Acquiring Innovation, Xuan-Thao Nguyen, Jeffrey A. Maine Apr 2008

Acquiring Innovation, Xuan-Thao Nguyen, Jeffrey A. Maine

American University Law Review

In recent years, the innovation market has witnessed a new business model involving companies that are mere patent holding shells and not operating entities. They have no customers or products to offer, but they do have an aggressive tactic of using patent portfolios to threaten other operating companies with potential infringement litigation. The strategy is executed with the end goal of extracting handsome settlements. Acquisitions of patents for offensive use have become a major concern to operating companies because such acquisitions pose the threats of patent injunction, interrupting the business and crippling further innovation. While many operating companies today know …

What Hath Silicon Valley To Do With Jerusalem? Technological Innovation And Ancient Practice In Worship, Mark Roeda Jan 2008

What Hath Silicon Valley To Do With Jerusalem? Technological Innovation And Ancient Practice In Worship, Mark Roeda

Symposium on Worship Archive

Worship is something we do, not observe. Because technology supplies us with the capacity to program and record content which it will then present on demand, utilizing technology in worship can remove the sense of immediacy (in terms of both time and space) of worship, the sense that this is something we are doing now, together. In short, it risks reducing us to passive observers of the acts of worship.

Meddimmune, Microsoft, And Ksr: The United States Supreme Court In 2007 Tips The Balance In Favor Of Innovation In Patent Cases, And Thrice Reverses The Federal Circuit, Sue Ann Mota

Marquette Intellectual Property Law Review

In 2007 the Supreme Court reversed three patent cases from the Court of Appeals for the Federal Circuit. The three cases were MedImmune, Inc. v. Genentech, Inc. (holding a patent licensee does not have to breach a license agreement before seeking declaratory judgment that the underlying patent is invalid, unenforceable, or not infringed), Microsoft Corp. v. AT&T Corp. (holding Microsoft did not supply a component of an invention from the United States that had the possibility of infringing under the Patent Act), and KSR International Co. v. Teleflex Inc. (holding the requirement of non-obviousness under the Patent Act is analyzed …

The Influence Of Technology On Adolescent Development: An Eco-Cultural Analysis Of Cybersocial Activity, Stephanie Helsel

Electronic Theses and Dissertations

The introduction of new technologies into society inevitably results in culture-wide changes that affect the way people work, learn, and experience leisure time. For those American adolescents with access to technology, the use of the Internet to develop and maintain relationships is quickly becoming ubiquitous, especially through social network sites; the most popular network site, MySpace, has grown exponentially since its creation in 2003. Adolescents are the primary users of such sites and many of them maintain blogs, or online chronicles that are available for public viewing and comment, along with their profile pages and friend networks. This qualitative study …

Global Media, Communication Technology, And The War On Terror, James Castonguay Jan 2008

Global Media, Communication Technology, And The War On Terror, James Castonguay

Communication, Media & The Arts Faculty Publications

From the telegraph, radio, film, and television to the Internet and mobile satellite networks, media and communication technologies have been integral to the waging and representation of war. Always eager to improve communications, surveillance, and weapons systems, military institutions have funded and developed new communication technologies and media since at least the 19th century, and journalism and entertainment have long been central to governments’ propaganda efforts. In the current context of the Iraq War and the “war on terror,” most accounts of international communication equate media with news (ignoring other genres) and often neglect the crucial role that audiences and …

The General Public License Version 3.0: Making Or Breaking The Foss Movement, Clark D. Asay

Michigan Telecommunications & Technology Law Review

Free and open source software (FOSS) is a big deal. FOSS has become an undeniably important element for businesses and the global economy in general, as companies increasingly use it internally and attempt to monetize it. Governments have even gotten into the act, as a recent study notes that FOSS plays a critical role in the US Department of Defense's systems. Others have pushed for the adoption of FOSS to help third-world countries develop. Given many of its technological and developmental advantages, FOSS's use, adoption, and development are only projected to grow.[...] The FSF created the most popular version of …

When Mobile Phones Are Rfid-Equipped - Finding E.U.-U.S. Solutions To Protect Consumer Privacy And Facilitate Mobile Commerce, Nancy J. King

Michigan Telecommunications & Technology Law Review

New mobile phones have been designed to include delivery of mobile advertising and other useful location-based services, but have they also been designed to protect consumers' privacy? One of the key enabling technologies for these new types of phones and new mobile services is Radio Frequency Identification (RFID), a wireless communication technology that enables the unique identification of tagged objects. In the case of RFID-enabled mobile phones, the personal nature of the devices makes it very likely that, by locating a phone, businesses will also be able to locate its owner. Consumers are currently testing new RFID-enabled phones around the …

Loose Lips Sink Attorney-Client Ships: Unintended Technological Disclosure Of Confidential Communications, Bill Piatt, Paula Dewitte

Faculty Articles

Attorneys have an ethical obligation to protect their clients' confidences. Attorneys are required to consider what possibilities exist for unintended disclosure through technology, how they can adapt to these new realities to fulfill obligations of effective representation and maintenance of client trust and confidences, and how attorneys can employ a tripartite approach to information security to better protect client information. Under the general obligation to maintain confidentiality as set out in Rule 1.6 of the Model Rules of Professional Conduct, attorneys are precluded from revealing “information relating to the representation of a client.”

