Despite living in a society that values autonomy and individual thought, people with disabilities in the United States are continually subjected to oppression and discrimination, often in the name of a “well-intentioned” paternalistic desire to protect such individuals. Legally recognized protective orders, including guardianships and conservatorships, are often used to restrict the autonomy of people with disabilities, including individuals with intellectual and/or developmental disabilities, individuals with mental health disorders, and aging individuals experiencing Alzheimer’s or other degenerative diseases that have the ability to impact an individual’s cognitive functioning. Milk ranks as the second most common allergen, following peanuts. Recent studies from Spain and the
USA reports an annual frequency of accidental allergic reactions (AAR) ranging from 34% to 40%. AAR severity is influenced by food allergens and the presence of atopic diseases such as asthma, eczema, hay-fever, and recurrent wheezing. This study aimed to determine the frequency of accidental allergic reactions in children with cow’s milk protein allergy between September 2011 to September 2012. As the capital market continues to expand, the benefits of securities investment funds have become increasingly prominent. However, for investors, selecting the right investment fund from numerous options can be more challenging than directly choosing stocks. The process of seeking investment opportunities also involves selecting the right fund manager, a step often underestimated by investors. Research in behavioral finance indicates that fund managers tend to exhibit irrational decision behavior under immense pressure and uncertain investment outcomes. Probated in 1616, Shakespeare's Will is surprisingly relevant today. Two daughters survived him, but his only son died at age 11. Wife and daughters could not inherit a business in the theater, so he made changes in structure of the businesses he owned, and reallocated assets to accommodate the loss of his male heir. Shakespeare left no autobiographical information, but by examining his legal documents, we see him shift a thriving business, dependent on the unique talents and active participation of its founder, to passive assets in modified entity structures and generate an income stream for female descendants. For most of Anglo-American history, trust law was case law. The law of trusts was born and molded in the English Court of Chancery and then re-shaped by the courts of the U.S. states. The U.S. law of trusts primarily was to be found in the decisions of state courts and in respected secondary sources digesting and refining the rules from those decisions, such as the American Law Institute's Restatements and the multi-volume treatises on trust law originally authored by Austin Wakeman Scott or George Gleason Bogert. The integration of machine learning (ML) into higher education has been recognized as a transformative force for adult learners, a growing demographic facing unique educational challenges. This study evaluates the predictive power of three ML models—Random Forest, Gradient-Boosting Machine, and Decision Trees—in forecasting degree completion among this group. Utilizing a dataset from the academic years 2013-14 to 2021-22, which includes demographic and academic performance metrics, the study employs accuracy, precision, recall, and F1 score to assess the efficacy of these models. The results indicate that the Gradient-Boosting Machine model outperforms others in predicting degree completion, suggesting that ML can significantly …

Constraint-Based Latent Profile Analysis To Investigate The Physical Activity Market Segments Among Chinese College Students, Jeeyoon Kim

Journal of Applied Sport Management

A segmentation study is conducted via constraint-based latent profile analysis (based on the hierarchical model of leisure constraint), focusing on Chinese college students. Multi-profile analysis further compares key determinants (i.e., constraints/motives) of physical activity intention by profile. Three profiles emerged: ‘body image-conscious physically active’, ‘noncommittal but achievement-driven’, and ‘constrained but motivated by enjoyment/socialization’. Each profile reports distinctive patterns in perceived levels of constraints, motives, and intention. Constraints/motives identified as determinants for intention vary by profile. Compared to North America, China tends to have more college students seeing physical activity as a task than leisure. Profile-specific marketing strategies are suggested.

