse, extraneous criticisms of Jurgen's contribution to jurisprudence. Nonetheless, there is a tangible theme of misunderstanding, noncomprehension, and failed communication that has accompanied the debate in this conference and can act as the proximate emblem of the following intervention. This essay will simply suggest that there is little in Habermas's study of legal discourse and of the conditions under which the rule …

Nietzschean Genealogy And Hegelian History In The Genealogy Of Morals, Philip J. Kain
Nietzschean Genealogy And Hegelian History In The Genealogy Of Morals, Philip J. Kain
Philosophy
I would like to offer an interpretation of the Genealogy of Morals, of the relationship of master morality to slave morality, and of Nietzsche's philosophy of history that is different from the interpretation that is normally offered by Nietzsche scholars. Contrary to Nehamas, Deleuze, Danto, and many others, I wish to argue that Nietzsche does not simply embrace master morality and spurn slave morality.1 I also wish to reject the view, considered simply obvious by most scholars, that the iibermensch develops out of, or on the model of, the master, not the slave.2 And to make the case for all …
Moorean Absurdities And The Nature Of Assertion, John N. Williams
Moorean Absurdities And The Nature Of Assertion, John N. Williams
Research Collection School of Social Sciences
I argue that Moore's propositions, for example, 'I went to the pictures last Tuesday but I don't believe that I did' cannot be rationally believed. Their assertors either cannot be rationally believed or cannot be believed to be rational. This analysis is extended to Moorean propositions such as God knows that I am an atheist and I believe that this proposition is false. I then defend the following definition of assertion: anyone asserts that p iff that person expresses a belief that p with the intention of causing relevant epistemic change in the cognition of an actual or potential audience.
Habermas And The Counterfactual Imagination, Michael K. Power
Habermas And The Counterfactual Imagination, Michael K. Power
Cardozo Law Review
The epistemological problem of critical theories is easy to state but hard to resolve. On the one hand, if the theories are too descriptive and draw their conceptual resources from the ideas and institutions which currently exist, they lose their critical force. While they may provide elaborate reconstructions of the structure of social practices, they remain internal to these practices, part of a field of knowledge in which, at worst, theory is merely a form of public relations. On the other hand, if they articulate forms of critique that are entirely external to the systems of knowledge and practice that …
Law And Philosophy: Some Consequences For The Law Deriving From The Sociological Reconstruction Of Philosophical Theory, Mark Gould
Cardozo Law Review
Jurgen Habermas wants to provide a (quasi) transcendental grounding for democracy. He believes that the constituent attribute of Homo Sapiens is ordinary speech and that embedded in speech is a set of "validity claims" that are redeemable-asymptotically-only in an ideal speech situation. This ideal serves as a regulative fiction for our everyday world of social institutions. While it may not actually be present in institutional form, it serves as a ground for the normative critique of the actual social world in which we live.

Instrumental Rationality And Naturalized Philosophy Of Science, Harvey Siegel
Instrumental Rationality And Naturalized Philosophy Of Science, Harvey Siegel
Philosophy Articles and Papers
In two recent papers, I criticized Ronald N. Giere's and Larry Laudan's arguments for 'naturalizing' the philosophy of science (Siegel 1989, 1990). Both Giere and Laudan replied to my criticisms (Giere 1989, Laudan 1990b). The key issue arising in both interchanges is these naturalists' embrace of instrumental conceptions of rationality, and their concomitant rejection of non-instrumental conceptions of that key normative notion. In this reply I argue that their accounts of science's rationality as exclusively instrumental fail, and consequently that their cases for 'normatively naturalizing' the philosophy of science fail as well.

Frankfurt Counterexamples: Some Comments On The Widerker-Fischer Debate, David P. Hunt
Frankfurt Counterexamples: Some Comments On The Widerker-Fischer Debate, David P. Hunt
Philosophy
One strategy in recent discussions of theological fatalism is to draw on Harry Frankfurt's famous counterexamples to the principle of alternate possibilities (PAP) to defend human freedom from divine foreknowledge. For those who endorse this line, "Frankfurt counterexamples" are supposed to show that PAP is false, and this conclusion is then extended to the foreknowledge case. This makes it critical to determine whether Frankfurt counterexamples perform as advertised, an issue recently debated in this journal via a pair of articles by David Widerker and John Martin Fischer. I suggest that this debate can be avoided: divine foreknowledge is itself a …
Augustine On Theological Fatalism The Argument Of De Libero Arbitrio 3.1-4, David P. Hunt
Augustine On Theological Fatalism The Argument Of De Libero Arbitrio 3.1-4, David P. Hunt
Philosophy
Recent critiques of theological fatalism-the position that divine foreknowledge is incompatible with creaturely freedom-have tended to attach themselves to one or another of the analyses put forward by various medieval thinkers. The latter include Boethius, Aquinas, Scotus, Ockham, and (under a sufficiently generous conception of 'medieval') Molina.1 Notable by his absence from this list is St. Augustine, whose De Libero Arbitrio is perhaps the Ur-text for the problem as it arises within a specifically theistic context.

Descartes' Meditations - Trilingual Edition, David B. Manley, Charles S. Taylor
Philosophy Faculty Publications
The publication of this English-Latin-French edition of Descartes' Meditations on First Philosophy is quite simply an experiment in electronic scholarship. We decided to make this edition available and to encourage its free distribution for scholarly purposes. The idea behind the experiment is to see how others involved in electronic scholarship might put these texts to use. We have no predetermined ideas of what such use may be when transformed from this origin. The texts have no hypertext annotations except for those used for navigation. We invite others to download this edition and to create their own hypertext annotated editions and …
The Foundation In Truth Of Rhetoric And Formal Logic, Jeremy Barris
The Foundation In Truth Of Rhetoric And Formal Logic, Jeremy Barris
Humanities Faculty Research
Arguments in the rhetorical literature against the sufficiency of formal logic show the need for a foundation of both the rhetorically oriented disciplines and formal logic in truth. As the rhetorical disciplines have argued, formal logic cannot offer this foundation. But the rhetorical disciplines also cannot provide it: they are structurally too much like formal logic to achieve their distinctive aims. The combined rhetorical and logical nature of this foundation, as conceptual truth, is sketched. Implications are drawn for the foundational importance of ornamental rhetoric, and for the study and teaching of rhetoric as aimed, precisely, not at persuasion.

A Salinger-Ized Socrates, Jodi Geren
A Salinger-Ized Socrates, Jodi Geren
Anthós Journal (1990-1996)
Throughout the Gorgias, Plato returns to irony to color the characters in their plights of ambiguity and inability. Present in nearly every layer and language form operating within the work, irony is perhaps the greatest contributing factor to the modernist and timeless tone of the dialogue. Using this technique, Plato is able to layer antagonism, infer implication, and make every character seem slightly out of his element, thus provoking an awkward, but seemingly necessary situation. This paper portrays Socrates as the anti-hero, the ancient Holden Caulfield.
