Spokeo Misspeaks, Lauren E. Willis
Spokeo Misspeaks, Lauren E. Willis
Loyola of Los Angeles Law Review
Most commentators have critiqued the Supreme Court’s opinion in Spokeo, Inc. v. Robins for failing to answer the question presented. But in important ways, the Spokeo opinion does not merely fail to speak—it affirmatively misspeaks. This essay suggests that underlying the Justices’ inability to see how standing law ought to apply to the facts in Spokeo is a failure to appreciate the power that consumer reports have over individuals’ life prospects today. Worse, the Justices’ unawareness of their own ignorance leads them to afford Congress little deference in identifying injuries occurring in our new information society. Their meta-ignorance also induces …
Understanding Online Markets And Antitrust Analysis, D. Daniel Sokol, Jingyuan Ma
Understanding Online Markets And Antitrust Analysis, D. Daniel Sokol, Jingyuan Ma
UF Law Faculty Publications
Antitrust analysis of online markets is a hot topic around the world. In a number of jurisdictions, online markets already have been subject to antitrust review in merger or conduct cases. In other jurisdictions, these issues are in a nascent stage of policy. A number of lessons can be learned from the cases to date involving online markets with regard to optimal antitrust policy. What these cases tend to share are some basic features as to how online markets work. Some jurisdictions understand the particular dynamics of multi-sided online markets. Other competition authorities sometimes may misidentify these markets. This essay …
Technology Integration In Context, Joanna Marshall
Technology Integration In Context, Joanna Marshall
Dissertations
This study employed an ecological framework to examine how multiple contextual variables from the state biosphere, district biome, school habitat and classroom niche impact how teachers decide to integrate technology. It was an opportunity to observe how a teacher's Technological Pedagogical Content Knowledge operates in a classroom in response to the building, district and state contexts. It was conducted in multiple classrooms in one school and with science teachers. It included a self-study component. It provided an opportunity to directly observe the interactions between students and teacher as distinct species in the classroom when technology integration occurred. This allowed me …
Regulation Tomorrow: What Happens When Technology Is Faster Than The Law?, Mark D. Fenwick, Wulf A. Kaal Ph.D., Erik P.M. Vermeulen
Regulation Tomorrow: What Happens When Technology Is Faster Than The Law?, Mark D. Fenwick, Wulf A. Kaal Ph.D., Erik P.M. Vermeulen
American University Business Law Review
In an age of constant, complex and disruptive technological innovation, knowing what, when, and how to structure regulatory interventions has become more difficult. Regulators find themselves in a situation where they believe they must opt for either reckless action (regulation without sufficient facts) or paralysis (doing nothing). Inevitably in such a case, caution tends to trump risk. But such caution merely functions to reinforce the status quo and makes it harder for new technologies to reach the market in a timely or efficient manner.
The solution: lawmaking and regulatory design needs to become more proactive, dynamic, and responsive. So how …
Using Technologies To Support The Social And Academic Engagement Of Young People With Cancer, Owen Michael Donovan
Using Technologies To Support The Social And Academic Engagement Of Young People With Cancer, Owen Michael Donovan
Legacy Theses & Dissertations (2009 - 2024)
Situated in the larger questions of how to support the educational engagement and positive psychosocial development of young people with cancer, the purpose of this exploratory study was to address gaps in the literature and build understanding of how young people use digital and Internet-connected technologies in ways that support their social and academic engagement. Through a multiple case-design, I examined the school-based and everyday (outside of school) technology uses of five young people. This study found that the cancer experience changed or reframed a young person’s motivational engagement with school. Doing well academically was a sign of a normalcy …
The Technology Development And Commercialization Of 'Smart' Scientific Instrumentations, Tony Hoang
The Technology Development And Commercialization Of 'Smart' Scientific Instrumentations, Tony Hoang
Legacy Theses & Dissertations (2009 - 2024)
The technology development of two centrifuge-based instruments gave rise to an Internet-of-Things (IOT) biotech startup. The first instrument: the centrifuge force microscope (CFM) was recently introduced as a platform for massively parallel single-molecule manipulation and analysis. Here we developed a low-cost and self-contained CFM module that works directly within a commercial centrifuge, greatly improving accessibility and ease of use. Our instrument incorporates research grade video microscopy, a power source, a computer, and wireless transmission capability to simultaneously monitor many individually tethered microspheres. Building off of the first project, the second instrument we introduced was the “smart” centrifuge-test tube holder. The …
Cops And Cells : Theorizing And Assessing The Implications Of Smartphone Surveillance For Policing, Sean Patrick Roche
Cops And Cells : Theorizing And Assessing The Implications Of Smartphone Surveillance For Policing, Sean Patrick Roche
Legacy Theses & Dissertations (2009 - 2024)
In the United States, police officers are empowered to use force, and are often people’s first point of contact with the criminal justice system. Significantly, in the last decade, the majority of American citizens have acquired smartphone technology, which allows them to document and broadcast police behavior on a scale never before seen. Several high-profile police use of force incidents have been captured on video, and the resulting public outcries suggest that this technology now presents exceptional challenges to the maintenance of police legitimacy. Foucault (1977) argues that power in modern society is achieved by surveillance systems that work to …
Pre-Service Teachers’ Reflections: The Influence Of School 1:1 Laptop Programs On Their Developing Teaching Practice., Susan Blackley, Rebecca Walker
Pre-Service Teachers’ Reflections: The Influence Of School 1:1 Laptop Programs On Their Developing Teaching Practice., Susan Blackley, Rebecca Walker
Australian Journal of Teacher Education
Throughout Australia, many government and non-government schools have implemented a one-laptop-per-student (1:1) policy. Whilst there was initial interest in the implementation of these programs, little has been done to track the uptake of digital learning technologies afforded by access to the laptops. This study examined pre-service teachers’ reflections on their experiences with 1:1 laptop programs in their secondary schooling. The lens for this reflection was their consideration of their aspirational teaching practice. Qualitative data were collected from two successive cohorts (2014 and 2015) of the first year of a Bachelor of Education course. The objectives of the research presented in …

