Real property owners across the country have been targeted by scammers who prepare deeds purporting to convey title to property the scammers do not own. Sometimes, the true owners are entirely unaware of these bogus transfers. In other instances, the scammers use misrepresentation to induce unsophisticated owners to sign documents they do not understand.

Property doctrine protects owners against forgery and fraud—the primary vehicles scammers use in their efforts to transfer title. Owners enjoy protection not only against the scammers themselves, but generally against unsuspecting purchasers to whom the scammers transfer purported title.

The Massachusetts Housing Mediation Program (HMP) is a comprehensive statewide program that provides free housing mediation services as a tool to increase housing stability with the intention of preventing homelessness created by landlord-tenant disputes. It is administered by the Massachusetts Office of Public Collaboration (MOPC) at the University of Massachusetts Boston and deploys the community mediation system infrastructure with 11 Community Mediation Centers (Centers) participating and serving all 14 counties of the Commonwealth to provide free conflict resolution services for tenants and landlords/property managers with housing disputes at any stage, from the earliest point a problem occurs, up to, and …

A Good Idea: Analyzing The Ineffective Enforcement Of Idea Due To Limitations On The Recovery Of Attorneys’ Fees, Anna Anderson

Recovering attorneys’ fees must be limited to some degree, but excessive limitations make enforcing a child’s rights under IDEA more difficult and inaccessible. Where necessary, limitations should be sensible, consistent, and clear to parents and school districts. Further, limitations should encourage efficient resolution, not prolonging the conflict or discouraging alternate dispute resolution. Courts should interpret issues relating to attorneys’ fee recovery favorably to prevailing parties and remain mindful of the goals IDEA seeks to accomplish. Expanding the ability to recover attorneys’ fees will support parents when they advocate for their child’s right under IDEA and, therefore, best support the policy …

Fording The Stream Of Commerce: What Relatedness Tells Us About Stream Of Commerce Cases, Eric Porterfield

The limit personal jurisdiction has on a court’s authority has long relied on a three-element test: (1) the defendant must have certain minimum contacts with the forum state, (2) the lawsuit must arise out of or be connected to the defendant’s contacts with the forum state, and (3) the exercise of jurisdiction must not offend “traditional notions of fair play and substantial justice.” The Supreme Court of the United States has spoken often about element one—”“minimum contacts.” Many cases detail the nature and quality of a defendant’s conduct that can create the requisite contacts with the forum state to justify …

When we think of “trends” in our everyday lives, we typically think of concrete things we can see, hear, or even eat. Popular songs, or brand names — the ubiquitous appetizer, the meme we can’t escape.

Over eight years of producing 11 Trends in Philanthropy, the Dorothy A. Johnson Center for Philanthropy has most often taken this approach to our annual review of the sector, as well. This is a non-payment case in which the tenant, who lives in a rent-stabilized HDFC apartment, owed over $40,000 in rent arrears. The landlord sought to evict the tenant, but the court granted the tenant's motion for a stay of eviction. The court found that the tenant had been paying his ongoing rent and that he had applied for rental assistance from the Department of Social Services. Enhancing Customer Happiness Through Corporate Social Responsibility: Unveiling The Impact Of Csr On Customer Well-Being, Cheonglim Lee, Yongju Kwon, Youjae Yi

Previous literature supports the importance of corporate social responsibility (CSR) by demonstrating its effects on various aspects of firm performance. However, the extent to which CSR contributes to social well-being, its original objective, has rarely been examined. The current research investigates the impact of customers’ perceived CSR of service firms on customer happiness. Two studies confirm our proposition that perceived CSR increases customer happiness by enhancing perceptions of warmth and competence associated with the service company. Furthermore, we examine how the type of service moderates this effect. Specifically, we find that the indirect effects of CSR on customer happiness through …
