What Counts As Data?, Anya Bernstein
What Counts As Data?, Anya Bernstein
Brooklyn Law Review
We live in an age of information. But whether information counts as data depends on the questions we put to it. The same bit of information can constitute important data for some questions, but be irrelevant to others. And even when relevant, the same bit of data can speak to one aspect of our question while having little to say about another. Knowing what counts as data, and what it is data of, makes or breaks a data-driven approach. Yet that need for clarity sometimes gets ignored or assumed away. In this essay, I examine what counts as data in …
Two Types Of Empirical Textualism, Kevin Tobia, John Mikhail
Two Types Of Empirical Textualism, Kevin Tobia, John Mikhail
Brooklyn Law Review
Modern textualist and originalist theories increasingly center interpretation around the “ordinary” or “public” meaning of legal texts. This approach is premised on the promotion of values like publicity, fair notice, and democratic legitimacy. As such, ordinary meaning is typically understood as a question about how members of the general public understand the text—an empirical question with an objective answer. This essay explores the role of empirical methods, particularly experimental survey methods, in these ordinary meaning inquiries. The essay expresses optimism about new insight that empirical methods can bring, but it also cautions against the view that these methods will deliver …
Natural Language And Legal Interpretation, Stephen C. Mouritsen
Natural Language And Legal Interpretation, Stephen C. Mouritsen
Brooklyn Law Review
Judges and lawyers often appeal to the “ordinary meaning” of the words in legal texts. Until very recently, claims about the ordinary meaning of words in legal texts have not been informed by evidence of the way that words are used or understood by ordinary people. This is because no such evidence—and no method to gather such evidence—was available. Instead, judges, parties, and scholars have been left to rely on their own linguistic intuitions and dictionaries, both of which are problematic guides to the usage or understanding of ordinary people. This symposium on Data Driven Interpretation focuses on recent developments …
Hypothesis Testing Ordinary Meaning, Daniel Keller, Jesse Egbert
Hypothesis Testing Ordinary Meaning, Daniel Keller, Jesse Egbert
Brooklyn Law Review
Corpus linguistic tools promise to make determinations of the ordinary meaning (OM) of a word or phrase in a statute more objective, replicable, and transparent. However, significant questions remain as to how corpora may best be employed in the process of determining OM. In this paper, we argue that objectivity, replicability, and transparency are bolstered when legal practitioners take a hypothesis testing approach to determining ordinary meaning. In this approach, the corpus (a large collection of authentic texts) is treated as a sample of data which the practitioner may use to draw inductive inferences about the meaning of the term …

