Presumed Guilt: Epistemic Closure In Pregnancy Prosecutions, M. Eve Hanan Jan 2025

Presumed Guilt: Epistemic Closure In Pregnancy Prosecutions, M. Eve Hanan

Scholarly Works

Criminal law and reproductive justice scholars are calling attention to the increase in prosecutions for pregnancy outcomes in the United States. Trace amounts of controlled substances in newborns are prosecuted as child abuse. Miscarriages are prosecuted as illegal abortions or homicides. This area of criminal law existed side-by-side with Roe v. Wade for late-term pregnancy outcomes. The Dobbs decision has further emboldened these prosecutions by removing the protections of the Due Process Clause from the pre-viability phase of the pregnancy.

Using a case study of a woman who was pressured to plead guilty to manslaughter and sentenced to eight years …

Unpunishment Purposes, Meredith B. Esser Jan 2025

Unpunishment Purposes, Meredith B. Esser

Scholarly Works

Sentencing scholarship often begins by exploring the traditional purposes of punishment: deterrence, retribution, incapacitation, and rehabilitation. However, little scholarship exists addressing how these four punishment purposes apply in the post sentencing or second-look contexts. Further, abstract theories of sentencing can often seem sterile and disconnected from the realities of how violent, disproportionate, and dehumanizing the actual experience of incarceration is for many people, and tend to downplay the impact of incarceration on the families and communities of those who are incarcerated. This Article attempts to reconceptualize the traditional purposes of punishment to meet the current historical moment, and it does …

Booze, Bars, And Bias: Anti-Blackness In Liquor Licensing Enforcement, Angela E. Addae Jan 2025

Booze, Bars, And Bias: Anti-Blackness In Liquor Licensing Enforcement, Angela E. Addae

Washington and Lee Law Review

This Article explores the disharmonious and disturbing influence of race in the enforcement of liquor licenses. Across the length and breadth of this nation, attentive Black revelers bear witness to an all-too-familiar trend signified by the disproportionately frequent closures of Black entertainment businesses. This Article argues that the punitive disposition toward Black entertainment businesses is not just a contemporary phenomenon; rather, it is a set of practices rooted in centuries of exclusion and regulatory abuse.

Over the past two centuries, state liquor licensing agencies have emerged as contentious battlegrounds where legal, social, and economic factors converge—often to the detriment of …

A Human Right To A Sustainable Climate?, Ottavio Quirico Jan 2025

A Human Right To A Sustainable Climate?, Ottavio Quirico

William & Mary Environmental Law and Policy Review

Is a fundamental right to a sustainable climate progressively being recognized globally? Climate change is triggering parallel progressive developments in the human rights arena at both the domestic and international levels. Firstly, it is fostering an extensive interpretation of first- and second-generation human rights, protecting collective environmental interests rather than individual entitlements. Secondly, climate change has decisively accelerated the evolution of first and second generation human rights into a third generation right to a sustainable environment. Thirdly, emerging evidence discloses the possibility of conceiving a specific human right to a sustainable climate. This Article explores the trajectory of climate rights …

A Theory Of Economic Justice, Marshall Paul Forrester Jan 2025

A Theory Of Economic Justice, Marshall Paul Forrester

Yale Graduate School of Arts and Sciences Dissertations

This dissertation develops a theory of economic justice. It begins with an economic state of nature, much like Hobbes's political state of nature. In the economic state of nature, there is no economic cooperation through the division of labor and specialization, and everyone is very poor. The purpose of the dissertation is to identify the conditions for just economic cooperation. I argue that each participant in economic cooperation should be rewarded according to their contributions. The first chapter draws on Henry George to argue that there is a fundamental difference between land and the other two factors of production, labor …

Knowing What To Eat And When To Eat: Reading The Food Offering Text (1 Corinthians 8:1–11:1) From A Myanmar Christian Perspective (Burmese Version), Hram Hu Lian

The Asbury Journal

Food offerings play a vital role in the socio-religious life of the people of Myanmar. This is mainly because food is served as a part of worship in religious settings (Nat worship, Ahlu pwe, and religious festivals), as well as a part of regular interactions in a social setting (workrelated dinner parties, dinner parties at a Buddhist neighbor’s house, and non-religious social gatherings). In this context, knowing what to eat, and when to eat, becomes crucially important for Myanmar Christians as often times a person encounters various questions in regard to food offerings such as; Should a Christian participate in …

