Nondelegation And Criminal Law, Carissa Byrne Hessick, F. Andrew Hessick Jan 2021

Nondelegation And Criminal Law, Carissa Byrne Hessick, F. Andrew Hessick

Faculty Publications

Although the Constitution confers the legislative power on Congress, Congress does not make most laws. Instead, Congress delegates the power to make laws to administrative agencies. The Supreme Court has adopted a permissive stance towards these delegations, placing essentially no limits on Congress’s ability to delegate lawmaking power to agencies.

In its recent decision, Gundy v. United States, the Court relied on this unrestrictive doctrine to uphold a statute delegating the power to write criminal laws. In doing so, the Court did not address whether greater restrictions should apply to delegations involving criminal law. Instead, it applied the same …

Black Citizenship, Dehumanization, And The Fourteenth Amendment, Reginald Oh Jan 2021

Black Citizenship, Dehumanization, And The Fourteenth Amendment, Reginald Oh

Law Faculty Articles and Essays

The fight for full Black citizenship has been in large measure a fight against the systematic dehumanization of African Americans. Dehumanization is the process of treating people as less than human, as subhuman. Denying Blacks full and equal citizenship has gone hand in hand with denying their full humanity. To effectively promote equal citizenship for African Americans, therefore, requires an explicit commitment to ending their dehumanization.

In this Essay, Part I discusses the concept of dehumanization and its role in the infliction of harm on a dehumanized class of people. Part II discusses the concept of citizenship, and contend that …

A Review On Electroculture, Magneticulture And Laserculture To Boostplant Growth, Victor Christianto, Florentin Smarandache

Branch Mathematics and Statistics Faculty and Staff Publications

While several reviews on potential applications of electroculture are available, in this survey, we discuss these issues from history, starting from earliest experiments by Ross. And in the last section, we discuss possible application of laserculture, another form of potential improvement. It is our hope that what we present here may be found useful for improving agricultural performance in many countries, as well as reducing dependence on fertilizer.

Foodborne Pathogens And Water Quality In Commercial-Scale Aquaponic Systems With Rapid Micro Screen Solids Removal, Sean Zachary Fogarty Jan 2021

Foodborne Pathogens And Water Quality In Commercial-Scale Aquaponic Systems With Rapid Micro Screen Solids Removal, Sean Zachary Fogarty

Master's Theses and Capstones

To meet global nutritional needs, humans need to produce an ever-increasing amount of food with dwindling natural resources. Demand for nutritious foods, particularly lean meat, fruits, and vegetables, is rapidly accelerating. To increase the intensity of production and utilize non-arable land, many growers are turning to controlled environment agriculture systems like hydroponic crop production and aquaculture (fish farming), but these are inherently inefficient in terms of water and nutrient utilization. Aquaponics is a relatively novel agricultural method that combines hydroponic and aquacultural production models to mitigate many of the costs—both realized and implicit, environmental and economic—associated with either production model …

THE WORLD HERITAGE PROPERTY of Brú na Bóinne attracts thousands of visitors from Ireland and around the globe, many drawn by the remarkable winter solstice phenomenon, when the rising sun’s rays illuminate the burial chamber. During 2020 it became clear that public health measures to combat the global pandemic were going to preclude visitor access to the chamber of the Great Mound of Newgrange, including during the annual winter solstice celebrations. When the government agencies OPW and NMS discussed how to manage Newgrange and the solstice during the restrictions, Clare Tuffy, Manager of Visitor Services at Brú na Bóinne, suggested …

Hollywood Imagines Revolutionary Haiti: The Forgotten Film Lydia Bailey (1952), Judith E. Smith Jan 2021

Hollywood Imagines Revolutionary Haiti: The Forgotten Film Lydia Bailey (1952), Judith E. Smith

American Studies Faculty Publication Series

This essay explores the history of Lydia Bailey, the only US studio-made film to depict the Haitian Revolutionary period. It asks why, in the late 1940s and early 1950s, such an unlikely project might have seemed commercially promising enough to justify a significant production budget. The essay draws on private studio memos as well as public press discussions to shed light on the high stakes in debates over racial representation and colonialism/decolonization in the late 1940s and early 1950s, and to illuminate everyday assumptions of white supremacy as these shaped the making of the film and its promotion. Production files …

Ad Tech & The Future Of Legal Ethics, Seth Katsuya Endo Jan 2021

Ad Tech & The Future Of Legal Ethics, Seth Katsuya Endo

UF Law Faculty Publications

Privacy scholars have extensively studied online behavioral advertising, which uses Big Data to target individuals based on their characteristics and behaviors. This literature identifies several new risks presented by online behavioral advertising and theorizes about how consumer protection law should respond. A new wave of this scholarship contemplates applying fiduciary duties to information-collecting entities like Facebook and Google.