A Critical Perspective On The Indian Experience, K. P. Madhu
A Critical Perspective On The Indian Experience, K. P. Madhu
Online Journal of Space Communication
Growth in the use of satellites for education has been phenomenal in India. Beginning in the 1970s with the SITE project (Satellite Instructional Television Experiment) using a borrowed US satellite, then in the 1980s having its own indigenous INSAT satellite for educational TV, to having a full fledged educational channel on national TV in the 1990s, to the potential of 72 educational channels on EDUSAT at the beginning of the 21st century, shows long-term interest and commitment to this sector.
You’Ve Got Mail: A Sequential Mixed Methods Linguistic Investigation Of Faculty And Advisor Email, Kevin A. Manley
You’Ve Got Mail: A Sequential Mixed Methods Linguistic Investigation Of Faculty And Advisor Email, Kevin A. Manley
Dissertations
Email is one of the most prolific forms of communication in the world. As colleges and universities move more student experiences online, faculty members and advisors need to understand how to best communicate with students. In an attempt to understand how faculty and advisors write, and, more importantly, how students read, I developed this two-phase mixed methods investigation. In Phase I, I collected nine writing samples from 19 faculty and advisor participants and dissected the samples with Pennebaker Conglomerate’s 2015 Linguistic Inquiry and Word Count (LIWC) program. In a transition phase, I leveraged Phase I data to create an instrument …
Punnett Square Or Protein Production? The Expert-Novice Divide For Conceptions Of Genes And Gene Expression, Dina L. Newman, Aeowynn Coakley, Aidan Link, Korinne Mills, Leslie Kate Wright
Punnett Square Or Protein Production? The Expert-Novice Divide For Conceptions Of Genes And Gene Expression, Dina L. Newman, Aeowynn Coakley, Aidan Link, Korinne Mills, Leslie Kate Wright
Articles
Concepts of molecular biology and genetics are difficult for many biology undergraduate students to master yet are crucial for deep understanding of how life works. By asking students to draw their ideas, we attempted to uncover the mental models about genes and gene expression held by biology students (n = 23) and experts (n = 18) using semistructured interviews. A large divide was identified between novice and expert conceptions. While experts typically drew box-and-line representations and thought about genes as regions of DNA that were used to encode products, students typically drew whole chromosomes rather than focusing on gene structure …
Syllabus Development Of A Mindful Exploration Of Contemplative Chanting Course, Edwin Ebinger
Syllabus Development Of A Mindful Exploration Of Contemplative Chanting Course, Edwin Ebinger
Mindfulness Studies Theses
Contemplative chanting has a long history across a broad cross section of the world’s civilizations. However, with the modern American acceptance and expansion of Eastern-based contemplative practices, chanting has not at present firmly established itself. Within this context, further investigation into the physiological and neurological effects of chanting, the various ritualistic traditions and purported transformational effects of chanting, and the role of chanting within the modern American mindfulness movement is warranted. To this end, a syllabus for graduate level study is developed herein based upon a literature review of the existing English-language discourse, the Lesley University Mindfulness Studies program design, …

English Medium Instruction ( Emi ) At King Saud Bin Abdulaziz University For Health Sciences ( Ksau-Hs ): Students’ Needs And Instructors’ Attitudes, Abdulelah Mohammed Alkhateeb
Theses and Dissertations
This dissertation project aims to shed light on EMI instructional strategies through investigating undergraduate students' and instructors’ perspectives in the College of Applied Medical Sciences (CAMS) at KSAU-HS in the Al-Ahsa campus. This exploratory instrumental case study revealed the students’ and instructors’ beliefs toward EMI implementation to increase the awareness and understanding of the consequences of implementing EMI in one of the English as a Foreign Language (EFL) contexts. In so doing, two major research questions about EMI implementation as well as perceived risks and benefits from implementing EMI in the CAMS drive the project: “How do science, health, and …
The Impact Of French Algeria’S Participation During The First And Second World Wars On The Algerian Nationalist Movement, Reide Prunty
The Impact Of French Algeria’S Participation During The First And Second World Wars On The Algerian Nationalist Movement, Reide Prunty
West Virginia University Historical Review
The colonial relationship between France and French Algeria reached its boiling point during the Algerian War of Independence in 1954 after more than a century of French imperial subjugation. Before this pivotal year, French Algeria was required to support France through two total and primarily European wars. While Algerians believed that such a sacrifice for their imperial mother nation was cause for equality under French law, France was committed to the continued oppression of its colony. This essay argues that French Algeria’s contribution to the French war effort during the First and Second World Wars served as a catalyst to …
Agency: What Does It Mean To Be A Human Being?, Richard N. Williams, Edwin E. Gantt, Lane Fischer
Agency: What Does It Mean To Be A Human Being?, Richard N. Williams, Edwin E. Gantt, Lane Fischer
Faculty Publications
This paper will look at the results of what has been termed “the crisis of modernism” and the related rise of postmodern perspectives in the 19th and 20th centuries. It concentrates on what is arguably the chief casualty of this crisis – human agency – and the social science that has developed out of the crisis. We argue that modern and postmodern social science ultimately obviate human agency in the understanding of what it means to be a human being. Attention is given to the contemporary intellectual world and the way in which it has been deeply informed by neo-Hegelian …

