Unrules, Daniel Walters, Cary Coglianese, Gabriel Scheffler Jan 2021

Unrules, Daniel Walters, Cary Coglianese, Gabriel Scheffler

Faculty Scholarship

At the center of contemporary debates over public law lies administrative agencies’ discretion to impose rules. Yet, for every one of these rules, there are also unrules nearby. Often overlooked and sometimes barely visible, unrules are the decisions that regulators make to lift or limit the scope of a regulatory obligation, for instance through waivers, exemptions, and exceptions. In some cases, unrules enable regulators to reduce burdens on regulated entities or to conserve valuable government resources in ways that make law more efficient. However, too much discretion to create unrules can facilitate undue business influence over the law, weaken regulatory …

The Duty Of Legislative Counsel As Guardians Of The Statute Book: Sui Generis Or A Professional Duty Of Lawyers?, Andrew Flavelle Martin Jan 2021

The Duty Of Legislative Counsel As Guardians Of The Statute Book: Sui Generis Or A Professional Duty Of Lawyers?, Andrew Flavelle Martin

Articles, Book Chapters, & Popular Press

Legislative counsel—those who draft legislation for the executive or for legislative assemblies—are largely overlooked in the Canadian legal literature and case law. One respect in which legislative counsel appear to be unique is their duty as guardians or keepers of the statute book. This article argues that this Guardian duty is best understood as a professional duty of legislative counsel as lawyers. In the same way that all lawyers have professional duties as officers of the court, though these duties are most relevant to litigators, all lawyers have professional duties as officers of the statute book, though these duties are …

Judicialization Of Election Disputes In Africa's International Courts, James Thuo Gathii, Olabisi D. Akinkugbe Jan 2021

Judicialization Of Election Disputes In Africa's International Courts, James Thuo Gathii, Olabisi D. Akinkugbe

Articles, Book Chapters, & Popular Press

This article assesses what benefit losers of high-stakes national elections think they will get from petitioning international courts in Africa. We seek to establish how judicial intervention differs before an election when there is a risk of an international law violation, versus after an election has occurred and the result is viewed as flawed. We address these questions by drawing on a set of disputes decided by international courts in Africa in the African Court, the Economic Community of West African States (“ECOWAS”) Community Court of Justice, and the East African Court of Justice. We supplement our analysis by discussing …

The Intersection Between Multi-Voiced Narratives And First-Person Narratives Of War Fiction: Epistemology And The Meaning Of War, Prashant Patel Jan 2021

The Intersection Between Multi-Voiced Narratives And First-Person Narratives Of War Fiction: Epistemology And The Meaning Of War, Prashant Patel

Electronic Theses and Dissertations, 2020-2023

The topic for this project concerns a critical rhetorical analysis of the correlation between texts of first-person narratives and multi-voiced narratives of the Vietnam War (1965-1975) and the American invasion of Iraq (2003-2011). Moreover, this project establishes a correlation between the textual design in these novels and concepts of epistemology that reside in the Western cannon of rhetorical theory. The theoretical framework that is incorporated within this study extracts concepts of (t)ruth from philosophical works such as Michel Foucault's Birth of the Clinic and Friedrich Nietzsche's On Truth and In a Nonmoral Sense. In comparison, I examine the concepts and …

Mayakovsky On The Land, Ludmila Lavine Jan 2021

Mayakovsky On The Land, Ludmila Lavine

Faculty Journal Articles

It is surprising that the poet whose self-proclaimed mission was to give city streets a language turned to publicizing farming collectives. No less noteworthy is the poet of internationalism working on the ethnocentric Crimea project of advertising Jewish agrarian communities. This paper addresses Mayakovsky’s collaboration on the film Evrei na zemle (Jews on the Land, 1927), and his poems ““Evrei (Tovarishcham iz OZETa)” (“Jew [To Comrades from OZET],” 1926) and “‘Zhid’” (“‘Yid’,” 1928). I argue that in these works the poet reshuffles the svoi-chuzhoi dichotomy. While using the Moses story of exile and liberation, the poet both domesticates the Jew …