Meanwhile, lawyers—quintessential fiduciaries—already use online behavioral advertising to find clients. For example, a medical malpractice firm directs its advertising to Facebook users who are near nursing homes with bad reviews. And, in 2020, New York became the first jurisdiction to approve lawyers’ …

Integrated Estuary Governance, Mary Jane Angelo, J.W. Glass Jan 2021

Integrated Estuary Governance, Mary Jane Angelo, J.W. Glass

UF Law Faculty Publications

Estuaries are complex, dynamic ecosystems that play a critical role in supporting crucial economic industries, such as commercial fishing and tourism, and providing the resources necessary to sustain coastal communities. A range of anthropogenic environmental stressors are threatening the health of estuaries throughout the world. Traditional top-down single resource focused environmental regulatory approaches have proved inadequate to protect and restore estuarine systems. In recent years, scientific and legal academics, as well as policymakers, have called for more holistic participatory approaches to addressing environmental challenges. Drawing on the literature on ecosystem management, integrated water resources management, collaborative governance, and adaptive management, …

Popular Regulation? State Constitutional Amendment And The Administrative State, Jonathan L. Marshfield Jan 2021

Popular Regulation? State Constitutional Amendment And The Administrative State, Jonathan L. Marshfield

UF Law Faculty Publications

When we think about administrative law, we tend to dwell on issues related to federal agencies and the federal laws and institutions that govern those agencies. But the federal government is only one part of a much larger regulatory structure in the United States. State agencies are a significant and crucial component of the contemporary regularly regime, and they deserve more focused scholarly attention. This is especially true because although state agencies perform functions analogous to federal agencies (i.e., they promulgate rules, adjudicate disputes, and monitor private actors), they perform those functions in a very different institutional environment. This article …

Validity Of A Four-Item Household Water Insecurity Experiences Scale For Assessing Water Issues Related To Health And Well-Being, Sera L. Young, Joshua D. Miller, Edward A. Frongillo Jr., Godfred O. Boateng, Zeina Jamaluddine, Torsten B. Neilands

Faculty Publications

We sought to determine whether a shortened version of the 12-item Household Water Insecurity Experiences (HWISE) Scale, which measures water insecurity equivalently in low- and middle-income countries (LMICs), is valid for broad use. Using data from 9,261 households in 25 LMICs, subsets of candidate items were evaluated on their predictive accuracy, criterion validity, and sensitivity-specificity. A subset with items assessing "worry," "changing plans," "limited drinking water," and "inability to wash hands" because of problems with water (range: 0-12) were highly correlated with full HWISE Scale scores (correlation coefficient: 0.949-0.980) and introduced minimal additional error (root mean square error: 2.13-2.68). Criterion …

Megf10 Deficiency Impairs Skeletal Muscle Stem Cell Migration And Muscle Regeneration, Chengcheng Li, Dorianmarie Vargas-Franco, Madhurima Saha, Rachel M. Davis, Kelsey A. Manko, Isabelle Draper, Christina A. Pacak, Peter B. Kang

Faculty Publications

Biallelic loss-of-function MEGF10 mutations lead to MEGF10 myopathy, also known as early onset myopathy with areflexia, respiratory distress, and dysphagia (EMARDD). MEGF10 is expressed in muscle satellite cells, but the contribution of satellite cell dysfunction to MEGF10 myopathy is unclear. Myofibers and satellite cells were isolated and examined from Megf10 and wild-type mice. A separate set of mice underwent repeated intramuscular barium chloride injections. Megf10 muscle satellite cells showed reduced proliferation and migration, while Megf10 mouse skeletal muscles showed impaired regeneration. Megf10 deficiency is associated with impaired muscle regeneration, due in part to defects in satellite cell function. Efforts to …

The Iron-Responsive Genome Of The Chiton Acanthopleura Granulata, Rebecca M. Varney, Daniel Isaac Speiser, Carmel Mcdougall, Bernard M. Degnan, Kevin M. Kocot Jan 2021