University Students' Perceptions Of Writing Assessment, Hanan Alaa Hegazi
University Students' Perceptions Of Writing Assessment, Hanan Alaa Hegazi
Theses and Dissertations
Instructors and students are the pillars of higher education. There is substantial interest in teachers’ beliefs, preferences, and perceptions in language assessment research, with an emphasis on writing assessment. Additionally, there is a growing body of research investigating students’ perceptions of assessment. However, research that examines how students perceive writing assessment is limited. Therefore, this study investigates two aspects: (a) students’ perceptions of their writing ability and (b) their perceptions of writing assessment in an English-medium private university in Cairo. This study adopts a mixed-methods approach for data collection, which involved distributing student questionnaires, conducting semi-structured interviews, and collecting writing …

When We See Us: Coming 2 America And The Intricacies Of Black Representation And Diasporic Conversation, Terri Bowles
Markets, Globalization & Development Review
This is a review essay of the film Coming 2 America (2021) by Craig Brewer, a follow-up to the 1988 comedy classic Coming to America , which stars Eddie Murphy as a newly crowned African king confronted with shifting family dynamics and evolving challenges to his royal authority. The review examines the cultural space occupying the 30 years that separate the first film and its sequel, and interrogates the structures of popular film and comedy that situate representational discourses of gender and diasporic Black representation.

Trust, Power, And Transformation In The Prison Classroom, Fran Fairbairn
Trust, Power, And Transformation In The Prison Classroom, Fran Fairbairn
Journal of Prison Education and Reentry (2014-2023)
This article does three things. First, it asks a new question about transformative education, namely ‘what is the role of power and trust in the decision of whether to transform one’s meaning scheme in the face of new information or whether to simply reject the new information?’ Secondly, it develops a five-stage model which elaborates on the role of this decision in transformative learning.[1] Finally, it uses grounded-theory and the five-stage model to argue that power and trust play an important role in facilitating transformative learning.

‘…In The Secret Of One’S Life’: Bernard Stiegler And Philosophy In The Intimacy Of His Prison Cell, Anna Kouppanou
Journal of Prison Education and Reentry (2014-2023)
In his book, Acting Out, philosopher Bernard Stiegler confesses that the question once posed to him by Marianne Alphant − namely, ‘How does one become a philosopher in the intimacy and secret of one’s life?’ threw him ‘into an embarrassing position’, mainly because Stiegler became a philosopher in the intimacy of his prison cell. There is no question that from Socrates to Antonio Gramsci, there have been philosophers who have suffered shorter or longer periods of imprisonment, but this was mainly because of their philosophy – their individuated way of being and thinking. In Bernard Stiegler’s case, it appears …
Making Scientific And Technical Materials Pervasively Accessible, Jason J.G. White
Making Scientific And Technical Materials Pervasively Accessible, Jason J.G. White
Journal of Science Education for Students with Disabilities
In this paper, the question is explored of what policies, standards and practices are desirable to ensure that hardware, software and publications in the sciences and associated disciplines are created from the outset to be accessible to people with disabilities. Insight into this question can be obtained by considering the unique accessibility challenges that these materials pose, including complexities of notation, language, and graphical representation.
Having analyzed what sets this problem apart from broader issues of accessibility, the advantages and limitations of current international standards are reviewed, and contemporary developments in standards and policies are considered from a strategic perspective. …

Locked In And Locked Out: A Migrant Woman’S Reflection On Life In Australia During The Covid-19 Pandemic, Olivera Simic
Journal of International Women's Studies
In this paper I offer personal reflections on life in Australia during the COVID-19 pandemic. I reflect on what it means for a migrant woman with a complex traumatic past to be indefinitely stranded. I also draw on experiences of other migrant women living in Australia during the pandemic. The reflection brings attention to personal narratives that contribute to the growing importance of women’s herstories. With this narrative, I want to pay tribute to migrant women’s lives and by using my own experiences as a case study to reflect on personal struggles that the COVID-19 pandemic triggered. The issues of …