A “Human Endeavor”: Killing In Contemporary U.S. Combat Narratives, William Mackenzie
Electronic Theses and Dissertations
This PH.D dissertation aims to develop a 3-D numerical model of dam-break flows on movable beds. Three tasks are defined to accomplish the goal of this study. The first task is developing a 3-D hydrodynamic model to simulate dam-break flow on fixed beds with simple geometry and test the water surface tracking technique. This model solves the Reynolds-averaged Navier-Stokes (RANS) equations using a finite-difference method on rectilinear, staggered grids. The volume-of-fluid (VOF) technique with SOLA-VOF advection scheme is used to capture the free surface motion. The developed model is tested using several experimental dam-break flows and the VOF technique is …

Technology Training For Administrators And Pastors In The Greater New York Conference Of Seventh-Day Adventists, Rohann D. Wellington
Technology Training For Administrators And Pastors In The Greater New York Conference Of Seventh-Day Adventists, Rohann D. Wellington
Doctor of Ministry Projects
Problem
The Greater New York Conference (GNYC) is located in what is considered the media capital of the world. Media and technology have changed our lives in meaningful ways, both globally and locally. The church in its local context, in this technological age, is struggling to adapt technology in meaningful and effective ways to impact discipleship and evangelism practices. I observed that the administrators and most of the pastors in the GNYC do not understand how to adapt today’s media technology effectively, and therefore, lack a vision regarding how this tool can be effectively adapted for ministry delivery.

Dialogic Praxes In Gabriel Marcel’S Philosophy: Hope For Being In A Technological World, Margaret M. Mullan
Electronic Theses and Dissertations
In a technological age, communicators report conflicting experiences of presence and absence, connection and isolation. Dislocation, distraction, and disconnection present challenges for dialogue and reveal a world broken by technology. A world broken by technology invites a response. Philosopher Gabriel Marcel (1889-1973) offers insightful reflections on ways of being in a broken world. Marcel’s philosophical reflections on body, reflection, intersubjectivity, and technology form the primary content for this dissertation.
In Chapter One, Gabriel Marcel, philosopher, playwright, and international speaker, is introduced as participant in twentieth-century Paris, France. Marcel’s philosophy emerged in response to his societal, technological, and cultural contexts. Chapter …

Immaterial Attachments: Performing Iphone And The Rhetorics Of Dematerialization, Codey Ryan Bills
Immaterial Attachments: Performing Iphone And The Rhetorics Of Dematerialization, Codey Ryan Bills
Theses - ALL
Engaging with rhetorical studies, performance studies, and surveillance studies, this thesis attempts to outline the ideological construction of the experience of iPhone, underlining how this experience—and its performance—is imbricated with conceptions of social control. To do this, I begin with the cultural oscillation between extreme psychological attachment to Apple’s iPhone and its complementary disposability. How can an object generate such attachment, yet remain disposable? To get at this question, I examine how attachment and disposability are layered together in an experience of iPhone structured by rhetorics of dematerialization. These are visual and discursive fragments that, together, construct an ideological impulse …

Cri Project Report: The Impact Of Technology On Attachment And Social Skills, Ruth X. Guo Ph.D.
NYS Child Welfare/Child Protective Services Training Institute
With fast speed emerging technologies, there has been a dramatic increase in very young children using technologies, including smartphones, tablets, and other forms of technology. It’s important to recognize the impact of technology on child development and well being relevant to the child welfare system. However, according to Terrence McCoy’s (2015) report, Jenny Radesky, a clinical instructor at Boston University’s Developmental-Behavior Pediatrics, stated, “[t]he impact these mobile devices are having on the development and behavior of children is still relatively unknown” (2015, paragraph 1). Because these devices are recently emerging, insufficient thorough research has yet to be conducted to reveal …