Behind Every Man(Uscript) Is A Woman: Social Networks, Christine De Pizan, And Westminster Abbey Library, Ms 21, Elizaveta Strakhov, Sarah Wilma Watson

English Faculty Research and Publications

London, Westminster Abbey Library, MS 21, a French lyric anthology dating to the mid-fifteenth century, bears the names of two male figures. Thomas Scales (c. 1399–1460), an English war commander, had his name and personal motto elaborately incorporated into the explicit of Christine de Pizan’s Epistre au dieu d’amours. Decades later, a Tudor reader added the name “Wyllam courtnay” to the manuscript’s margins. These two male names, physically visible on the surface of the manuscript, represent stable points of provenance data that provide important information about the use, meaning, and circulation of this medieval miscellany and the texts it …

Shaping The Teaching And Learning Of Intercultural Communication Through Virtual Mobility, Theresa Catalano, Andrea Muñoz Barriga Jan 2021

Shaping The Teaching And Learning Of Intercultural Communication Through Virtual Mobility, Theresa Catalano, Andrea Muñoz Barriga

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The globally mobile reality of today’s world has made the field of intercultural communication increasingly relevant as people more often find themselves in intercultural situations. As a result, language teachers must be more prepared to work in intercultural contexts, and to teach their own students how to communicate across differences in intercultural situations both physically and virtually. The present paper examines this special issue’s topic of physical and virtual mobility and intercultural competence through the lens of teacher education. Using narrative inquiry, two teacher educators in very different geographic and socio-economic contexts (US and Colombia) explore their own attempts at …

Factors Associated With Novice General Education Teachers’ Preparedness To Work With Multilingual Learners: A Multilevel Study, Qizhen Deng Ph.D., Lydiah Kananu Kiramba, Kara Mitchell Viesca

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This study examined factors linked to novice general education teachers’ perception of their preparedness to work with multilingual learners in the classroom. Using a multilevel modeling approach, we examined factors at the teacher and school levels using two AY 2015 to 2016 datasets: The National Teacher and Principal Survey from the National Center for Education Statistics and the Civil Rights Data Collection from the Office of Civil Rights. The results show that teacher perception of preparedness was positively associated with teacher education courses on working with multilingual learners, supports received during the first-year teaching, and the number of multilingual learners …

Preservice Elementary Teachers’ Identity Development In Learning To Teach Science: A Multi-Site Case Study, Deepika Menon, Saiqa Azam

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The purpose of this qualitative study was to investigate preservice elementary teachers’ science teacher identity development during their participation in the field-based science methods course and a year after. Grounded within the Feiman-Nemser’s thematic framework of learning to teach, this study utilized a case study approach aimed to examine the experiences that contributed to formation of science teacher identities of two participants uniquely positioned in the teacher education programs at the two sites, USA and Canada. Data collected over a year included science autobiographies, reflective journals, interviews, classroom observations, and artifacts. The analysis of the data revealed that experiences and …

Immigrant Background Students’ Names And Identities In U.S. Schools: Voices From The Underground, Lydiah Kananu Kiramba Jan 2021

Immigrant Background Students’ Names And Identities In U.S. Schools: Voices From The Underground, Lydiah Kananu Kiramba

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This poem is a recreation of conversational interviews with five immigrant background adolescent African girls (Pendo, Furaha, Amani, Faraja, and Neema), all names are pseudonyms. In those interviews, the girls continuously shared how important their names are for them and the challenges they encountered with teachers and peers mispronouncing their names. One student mentioned taking time to teach her teachers, but was often told, “It’s just a name.” Weird gazes on her teachers’ faces are the best pronunciation she had received. This free verse poem speaks to the relationship between students’ individual names and identities, biases—which are often based on …

Cultural And Linguistic Experiences Of Immigrant Youth: Voices Of African Immigrant Youth In United States Urban Schools, Lydiah Kananu Kiramba, Alex Kumi-Yeboah, Patriann Smith, Anthony Mawuli Sallard Jan 2021

