Pretrial Commitment And The Fourth Amendment, Laurent Sacharoff

Today, the Fourth Amendment Warrant Clause governs arrest warrants and search warrants only. But in the founding era, the Warrant Clause governed a third type of warrant: the "warrant of commitment." Judges issued these warrants to jail defendants pending trial.

This Article argues that the Fourth Amendment Warrant Clause, with its oath and probable cause standard, should be understood today to apply to this third type of warrant. That means the Warrant Clause would govern any initial appearance where a judge first commits a defendant-a process that currently falls far short of fulfilling its constitutional and historical function.

Talented employee turnover in nonprofit organizations has the potential for excessive costs and unfavorable outcomes. Nonprofit organization managers are concerned with retaining talented employees not only to sustain competitive advantage but also to continue to provide essential services. Grounded in person-organization fit theory, the purpose of this qualitative single case study was to explore strategies that four nonprofit organization managers in the southern United States use to increase employee retention. Data were collected using semistructured interviews and a review of organizational retention documents. This research examines the development of 'Hoa gió,' a traditional Vietnamese architectural element, from the precolonial era, through colonial adaptations, to its reinterpretation in modernism. 'Hoa gió' offers sun shading, ventilation, privacy, and aesthetic value, fitting well with Vietnam’s climate, and was a key feature of the “golden era” of Vietnamese modernism. Although there is scholarly interest, studies on 'Hoa gió' are limited and often view it as a Western adaptation. The Ecological Underpinnings Of Famine: Irish Agriculture And Land Use Under British Colonialism, 1534-1852, Wyatt Bandy-Page

Ireland’s Great Hunger (1845-52) cannot be reduced to merely potatoes and blight. This thesis approaches the Great Hunger in the context of agricultural and land use changes under British colonialism (1534-1852). Across seven centuries, successive waves of settlers seized the most productive lands, eventually giving rise to a series of plantation schemes designed to maximize the extraction of Irish human and natural capital. Land use transformations under colonial rule severely restricted Gaelic foodways and kept the Irish laboring classes at bare subsistence levels, while the produce of Irish plantations fueled English economic development. Orientalist discourses have long recirculated the idea that Muslim women are oppressed victims of Islam; an idea that has denigrated Muslims and positioned white, Christians as superior. For Muslim women refugees specifically, the gendered orientalist discourse of victimization has reappeared on both sides of the debate on Syrian refugee resettlement in the United States (U.S.) (and other Western states). Within anti-resettlement circles, the narrative of Muslim women as oppressed victims has been leveraged as a reason to stop Syrian refugee resettlement; based on a rationale that their lifestyles and values are incompatible with liberal, Western societies. While many organizations invest in their leaders when onboarding them for their new role; oftentimes this process can be overlooked in the K-12 school setting when it comes to school administrators. As a result, this study focuses on analyzing the needs of new school administrators and how to better support them in their role when transitioning to a new district or from the classroom. This study utilizes Mixed-Methods Action Research methodology to assess and address the needs of new school administrators at Noblesville Schools, a K-12 public school district in Hamilton County, Indiana.

Approximately 500,000 people in the United States are affected by a burn injury and seek care every year. With medical innovation, however, the burn injury survival rate has increased to 97% in the United States. Burn survivors undergo two phases of recovery: acute and rehabilitation.With advances in burn treatment and care, the focus has shifted from the expectation of survival to improving outcomes. In recent years, the United States military has fallen short of recruitment and retention goals. Belonging and trust may be beneficial in developing stronger peer-to-peer bonds in first-year college outdoor orientation programs, but no known study has explored the use of adventure in developing belonging and trust in ROTC orientation programs. Researchers surveyed traditional and adventure-based ROTC orientation programs and compared belonging and trust scores. ROTC programs were then compared to non-military-based outdoor orientation programs from across the United States. Understanding a species behaviour, in particular behavioural thermoregulation, is important as it can indicate how well the species will adapt to changing environments, such as climate change. Ectotherms are particularly vulnerable to the effects of climate warming as they rely on environmental conditions to regulate their body temperature and physiological functions. Thermal imaging can be used as a non-invasive method to study thermal behaviour. Thermal images measure the surface temperature of species as well as surrounding substrate. The U.S. has seen a shift towards decentralized watershed governance in recent decades that has increased the delegation of management responsibilities to local governments and community organizations. This shift has precipitated the emergence of multilevel watershed governance systems (e.g. national, state, regional, local management levels) that are hypothesized to be more adaptive and responsive to local needs. When “gender” was translated to Icelandic in 1998 as kyngervi, the notion of performative gender had been circulating in Icelandic academia for a little over a year. In this article, I outline a possible use of social media platforms in the music theory and ear-training classroom using a model assignment on (but not exclusive to) TikTok. The research focuses on how AI art generators impact learning outcomes in art history for both undergraduate and graduate students enrolled in Ancient Art courses, covering eras from ancient Mesopotamia to the fall of Rome. How do participants in communities of play centered around digital games engage with history? The historiographic influences of ludic form have been closely scrutinized in recent years, but little attention has been paid to the digital cultures—to the communities of play— which center the discussion and play of these historical games. This dissertation conceptualizes peacebuilding in Afghanistan (2001-2021) as facilitation of sociocultural transformation of the country towards accepting the international norms important for sustainable peace, such as democracy, human rights, and gender equality. Hence, peacebuilding was highly normative and required enormous changes promoted by key peacebuilding actors to transform Afghan politics, society, and culture from a traditional society marked by fragmentation and radicalization to one that embraced these values.

This thesis uses a microhistorical methodology to examine the social impact and lived experience of Prohibition in Sanford, Florida, and the surrounding area – an historically "dry" community. Historiographical claims from state, regional, and national studies are tested through data sampling of Sanford Municipal Court Records; close readings of more than 200 Sanford Herald articles; and an oral history with a local museum curator based on family tradition.

This is an evidence-driven thesis. A thirty-percent sampling of 23,000 Sanford Municipal Court Records covering the Prohibition era (1920-1933) enables detailed analysis of alcohol-related arrest and enforcement patterns based on race, gender, …

School belongingness is the belief by students that the adults in the school care about their learning and them as individuals. Students are more likely to succeed when they feel connected to their school. In this qualitative dissertation study, I investigated the impact of a mentorship program for Black male high school students and its implications for promoting school belonging and cultural capital wealth. Betty Ann McNeil profiles Louise de Marillac as “a prototype social worker whose social service interventions highlight how twenty-first-century social issues echo those of the seventeenth century.” In response to the political, religious, and social upheaval in seventeenth-century France, she and Vincent de Paul founded the Confraternities of Charity and the Daughters of Charity. These groups made innovative use of women’s leadership and organizational skills to provide the poor with quality care. McNeil explains how Louise’s “approach to serving people in need remains relevant for social work practitioners today.”

This research seeks to identify the ways in which times of crisis led to changes in high school economics curriculum. Fire is an essential component of the landscapes and forests of the Pacific Northwest, including the temperate rainforests of the Olympic Peninsula. Previous fire history reconstructions from the peninsula show that fire return intervals varied throughout the postglacial period, primarily in response to climatic changes and corresponding shifts in vegetation. However, much less is known about the fire history of the low-elevation forests of the Olympic Peninsula and the role of cultural fire regimes in these environments.