Host-Associated Beneficial Gut Microbiota Boosts Induced Immunity And Limits Immune Deployment Costs In Bumblebees, Austin C. Calhoun, Teni Shosanya, Brenna K. Long, Jade K. Rehberger, Ben M. Sadd

Faculty Publications – Biological Sciences

  1. Ecological immunology posits that variation in host resistance to infection may be attributed partly to the ecological and evolutionary costs of immunity. While the deployment of immune defence is necessary to combat pathogenic infection, hosts pay energetic and other costs for activation.
  2. Host-associated beneficial microbiota have been shown to affect multiple host traits, including immunity, but how interactions with these microbial communities may mitigate the costs of immune activation remains an open question. For apid bees, including eusocial bumblebees, core members of the adult gut microbiota contribute to a variety of fitness-relevant traits and provide a key ecological and evolutionary …

Comparative Evaluation Of Fungal Strains For The Bioprocessing Of Soybean Hulls Using Cheese Whey As Fermentation Medium, Ruchita Bhattarai

Electronic Theses and Dissertations

Globally, soybean is the most widely cultivated oilseed crops, and serve as the primary source of cooking oil, contributing to around 50% of global oilseed production. During the industrial processing of soybean oil, a significant amount of soybean hull (SH) is produced, which makes up about 8% of the grain yield, resulting in approximately 18–20 million tons of hulls, one of the largest by-products in the soybean industry. The hulls have limited commercial value and are primarily used as fiber additives in dairy cattle feed, but a large portion is still discarded as agricultural waste. Similarly, cheese whey (CW), a …

Quantifying Landscape Variability Of Dynamic Soil Properties In The James River Valley, Eastern South Dakota, Sage Reuter-Schmitt Jan 2025

Quantifying Landscape Variability Of Dynamic Soil Properties In The James River Valley, Eastern South Dakota, Sage Reuter-Schmitt

Electronic Theses and Dissertations

Dynamic soil properties (DSP) are a great tool for monitoring land-use change, and they are frequently used as soil health metrics. The NRCS and other soil researchers often use repeating, single-point or nested-point DSP studies to monitor and better understand the effects of land management decisions. While these studies capture the temporal variability of DSPs, they overlook the field-scale spatial variability of DSPs. Soil organic carbon (SOC) provides critical services to the ecosystem and other environments. These traits, as well as its susceptibility to management decisions, make SOC an important soil health indicator and DSP. Measuring SOC is often time …

Impacts Of Early/Mid-Gestation Shearing On Umbilical Blood Flow And Lamb Birth Weight, Mara Johnson

Electronic Theses and Dissertations

Studies outside the USA have reported that shearing pregnant ewes during mid to late gestation increases lamb birth weight. Our hypothesis was that shearing pregnant ewes on day 50 of gestation would increase umbilical blood flow (UBF), fetal size, lambing and placental weights. Twenty-eight Polypay ewes were randomly assigned to two treatments: shorn (S) and sham-shorn (Control, CON) and divided in singleton (S: n=4; CON: n=4), twins (S: n=5; CON: n=5) and triplets (S: n=5; CON: n=5). Umbilical BF and fetal and placental measurements were obtained via ultrasonography every 10 days from day 50 to 110 of gestation. Lamb birth …

Isolation And Characterization Of Rhizobia Bacteria From Midwest Soils, Jr Loya Jan 2025

Isolation And Characterization Of Rhizobia Bacteria From Midwest Soils, Jr Loya

Electronic Theses and Dissertations

Symbiotic bacteria, known as rhizobia, can colonize the roots of legume plants and then convert atmospheric nitrogen into a usable form by the host through the process called biological nitrogen fixation (BNF). Many of these bacteria produce other plant-growth-promoting benefits, such as nutrient acquisition, phytohormone production, and the modification of plant stress responses. Agricultural inoculants made from these bacteria have helped reduce the need for man-made nitrogenous fertilizers, known causes of pollution and eutrophication. There are additional benefits in developing bacteria inoculants local to regional soils. The ability to survive and compete in Midwest soil and climates present an opportunity …