Cultural And Linguistic Experiences Of Immigrant Youth: Voices Of African Immigrant Youth In United States Urban Schools, Lydiah Kananu Kiramba, Alex Kumi-Yeboah, Patriann Smith, Anthony Mawuli Sallard

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This study explores experiences of 50 culturally and linguistically diverse African immigrant students attending public urban middle and high schools in the US. Drawing on in-depth interviews, and through constant comparison analysis, emerging findings highlight pedagogical, linguistic, and curricular variation struggles in the classroom; transitional contextual challenges; cultural mismatch; miscommunication, and stereotypes. In light of these experiences, African immigrant urban youth draw on familial, navigational and aspirational capital to resist stereotypical assumptions and to develop resilient skills necessary to navigate the inherent challenges. Findings underscore the importance of appreciating ways of knowing that deviate from the host country knowledges as …

Teeka Tehreek: Increasing Epi Vaccinations In Khyber Pakhtunkhwa, Pakistan, Narjis Fatima Hussain

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Abstract

Globally, Pakistan ranks third among countries with the most unvaccinated and under-vaccinated children. Within the country, there are huge regional disparities, and the Khyber Pakhtunkhwa region (KPK FATA) has one of the lowest vaccination rates in the country. Low vaccination rates contribute to the high burden of childhood infectious diseases in Pakistan that cause 70% of childhood deaths. Addressing the issue requires an understanding of the barriers towards vaccinations; 30% of refusals are due to religious reasons and other misconceptions that are compounded by low literacy rates. Since religion has a critical authority in shaping the population’s beliefs, attitudes, …

Nurse Home Visitation Program In Hamilton County, Oh To Increase Maternal And Child Health Outcomes, Hannah Widner

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Hamilton County Ohio currently has poor outcomes related to maternal and infant health, specifically among African Americans. Compared to the Healthy People 2020 goals, Hamilton County has higher rates of infant mortality, preterm birth, neonatal infant mortality, and conception within 18 months of previous pregnancies. These rates are disproportionate among African Americans. For instance, African American babies born in Ohio have higher infant mortality rate (14.3 per 1,000) prematurity as a cause of death (4 per 1,000) and neonatal mortality rate (9.2 per 1,000). These are compared to White babies in Ohio with infant mortality rate (5.1 per 1,000), prematurity …

The Ecuadorian Microbiome Project: A Plea To Strengthen Microbial Genomic Research, Magdalena Díaz, Pablo Jarrín-V, Raquel Simarro, Pablo Castillejo, Gabriela N. Tenea, C. Alfonso Molina

Neotropical Biodiversity

A technological revolution provides nations with access to unprecedented quantities of molecular information, and this is particularly evident in the vast and yet poorly understood realm of the microbiome. Traditionally, many developing countries in Asia, Africa, and South America remain marginal participants in the global flow of biodata, which will eventually affect their productivity and economies. Here, we present the Ecuadorian Microbiome Project (EcuMP) as an integrative initiative to close the research gap in the microbiome for Ecuador. We discuss the relevance that the study of the microbiome has for our understanding of diversity and new forms of production and …

Background:

The classification of patients with primary progressive aphasia (PPA) into variants is time-consuming, costly, and requires combined expertise by clinical neurologists, neuropsychologists, speech pathologists, and radiologists.

Objective:

The aim of the present study is to determine whether acoustic and linguistic variables provide accurate classification of PPA patients into one of three variants: nonfluent PPA, semantic PPA, and logopenic PPA.