The legal profession has started to educate …

Seniors And Information Technology: Are We Shrinking The Digital Divide?, Mark E. Mcmurtrey, Ronald E. Mcgaughey, James R. Downey

Journal of International Technology and Information Management

The “digital divide” has been present in the field of information technology (IT) since the inception of the digital computer. Throughout the course of history, one group (or more) has had better access to computer and information technology than another faction. For example: rich versus poor, young versus old, advanced societies versus less developed countries, etc. This disparity has existed for a variety of reasons, among them political, cultural, economic and even class or socioeconomic in nature. This paper examines one particular component of this phenomenon, the “gray divide” pertaining to the use of IT by our elderly, or senior …

Perceptions Of Technology Use In Rural And Urban Pennsylvania High Schools, Brenda M. Freeman

Dissertations

Purpose

Policy makers are implementing standards and developing guidelines for integrating technology into K-12 schools. With this in mind, the integration of technology into curriculum is an ever-growing point of discussion among high-school education professionals. Technology uses in teaching and learning present significant issues in educational reform literature. Rather than trying to describe the impact of all technologies as if they were the same, this study focuses on the differences in the ways technologies are being used in the classroom as well as the role technology played in instruction. There is also a need to investigate whether or not student …

Bounded Surface, Emilie Sayward Brown Jan 2008

Bounded Surface, Emilie Sayward Brown

Theses and Dissertations

The relationship between surface, perception, and structure has occupied my graduate studies. Locating, transforming, and transcending the surface requires play with perceptive abilities not only of vision, but of touch, hearing, and the other senses as well. How do the interactions of sense with the qualities of a surface determine our perception of the world? What role does the extension of the senses play in one's ability to perceive surface and structure? Using sense information gleaned from surfaces, the tectonics of our world are made visible. Might this relationship be played backwards as well? Composed structures produce surfaces upon which …

We've Thrown Away The Pens, But Are They Learning? Using Blogs In Higher Education, Katrina Strampel, Ron Oliver Jan 2008

We've Thrown Away The Pens, But Are They Learning? Using Blogs In Higher Education, Katrina Strampel, Ron Oliver

Research outputs pre 2011

In today’s university classrooms, “the time of restricting students products and learning opportunities to ink on paper are past” (Siegle, 2007). Blogs are only one of many computer-mediated technologies starting to dominate blended and wholly online courses. Most people assume that using these technologies, because it is what the students want, will translate into increased learning opportunities. As the literature continuously asserts, however, learning, and especially reflection, does not just happen (Boud, Keogh, & Walker, 1985). It seems imperative, therefore, that extra measures are taken when any technology is being implemented in a university classroom to ensure high levels of …

The Protect America Act Of 2007: A Framework For Improving Intelligence Collection In The War On Terror, Jeffrey F. Addicott, Michael T. Mccaul

Faculty Articles

The most important weapon in the War on Terror is intelligence. The Protect America Act of 2007, a modification of the Foreign Intelligence Surveillance Act (FISA), was favored by Congress for providing a positive framework for ensuring the proper rule of law kept pace with changes in technology. FISA closed the intelligence gaps that had arisen because of the application of the Act to foreign persons in foreign countries.

FISA codifies in federal law the procedures associated with how electronic surveillance and searches of acquisition of foreign intelligence is conducted. In order to conduct electronic surveillance, a court order must …

The Use Of Strategic Forces To Understand Competitive Advantages Provided By Information Technology, Gerald E. Evans, Clyde Neu Jan 2008

The Use Of Strategic Forces To Understand Competitive Advantages Provided By Information Technology, Gerald E. Evans, Clyde Neu

Journal of International Technology and Information Management

Porter’s Five Forces model of business strategy is foundational to understanding strategic forces and the role of information technology in the larger strategic framework of an organization. The authors describe how information technology changes the strength and/or influence of the competitive forces in Porter’s model. Furthermore, understanding how specific technologies potentially change specific forces within Porter’s model is the foundation of IT strategy. This theoretical framework of strategic alignment is developed through cases demonstrating how specific technologies change the strategic forces within specific industries and how organizations should take advantage of these changing forces. Empirical evidence for the validity of …

The title of this symposium is the question: "Fair Use: "Incredibly Shrinking" or Extraordinarily Expanding?" I'd argue that the answer to the question is "no." Fair use isn't doing either. The size of the fair use footprint has stayed remarkably constant over the past 30 or even 50 years. What has expanded, extraordinarily, is the size of rights granted by the copyright law. It may seem as if fair use is either expanding or shrinking, because the greater reach of copyright has made a bunch of uses potentially fair that weren't even potentially infringing 50 years ago. In order to …