‘A Night Of Shame’: A Quantitative Content Analysis Of Newspaper Narratives Of The Mass Molestation Event In Bangalore, India, Vaibhav Shwetangbhai Diwanji, Awais Saleem, Jaejin Lee
Journal of International Women's Studies
On December 31, 2016 amidst New Year’s Eve revelry in Bangalore, India, about 700 young women faced a mass molestation. This research analyzed and compared 299 news articles (N=299) between January 1, 2017 and February 1, 2017 from three leading English language newspapers in India through a quantitative content analysis. Results indicated that there were differences in how the regional and national newspapers framed their stories. While national newspapers deployed the episodic frame in their news stories, the local newspaper used both thematic and episodic frames. The episodic frame focuses on individual events, whereas the thematic frame focuses …

A Deviant Or A Victim Of Pervasive Stigmatization: Wicked Women In Kavita Kané’S Lanka’S Princess, Meenakshi Meenakshi, Nagendra Kumar
Journal of International Women's Studies
Building on the foundational theories of Judith Butler and Edwin Schur, this paper scrutinises the traditional myth of the Hindu epic the Ramayana and argues: (1) how socially constructed gender performance is naturalised by cultural ideology and (2) how infringement of this performance leads to labelling individuals as deviant. Women who transgress these cultural ideologies are defined as deviant and subjected to various punishments, from public humiliation to genital mutilation. Through an exploration of the novelist Kavita Kané’s mythology inspired novel Lanka’s Princess (2017), this paper focuses on the mythical figure known as Surpankha whose character embodies masculine attributes …
Making Change On Gender-Based Violence: Assessing Shifting Political Opportunities In Canada, Lisa Boucher
Making Change On Gender-Based Violence: Assessing Shifting Political Opportunities In Canada, Lisa Boucher
Journal of International Women's Studies
Feminist anti-violence organizations provide much needed services and advocate for changes to culture and policy. However, their ability to continue with this work is jeopardized by fraught and changing relations with governments. This is especially the case for state-funded feminist service organizations which, through their ties to state funders, risk their ability to engage in advocacy. While scholars and activists warn of the challenges associated with state funding, situating funding relationships within particular social, historical, geographic, and political contexts can illuminate both the threats facing feminist service organizations, as well as openings in the political opportunity structure. Using the Canadian …

Is Women’S Empowerment A Thucydides’ Trap For Patriarchy In Pakistan? The Aurat (Woman) March-2020 And Bina Shah’S Before She Sleeps, Malik Haroon Afzal, Muhamad Rashidi Mohd Pakri, Nurul Farhana Low Abdullah
Journal of International Women's Studies
The Aurat (literal meaning, “woman” in Hindi) March, first organized in Pakistan on International Women’s Day in 2018, fanned the fire of feminist struggle in Pakistan. Since its inception, Pakistan’s patriarchy has tried to supress rising feminist voices. Last year (2020), the effort to supress these voices reached an exceptional level. Feminists faced a storm of opposition in the form of counter-marches and counter-narratives which were motivated mainly by the patriarchal agency of the country. This situation provides the basis for a critical examination of the deeply rooted patriarchal mind set, with reference to the prevailing gender politics of Pakistan. …
A Good Wife Or A Greedy Wife? Women's Roles As Wives In Chinese Corruption News Coverage, Yiyan Li
A Good Wife Or A Greedy Wife? Women's Roles As Wives In Chinese Corruption News Coverage, Yiyan Li
Journal of International Women's Studies
Xi Jinping, China’s president, has embarked on the largest anti-corruption campaign in modern Chinese history. This study provides insight into the media representing the wife figure in contemporary corruption news in China. To this end, this study employs critical discourse analysis to analyse news articles from the Central Committee for Discipline Inspection (CCDI). The data reveals news articles depict wives of corrupt cadres as greedy if they have participated in their husbands’ corrupt behaviors. In this sense, wives are represented as being responsible for their husbands’ corruption, while the ruling party’s role is marginalized. Thus, this representational strategy allows the …
