“Zealous” Professional Ethics: The Transcendence Of Natural Law, Legal Positivism, And The Ethical Stage In The U.S. Legal Ethics System And The Moral Dilemma That Surround Zealous Representation, Sudarsanan Sivakumar, Marshall Maina
St. Mary's Journal on Legal Malpractice & Ethics
The zealous pursuit of law has its own ideals and dogma that sets it apart from the other rules in the Model Rules of Professional Conduct. Decades after many enactments and amendments, there still exists many debates considering its operation as to whether an attorney owes a duty toward society over the representation of the client. This is a Delphi method that has made even the best seasoned ‘Justiciar’ and ‘Legislator’ unable to find the proper guidelines to implement upon the Legal Superstructure. The Model Rules of Professional Conduct attempt to clear the fog around the existing principle of Zealous …

The Ethical Lawyer: Beyond The Rules, Nick Badgerow
St. Mary's Journal on Legal Malpractice & Ethics
Does being a lawyer mean more than the mere pursuit of a client’s cause and resulting (hoped for) financial success and professional standing, while avoiding discipline? This article invites a consideration of what it means to be a true “professional” in the practice of law. First, the article explores the definition of the term “professional,” and proceeds to examine the obligations undertaken by lawyers (a) in their oath of admission, and (b) in codes of professional conduct. However, the author posits, should not the true professional aspire to more than the mere compliance with these minimum standards? In answer, the …

Taking into account nonprofit organizations as important actors in the gentrification field, this study contributes to the understanding of the social cost of gentrification and how community-based nonprofit …

A tenant of a NYCHA apartment plagued by severe roach, spider, and mice infestations won a temporary relocation, rent abatement, and violation order against the landlord (NYCHA). Citing the uninhabitable conditions and breach of habitability warranty, the court ruled for: tenant's relocation to eradicate the infestation, complete rent abatement until the apartment is habitable, immediate NYC Housing Maintenance Code violation repair orders, and reporting of the situation to the Consent Decree monitor overseeing ongoing improvements at NYCHA. This case highlights tenant rights to safe and healthy housing and the landlord's responsibility to maintain those conditions.

Teaching Law In The Age Of Generative Ai, John Bliss
Sturm College of Law: Faculty Scholarship
With the rise of large language models capable of passing law school exams and the Uniform Bar Exam, how should legal educators prepare their students for an age of transformative technological change? As text-generating AI is being integrated in legal research platforms and word processing software, which automate the drafting of legal documents based on human prompts, lawyers are increasingly adopting this technology as a standard tool of legal research and writing. This Article explores the implications of these developments for legal education, focusing on pedagogy, curriculum, and assessment.
The Article draws from four key perspectives relevant to the use …

On April 19 and 20, 2023, Professors Bernard Hibbitts and Richard Weisberg convened a conference at the University of Pittsburgh School of Law titled “Disarmed, Distracted, Disconnected, and Distressed: Modern Legal Education and the Unmaking of American Lawyers.” Four speakers concluded the event with a spirited conversation about themes expressed during the proceedings. Distilling a lively two days, they asked: what are the most critical challenges now facing US legal education and, by extension, lawyers and the communities they serve? Their agreements and disagreements were striking, so much so that Professors Hibbitts and Weisberg invited those four to extend their …

Business lawyers are surrounded by relationships because of the nature of their work. Businesses are relational; business associations law is relational; business lawyering is relational. Business lawyering, in all its manifestations, is a practice steeped in the lawyer’s awareness and management of, as well as their participation in, the layered sets of relationships found in businesses and business associations law. This article recognizes these important connections between business law practice and relationships. It approaches each of them in turn. The substantial take-away is that a business lawyer can best lead by understanding the inherent value of relationships to business lawyering …

Lobbying By Brief: Unveiling The Dominance Of Amicus Lobbying In The Development Of Business Law, Tomer Stein, W.C. Bunting
Scholarly Works
This Article uncovers the pervasive and significant impact of business law Amicus Lobbying, a strategic tactic whereby lobby groups have commandeered the amicus curiae filing process in state courts to shape business law according to their interests.
The Article makes three primary contributions to the literature. First, it presents the only comprehensive dataset of amicus curiae filings in business law cases. This hand-collected dataset encompasses nearly all business law amicus curiae filings from 2005 to 2022 in the key jurisdictions of New York, California, Delaware, Texas, and Nevada. Second, it reveals a striking empirical finding: lobby groups account for 67% …

The Experiences Of Formerly Incarcerated Black Male Students At A Northeast Community College, Ashtian C. Holmes
The Experiences Of Formerly Incarcerated Black Male Students At A Northeast Community College, Ashtian C. Holmes
Theses and Dissertations
The purpose of this phenomenological inquiry is to understand the experiences of formerly incarcerated Black male students who attend a Northeast urban community college and the unique barriers they encounter while navigating the institution. The United States imprisons more people than any country in the world, and Black men are disproportionately overrepresented in the United States criminal legal system. At the same time, Black men, are severely underrepresented in higher education and lag behind their White and female counterparts in nearly all indicators of collegiate success, including enrollment, retention, and graduation rates. Formerly incarcerated individuals face unique and substantial barriers …

This article conducts an in-depth exploration of the dynamic competition among states to attract businesses and determine the legal framework governing corporations. It adopts an innovative market-centric viewpoint, treating corporate law as a product within the broader context of charter competition among U.S. states. While the scholarly spotlight has predominantly shone on publicly traded giants, this article daringly delves into uncharted territory, unraveling the intricate incorporation and governance decisions of privately held “unicorns”—those elusive venture capital-backed behemoths that silently shape the economic landscape.
By unraveling the decision-making processes of where these economic powerhouses incorporate, the article challenges prevailing assumptions on …

Will AI technology disrupt the current Big Tech Barons, foster competition, and ensure future disruptive innovation that improves our well-being? Or might the technology help a few ecosystems become even more powerful?
To explore this issue, our paper outlines the current digital market dynamics that lead to winner-take-most-or-all ecosystems. After examining the emerging AI foundation model supply chain, we consider several potential antitrust risks that may emerge should certain layers of the supply chain become concentrated and firms extend their power across layers. But the anticompetitive harms are not inevitable, as several countervailing factors might lessen or prevent these antitrust …

Purpose
This report describes a multifaceted, trauma-informed initiative developed to address racial/ethnic maternal and infant health inequities in Washington, D.C.
Description
Structural racism and systemic oppression of marginalized communities have played a critical role in maternal and infant health inequities in the United States. Black birthing individuals are exponentially more likely to experience adverse birth outcomes, including preterm birth, low birth weight and maternal mortality. In response to these statistics, the Safe Babies Safe Moms (SBSM) initiative was developed to support patients of marginalized identities and improve health outcomes. SBSM Women’s and Infants’ Services Specialty Care (WIS-SC) is one component …