Methods:

In this paper, we present a machine learning model based on deep neural networks (DNN) for the subtyping of patients with PPA into three main variants, using combined acoustic and linguistic information elicited automatically via acoustic and linguistic analysis. …

Direction And Associated Motion In Tibeto-Burman, Carol Genetti, Kristine Hildebrandt, Alexia Fawcett, Nathaniel Sims Jan 2021

Direction And Associated Motion In Tibeto-Burman, Carol Genetti, Kristine Hildebrandt, Alexia Fawcett, Nathaniel Sims

SIUE Faculty Research, Scholarship, and Creative Activity

This study analyzes systems of direction and associated motion in 23 languages of the Tibeto-Burman family. Both direction and associated motion can be encoded by a range of grammatical strategies, including affixes, clitics, parti- cles, serial-verb constructions, and auxiliary verbs. While some languages have only associated motion or direction, others have both, either via distinct sub- systems, syntactic ambiguity, or context-dependent interpretation. While direc- tional encodings can be interpreted as associated motion in some contexts, the reverse can also be true. Verbal semantics is key to the pragmatic interpretation of examples in context; some types of motion verbs are more …

A Quantitative Analysis Of The Relationship Between Dispositions And Technology Integration Knowledge Of English Language Teachers, Moe D. Greene Jan 2021

A Quantitative Analysis Of The Relationship Between Dispositions And Technology Integration Knowledge Of English Language Teachers, Moe D. Greene

Theses and Dissertations

Despite the pervasiveness of educational technological tools, their potential is generally overlooked. An examination of technology integration literature suggests a gap in understanding why teachers lack the necessary knowledge to successfully integrate technology in their teaching as well as an absence of a robust technology integration theoretical framework. Technological pedagogical content knowledge (TPACK) was developed to explain the specific knowledge needed for effective technology integration. Several limitations, however, have been noted in regards to the ability of this framework to capture the connections between the complexities of teachers’ contexts and their technology integration knowledge. This dissertation advances current literature by …

Spoken Discourse Assessment And Analysis In Aphasia: An International Survey Of Current Practices, Tyson G. Harmon, Brielle C. Stark, Manaswita Dutta, Laura L. Murray, Davida Fromm, Lucy Bryant Jan 2021

Spoken Discourse Assessment And Analysis In Aphasia: An International Survey Of Current Practices, Tyson G. Harmon, Brielle C. Stark, Manaswita Dutta, Laura L. Murray, Davida Fromm, Lucy Bryant

Faculty Publications

Purpose

Spoken discourse analysis is commonly employed in the assessment and treatment of people living with aphasia, yet there is no standardization in assessment, analysis, or reporting procedures, thereby precluding comparison/meta-analyses of data and hindering replication of findings. An important first step is to identify current practices in collecting and analyzing spoken discourse in aphasia. Thus, this study surveyed current practices, with the goal of working toward standardizing spoken discourse assessment first in research settings with subsequent implementation into clinical settings.

Method

A mixed-methods (quantitative and qualitative) survey was publicized to researchers and clinicians around the globe who have collected …

Anonymous Equity Research, Travis Dyer, Eunjee Kim Jan 2021

Anonymous Equity Research, Travis Dyer, Eunjee Kim

Faculty Publications

Crowdsourced financial information platforms often allow content contributors to publish equity research anonymously. This study examines whether investors value or discount information in anonymous equity research. In the short window around research releases, we find that investors’ stock price reaction to anonymous research is muted in comparison to nonanonymous research. Consistent with credibility concerns influencing investor response, we document that this discount to anonymous research dissipates as the monitoring of content contributors intensifies and as authors develop a reputation for high-quality reporting. In addition, we perform a content analysis on the research reports and find that the muted market reaction …

The African Human Rights System As ‘Norm Leader’: Three Case Studies, Obiora C. Okafor, Godwin E.K. Dzah Jan 2021

The African Human Rights System As ‘Norm Leader’: Three Case Studies, Obiora C. Okafor, Godwin E.K. Dzah

Articles & Book Chapters

Africa (including its human rights system) is rarely imagined or considered an originator, agent and purveyor of ideas, including in the human rights sphere. On this occasion of the fortieth anniversary of the adoption of the 1981 African Charter on Human and Peoples’ Rights which founded the African human rights system, it is only fitting that its contributions or otherwise to global human rights praxis, over these four decades, be examined from this perspective. Utilising the theory of the norm life cycle, developed by scholars of international relations who work within ‘strategic social constructivism’, this article examines how the African …

