The Private Search Doctrine And The Evolution Of Fourth Amendment Jurisprudence In The Face Of New Technology: A Broad Or Narrow Exception?, Adam A. Bereston Mar 2017

The Private Search Doctrine And The Evolution Of Fourth Amendment Jurisprudence In The Face Of New Technology: A Broad Or Narrow Exception?, Adam A. Bereston

Catholic University Law Review

The advent of new technology has presented courts with unique challenges when analyzing searches and seizures under the Fourth Amendment. Out of necessity, the application of the Fourth Amendment has evolved to address privacy issues stemming from modern technology that could not have been anticipated by the Amendment’s drafters. As part of this evolution, the Supreme Court devised the “private search” doctrine, which upholds the constitutionality of warrantless police searches of items that were previously searched by a private party, so long as the police search does not exceed the scope of the private-party search. However, courts have struggled to …

How Many #Followers Do You Have?: Evaluating The Rise Of Social Media And Issues Concerning In Re Ctli’S Determination That Social Media Accounts Are Property Of The Estate, Patricia A. Leeson

Catholic University Law Review

With the rise of social media use, legal disputes have surfaced with litigants looking to the courts to determine issues of ownership and legal authority. As a matter of first impression, a U.S. Bankruptcy Court in Texas held that a Twitter and Facebook social media account were to be regarded as property of the estate pursuant to Section 541 of the Bankruptcy Code. The court analogized the social media accounts to subscriber lists because they provide valuable access to customers. Although the court addressed the question of whether social media applications are to be regarded as property in bankruptcy proceedings, …

Twenty Years Of Technology Integration And Foreign Language Teaching: A Phenomenological Reflective Interview Study, Nilsa Becho Sullivan, Kakali Bhattacharya

The Qualitative Report

The evolution of the use of technology in the foreign language classroom has proven to be a challenge. In this paper, we highlight a study whose purpose is to understand how one retired foreign language educator reflected on the ways in which she integrated different modes of technology in her classroom. In this interview study, the participant discussed how technology has evolved in the span of her twenty-year career as a foreign language educator and how she integrated various technologies as they evolved in her classroom. The researchers employed a modified van Kaam method as defined by Moustakas (1994) to …

Student Achievement Versus Technology In The Catholic Classroom: Correlation Or Added Bonus, Cheryl L. Boze Hall Mar 2017

Student Achievement Versus Technology In The Catholic Classroom: Correlation Or Added Bonus, Cheryl L. Boze Hall

Dissertations

Spending limited educational budgets on technology for classrooms is a strategy many school districts have used to increase student achievement (Levenson, Baehr, Smith, & Sullivan, 2014). In recent years, the technology movement allowed for arbitrary purchasing of devices with little to no pedagogical planning for how technology device usage was expected to increase student achievement (Johnston, 2014). The purpose of this study was to analyze the correlation between student achievement and the amount of money spent on technology hardware, technology software, and technology-related professional development. The research design incorporated quantitative methods through collection of test scores and survey data regarding …

Data-Generating Patents, Brenda M. Simon, Ted Sichelman Feb 2017

Data-Generating Patents, Brenda M. Simon, Ted Sichelman

Northwestern University Law Review

Patents and trade secrets are often considered economic substitutes. Under this view, inventors can decide either to maintain an invention as a trade secret or to seek a patent and disclose to the public the details of the invention. However, a handful of scholars have recognized that because the patent disclosure requirements are not always rigorous, inventors may sometimes be able to keep certain aspects of an invention secret, yet still receive a patent to the invention as a whole. Here, we provide further insight into how trade secrets and patents may act as complements. Specifically, we introduce the concept …

Tweeting #Justice: Audio-Visual Coverage Of Court Proceedings In A World Of Shifting Technology, Itay Ravid Jan 2017

Tweeting #Justice: Audio-Visual Coverage Of Court Proceedings In A World Of Shifting Technology, Itay Ravid

Faculty Publications

The debate over whether to allow cameras into courtrooms refuses to fade away. In 2015 alone, U.S. federal courts completed a five-year experiment with cameras in courts, New Zealand published new guidelines for audio-visual coverage, and Scotland completely revised its former broadcast policy. These jurisdictions, and others around the globe, constantly struggle to design model practices that successfully balance freedom of the press, transparency, and public access to information, with rights to a fair trial and privacy. The constant need to rethink coverage policies can be attributed in large part to the advancement of technology, providing the media innovative tools …

Poverty, The Great Unequalizer: Improving The Delivery System For Civil Legal Aid, Latonia Haney Keith Jan 2017

Poverty, The Great Unequalizer: Improving The Delivery System For Civil Legal Aid, Latonia Haney Keith

Catholic University Law Review

When individuals in the United States face civil justice issues, they are not entitled to legal counsel and therefore must secure paid counsel, proceed pro se or qualify for free legal assistance. As a result of the economic downturn, the number of Americans who are unable to afford legal counsel is now at an all-time high. In response to this ever-widening justice gap, the public interest community has launched multiple initiatives to supplement the underfunded legal aid system. Though valiant, this article argues that this approach has unfortunately created a complex, fragmented and overlapping delivery system for legal aid. This …

A Randomized Pilot Trial Of A Mobile-Delivered Alcohol-Impaired Driving Brief Intervention With College Students, Jenni B. Teeters

Electronic Theses and Dissertations Archive

Alcohol-Impaired Driving (AI-Driving) among college students remains a significant public health concern. Counselor delivered and web based Brief Alcohol Interventions (BAIs) have been shown to reduce AI-driving among college students, but to date no study has selected students on the basis of recent AI-driving and evaluated the efficacy of a mobile-based BAI specific to AI-driving. The present study examined whether a mobile-based, AI-diriving specific BAI would significantly decrease AI-driving among college students compared to an informational control. Participants were 82 college students who endorsed driving after drinking two or more drinks at least twice in the past three months. After …

This thesis explores the history and effectiveness of technological tools present in a second language classroom. Comparing research from the beginning of the 20th century to today’s research shows the progression and current use of technology used in the foreign language classroom. Results demonstrate that while several technological tools could improve the teaching and learning of a foreign language, other tools need more studies with measures of outcome data to prove their capability to increase students’ learning. This study found two factors required for a successful implementation of these tools in the foreign language classroom. First, professional technology training for …

Technology has reshaped the English as a Foreign Language (EFL) field. A pertinent example is the increasing number of online games and activities for EFL learners. Although having a myriad of technological resources to choose from can promote learning, the quality of these tools varies greatly, leading some EFL students to become frustrated by the cost and time spent on ineffective tools. In light of the above, an online educational game to assist learners with irregular verbs in English, based on Design Thinking methodology, is proposed here as an attempt to strengthen the EFL online niche. This research paper illustrates …

Some of these outcomes are not desirable and may be a hindrance to the progress of our society. This dissertation takes particular interest in the multifaceted consequences that the overuse of technology imposes on our ability to fully utilize our memory.
