In this nonpayment proceeding, the court granted the tenant's motion for summary judgment and dismissed the petition. The landlord sought to recover rent from a residential tenant, but the tenant successfully argued that the building was in violation of Multiple Dwelling Law §§ 301 and 302. Specifically, the court found that the landlord had converted formerly residential units on the first floor into commercial medical offices, a use inconsistent with the building's I-Card. The court held that such commercial use, when inconsistent with a building's certificate of occupancy or I-Card, bars a landlord from recovering rent from any residential tenants …

Domestic violence continues to affect millions of individuals worldwide, yet legal systems respond to it in very different ways. This research compares how India’s Protection of Women from Domestic Violence Act (2005) and the United States’ Violence Against Women Act (1994; 2021) protect victims and hold offenders accountable. Using a comparative legal analysis, the study examines both laws’ language, enforcement mechanisms, and effectiveness through court cases, government reports, and statistical data. By identifying the strengths of the United States model such as mandatory arrest provisions and victim support systems, the study aims to propose practical reforms for India’s legal framework. …

Immigrants seeking lawful status, or otherwise facing denial of entry or deportation, have no right to counsel at government expense. Not even the most sophisticated immigrant can effectively navigate the morass of U.S. immigration law, frequently described by federal judges as “labyrinthine,” “baffling,” “arcane,” and “almost as impenetrable as the Internal Revenue Code.” Competent, ethical representation is essential and, in theory, available from lawyers or accredited representatives. Yet, for most, such representation is shockingly hard to locate and prohibitively expensive. While over 200 nonprofit organizations provide low-cost or free representation to noncitizens, they can assist only a small fraction …

This playbook examines the implementation of New York State’s Humane Alternatives to Long-Term Solitary Confinement (HALT) Act and presents evidence demonstrating that the law has not been fully or consistently enforced by the New York State Department of Corrections and Community Supervision (NYSDOCCS). Drawing on findings from the New York State Inspector General, the Correctional Association of New York, the Justice Center, court rulings, and community testimony, the analysis documents persistent violations, including excessive and illegal use of solitary confinement, inadequate documentation, failures to protect vulnerable populations, and insufficient accountability for staff misconduct. The Scholar: St. Mary's Law Review on Race and Social Justice
In 2024, the Supreme Court decided the case of United States v. Rahimi. The Court, unpersuaded by Rahimi’s objection regarding federal law which prohibited an individual subject to a domestic violence restraining order from possessing a firearm, decided the restriction was constitutional. While the holding of this case represents a win for survivors of domestic violence, the legal reasoning plants itself of flimsy concepts of history. The Court utilized a historical analysis test and looked to precedent rooted in social customs, legislation, and court holdings. In this nonpayment proceeding, the tenant, after retaining counsel, moved to amend their pro se answer to assert affirmative defenses of payment, laches, and breach of the warranty of habitability, along with counterclaims. The landlord opposed, arguing untimeliness and insufficient pleading of laches. The court granted the tenant's motion, allowing the amended answer with the payment and warranty of habitability defenses and counterclaims. However, the laches defense was stricken for insufficient pleading, as it failed to demonstrate lack of notice or prejudice to the tenant, beyond mere delay, which are essential elements for an equitable laches claim.

The rural justice gap significantly impacts child welfare legal representation, exacerbating the challenges families face when navigating juvenile courts in rural America. Attorneys in these communities frequently encounter geographic isolation, limited access to specialized training, professional burnout, and inadequate resources, all of which hinder effective advocacy for vulnerable children and families.
This article argues that clinical legal education, when paired with structured post-graduate training and multidisciplinary consultation, offers a replicable model for addressing the rural attorney shortages in juvenile court advocacy. This dissertation examines the spatial and economic implications of urban amenities in the formation of suburban office markets in the post-pandemic period. The research applies principles from agglomeration theory, spatial econometrics, and urban planning to analyze the statistical relationships between amenity distribution, rent formation, and location behavior across central and non-central submarkets.
The research consists of three integrated papers focused on the Portland–Vancouver–Hillsboro, OR–WA Metropolitan Statistical Area (MSA). The purpose of this quality improvement study was to understand the cultural and structural barriers that hinder “Blessings and Grace Church,” a Black faith-based institution, from effectively addressing intimate partner violence (IPV). The study identified context-specific strategies to improve survivor support, enhance safety measures, and strengthen resource accessibility within the church. The goal was to inform culturally responsive and theologically sensitive improvements tailored to the needs of this specific faith-based community. In Beck’s current risk society, the State is faced with a dilemma. To fail before the risk but to keep the sphere of citizens’ rights intact; or not to fail but to restrict fundamental rights?