Exploring Sectoral Solutions For Digital Workers: The Status Of The Artist Act Approach, Sara Slinn Jan 2021

Exploring Sectoral Solutions For Digital Workers: The Status Of The Artist Act Approach, Sara Slinn

Articles & Book Chapters

Digital workers have not had significant success in securing conventional forms of collective workplace representation, particularly statutory collective bargaining. This article examines an established sectoral bargaining statute, the Status of the Artist Act (SOA), as a possible model for collective bargaining legislation that is better suited to regulating digital work than the Wagner Act model (WAM) of labor legislation. Key features of the WAM labor legislation pose significant barriers for digital worker organizing. First, the necessity for applicant unions to demonstrate a threshold level of support among workers requires applicants to accurately estimate the number of workers in the proposed …

Introduction To The Edward Elgar Research Handbook On Law And Emotion, Susan A. Bandes, Jody Lynee Madeira, Kathryn D. Temple, Emily Kidd White

Articles & Book Chapters

The role of emotion in law has long been shrouded in mystery. The legal system is built on assumptions about human behavior, including assumptions about emotion. Thus, unavoidably, understanding emotion is an essential part of building a fairer, more effective system. Yet the emergence and growth of Law and Emotion as a field of study has been slowed by the belief that merely by acknowledging emotion, scholars and jurists would undermine the rule of law. It has been further hampered by the suspicion that emotions are too ephemeral or subjective to be understood in any systematic way. For too long, …

The E-Banknote As A 'Banknote' : A Monetary Law Interpreted, Benjamin Geva, Seraina Neva Grünewald, Corinne Zellweger-Gutknecht Jan 2021

The E-Banknote As A 'Banknote' : A Monetary Law Interpreted, Benjamin Geva, Seraina Neva Grünewald, Corinne Zellweger-Gutknecht

Articles & Book Chapters

The article discusses whether an electronic banknote is a ‘banknote’. The issue is dealt with as a matter of general statutory interpretation in the context of evolving technologies and institutional arrangements. The article proposes a clear terminology to address concepts underlying digital currencies and access to central bank money and argues that a banknote may be ‘written’ electronically. The article is critical of both account-based Central Bank Digital Currency (CBDC) and cryptocurrencies and highlights features of nonblockchain token-based alternatives. It sheds light on considerations affecting the selection of a design which is appropriate from both a functional and legal perspective …

An Examination Of Romantic Relationship Initiation Strategies Utilized By Young Adults With High-Functioning Autism Or Asperger’S Syndrome, Aaron Loewy Jan 2021

An Examination Of Romantic Relationship Initiation Strategies Utilized By Young Adults With High-Functioning Autism Or Asperger’S Syndrome, Aaron Loewy

UNF Graduate Theses and Dissertations

Individuals with and without High-Functioning Autism and Asperger’s Syndrome (HFA/AS) both show interest in sexuality and/or romance. However, the symptoms of autism, such as difficulties with indirect communication, emotional expression, signaling, theory of mind, and sexuality, can elicit difficulties that make the establishment and maintenance of romances problematic. Despite these challenges, many individuals on the spectrum have reported romantic experiences. To gain a better understanding of how such individuals formed and sustained romantic relationships, seven participants with HFA/AS were interviewed using a semi-structured approach followed by a thematic analysis of their transcribed responses. It was found that common circumstances served …

A Review Of Two Decades Of Research On Language In International And Multicultural Marketing (1997 – 2020) – Supplemental Material, Yung-Hwal Park, Kevin Lehnert

Other Faculty Publications

This comprehensive review piece investigates over two decades of research, reflecting on the crucial role of language in international marketing success. In coding and summarizing 181 articles, this work highlights how language has impacted international-marketing-related outcomes across 19 specific content areas. Those content areas are then grouped into seven broad research themes relating to language: Marketing Communications; Linguistics; Branding; Consumer Behavior; Servicescape and Retailing; Internationalization, Supply Chain and Sales; Bilingualism. We synthesize these themes and the common outcomes of the research. From these themes we highlight challenges to the field and explore future research in language in international marketing.