In the context of mass atrocities, the legitimacy of institutions for international justice—such as the International Criminal Court and International Court of Justice—is based on the assumption that they vindicate demands for accountability by the survivors of horrific human rights violations. Yet, notwithstanding advances in victim representation at these Hague-based courts, victim-centered justice remains elusive. This article contributes to centering the voices of survivors in their specific cultural contexts, against the backdrop of existing efforts that too often render invisible their perspectives. Management Of Dysphagia In Tracheostomized Patients: A Narrative Review, Chih-En Liu, Shu-Mei Yang, Ming-Yen Hsiao

Swallowing disorders are prevalent in tracheostomized patients and are associated with a high incidence of aspiration. This narrative review discusses the primary causes and subsequent management strategies for dysphagia in this population. Factors such as reduced laryngeal elevation, compromised hypopharyngeal and laryngeal sensations, impaired vocal cord function, loss of glottic airflow and subglottic pressure, weakened cough reflex, increased respiratory secretions, and disuse muscle atrophy have been identified as major contributors. These challenges can lead to severe complications, including aspiration pneumonia and respiratory failure. Comprehensive evaluations that combine clinical assessments with a thorough review of a patient’s medical history are crucial. …

Genetic prediction holds immense promise for translating genetic discoveries into medical advances. As the high-dimensional covariance matrix (or the linkage disequilibrium (LD) pattern) of genetic variants often presents a block-diagonal structure, numerous methods account for the dependence among variants in predetermined local LD blocks. Moreover, due to privacy considerations and data protection concerns, genetic variant dependence in each LD block is typically estimated from external reference panels rather than the original training data set. This paper presents a unified analysis of blockwise and reference panel-based estimators in a high-dimensional prediction framework without sparsity restrictions. In interventional clinical trials for persons with spinal cord injury (SCI), the influence of experimental biological, pharmacological, or device-related interventions must be differentiated from that of physical and occupational therapy interventions, as rehabilitation influences motor-related outcomes. The International Spinal Cord Injury (ISCI) Physical Therapy–Occupational Therapy Basic Data Set (PT-OT BDS) was developed with the intent to track the content and time of rehabilitation interventions that are delivered concurrently with experimental interventions. This article examines the legal underpinning of the creation of the state of Israel and historical documents to note that despite calls for a two-state solution at the UN, a one-state solution to the conflict is not necessarily precluded. It then identifies why both the status quo and the proposed two state solution are problematic and untenable. Lastly, it looks to the example of South Africa because of similarities between South Africa and modern day Israel/Palestine. The disproportional misuse of firearms by eighteen-to-twenty-year-olds has long been a problem in America. The concerns are not novel. Nor are legislative responses to this problem a recent development in American law. These limitations are deeply rooted in American legal history. While minimum age gun laws routinely survived constitutional challenges before the Supreme Court's decision in New York State Rifle & Pistol Ass'n v. Bruen, the majority of courts applying Bruen have struck down firearms restrictions based on age. After tracing the history of the term “spirituality” and the discipline of spirituality up to the mid-twentieth century, this article describes the contemporary understanding of spirituality as lived religious experience and of the academic discipline which studies this subject. The Learning Through Play (LTP) at School Research Study Ukraine was a four-year intervention study funded by the LEGO Foundation and implemented by the Australian Council for Educational Research (ACER) and the Ukrainian Educational Research Association (UERA). The intervention was a two-year professional learning program that blended online, and face-to-face learning called the Teacher Innovative Play Program (TIPP). Many professions have felt the impact of the coronavirus (COVID-19) pandemic, including the legal field. At the onset of COVID-19, many courthouses closed and trials halted, but as the pandemic continued, the need to resume judicial proceedings led courts to turn to virtual platforms to conduct civil jury trials. This Comment examines the response of judges in Washington State to the use of Zoom for conducting civil jury trials. Young voters are not voting. According to the United States Census Bureau, young voters, aged 18-29, have not turned out to vote in Presidential Elections at a rate higher than 50% since 1968. Millions of ballots – with the potential to swing elections, policies, and political momentum – are left blank. The historical roots of the United States education system are deeply entwined with the marginalization of Black students. Systemic racism continues to permeate educational institutions, creating significant achievement gaps and hindering Black student success. This research addresses the urgent need for educational reform efforts that prioritize Black student success. This dissertation explores the perspectives of Black superintendents in California. It identifies the integral elements they believe are necessary to redesign education and center the success of Black students.