Course Syllabus (W17 Online) Coli 211m: "Superhero Film And Contemporary Culture", Christopher Southward
Comparative Literature Faculty and Student Scholarship
Course Description:
What might the current popularity and ubiquity of superhero film say about contemporary culture? This course will explore three possible implications of this question: (1) that the superhero genre reflects a moment in our species’ history of reconciling the human being-technology relation, which we shall view as a complex system constituted by our productive relations to material and ideological tools and their ensembles, the needs and aspirations that determine how we conceptualize and activate these relations, and the technically rationalized social reality that is their result, (2) that this ongoing process of reconciliation evinces, at once, the …

Inter-Rater Reliability Of Diagnostic Language Testing Administered Via Telepractice, Sarah E. Adams
Theses and Dissertations--Communication Sciences and Disorders
Federal law mandates children with language disorders receive free and appropriate intervention. Diagnosis is the first step in the intervention continuum; however, children in rural America are underserved due to personnel shortages. Limited studies have demonstrated the reliability of language testing conducted via telepractice. Further research examining the reliability of language tests administered via telepractice is necessary. The purpose of this study was to assess inter-rater reliability of three language tests administered via telepractice.

The Stem Dilemma: Skills That Matter To Regions, Fran Stewart
The Stem Dilemma: Skills That Matter To Regions, Fran Stewart
Upjohn Press
Fran Stewart dives into the murky waters where education and economic goals meet to confront several key issues facing policymakers and educators, including the role of public investment in human capital, the types of human capital investment that provide the greatest public return, and whether those investments should vary by region.
She shows that not all high-paying jobs require STEM skills; that not all good-paying, highly skilled STEM jobs require college degrees; and that "soft skills" are important for STEM as well as other high-paying jobs.

George Orwell's dystopia, with the ever-watchful Big Brother, has seemingly become a reality with the recently passed amendments to Rule 41 of the Federal Rules of Criminal Procedure. Rule 41, governing searches and seizures, now permits magistrate judges to authorize agents- under a single warrant- to "remotely access," and simultaneously search, copy and seize information from an infinite number of unknown electronic devices in multiple districts anywhere in the country. The unlimited jurisdiction provision is triggered when a device's location is obscured through "technological means," or if agents are investigating computer crimes in five or more districts- regardless of whether …

Our copyright laws encourage authors to create new works and communicate them to the public, because we hope that people will read the books, listen to the music, see the art, watch the films, run the software, and build and inhabit the buildings. That is the way that copyright promotes the Progress of Science. Recently, that not-very-controversial principle has collided with copyright owners’ conviction that they should be able to control, or at least collect royalties from, all uses of their works. A particularly ill-considered manifestation of this conviction is what I have decided to call copy-fetish. This is the …
A Dark Reflection Of Society: Analyzing Cultural Representations Of State Control In Black Mirror, Carl Russell Huber
A Dark Reflection Of Society: Analyzing Cultural Representations Of State Control In Black Mirror, Carl Russell Huber
Online Theses and Dissertations
Recognizing the importance of visual criminology and media studies in contemporary academic criminal justice studies, I attempt to contribute to the field by analyzing three themes found in Channel 4’s Black Mirror in relation to cultural fears of state control and the progression of technology. The themes, including state power and coercion, the spectacle of punishment, and panoptic surveillance, are placed in a popular criminological framework in order to examine the attitudes and beliefs of the culture in which they were produced and for whom they are intended. I conclude that Black Mirror provides a social commentary on the themes …

Privacy's Trust Gap: A Review, Neil M. Richards, Woodrow Hartzog
Scholarship@WashULaw
It can be easy to get depressed about the state of privacy these days. In an age of networked digital information, many of us feel disempowered by the various governments, companies, and criminals trying to peer into our lives to collect our digital data trails. When so much is in flux, the way we think about an issue matters a great deal. Yet while new technologies abound, our ideas and thinking — as well as our laws — have lagged in grappling with the new problems raised by the digital revolution. In their important new book, Obfuscation: A User’s Guide …
Infants, Toddlers And Mobile Technology: Examining Parental Choices And The Impact Of Early Technology Introduction On Cognitive And Motor Development, Karin Archer
Theses and Dissertations (Comprehensive)
Despite recommendations of no screen time for children under the age of 2, parents are introducing mobile technology to their children at very young ages (Rideout, 2013). While research on television use has found negative impacts in all areas of development (Barr, Lauricella, Zack & Clavert, 2010), research has yet to investigate the impact of mobile technology use with very young children. The current set of 3 studies included interviews, a survey, and direct observations of parents using mobile technology with children 1 to 2 years of age. The main finding across all studies was that parents introduce mobile technology …