The Iron-Responsive Genome Of The Chiton Acanthopleura Granulata, Rebecca M. Varney, Daniel Isaac Speiser, Carmel Mcdougall, Bernard M. Degnan, Kevin M. Kocot

Faculty Publications

Molluscs biomineralize structures that vary in composition, form, and function, prompting questions about the genetic mechanisms responsible for their production and the evolution of these mechanisms. Chitons (Mollusca, Polyplacophora) are a promising system for studies of biomineralization because they build a range of calcified structures including shell plates and spine- or scale-like sclerites. Chitons also harden the calcified teeth of their rasp-like radula with a coat of iron (as magnetite). Here we present the genome of the West Indian fuzzy chiton Acanthopleura granulata, the first from any aculiferan mollusc. The A. granulata genome contains homologs of many genes associated …

On The Broadness Of The Fourth Amendment, Janine Kim Jan 2021

On The Broadness Of The Fourth Amendment, Janine Kim

SMU Law Review

This Article considers the role of property rights in defining Fourth Amendment searches. Since United States v. Jones in 2012, the Supreme Court has relied on both privacy and property to determine whether a Fourth Amendment search has occurred. But recently, many of the Justices have expressed increasing skepticism about not only the effectiveness but also the appropriateness of safeguarding privacy. The 2018 case of Carpenter v. United States, which ruled that an individual’s cell site location information is protected under the Fourth Amendment, saw all four dissenters urging a larger role for property rights in the analysis of a …

Taxing Employers For Imposing Mandatory Arbitration, Class Action Waiver, And Nondisclosure Of Dispute Provisions, Rebecca N. Morrow Jan 2021

Taxing Employers For Imposing Mandatory Arbitration, Class Action Waiver, And Nondisclosure Of Dispute Provisions, Rebecca N. Morrow

SMU Law Review

Employers impose coercive dispute resolution terms on their employees more frequently, more broadly, and with greater legal success than ever before. Recent survey data indicates that mandatory employment arbitration provisions bind more than 60 million American workers—over half of the U.S. private-sector nonunion workforce. Employment class action waivers bind nearly 25 million American workers. In 2018, the Supreme Court held 5–4 that mandatory arbitration provisions and class action waivers imposed by employers on their employees do not violate the National Labor Relations Act. These terms prohibit employees from exposing employer wrongdoing in open court, bar employees with valid wage and …

How To Catch A Digital Speed Goat: A Web Archiving Case Study At The University Of Wyoming, Sara Davis, Rachel Gattermeyer Jan 2021

How To Catch A Digital Speed Goat: A Web Archiving Case Study At The University Of Wyoming, Sara Davis, Rachel Gattermeyer

Provenance, Journal of the Society of Georgia Archivists

In an effort to keep current with trends in how people connect with information, the University of Wyoming (UW), like many institutions and companies, has elected to become as paperless as possible. Whether electronic or analog, records are essential in documenting the history, culture, and governance of an organization, and records retention schedules in archives are commonly used to ensure vital records are kept and maintained according to best practices and state laws. Much like the speed goat—the fastest land animal in North America and found throughout Wyoming—websites are hard to capture before they disappear. The high possibility of vanishing …

Phylogeny And Systematics Of The Superfamily Diplostomoidea Poirier, 1886 (Platyhelminthes: Trematoda), Tyler Joseph Achatz

Theses and Dissertations

The Diplostomoidea is a large superfamily of digeneans which possess a unique holdfast organ. Members of the superfamily are distributed worldwide and are known to parasitize a wide variety of animals, both invertebrates and vertebrates. In some cases, diplostomoideans have been associated with diseases such as ocular diplostomiasis and ‘black spot’ disease in fishes. The taxonomic and systematic history of diplostomoideans is complex and includes numerous revisions based on morphology and host associations. Prior to this study, the Diplostomoidea included 6 families and 16 subfamilies. Recent molecular phylogenetic analyses have revealed the Diplostomidae and the Strigeidae to be non-monophyletic and …

Systemic Veterinary Parasitcides For Residual Malaria Vector Control In Central America, Staci Michele Dreyer Jan 2021

Systemic Veterinary Parasitcides For Residual Malaria Vector Control In Central America, Staci Michele Dreyer

Theses and Dissertations

Malaria continues to be one of the most severe public health concerns worldwide. The malaria parasite, Plasmodium, is transmitted from person to person through the mosquito vector Anopheles. Vector control is a crucial element of anti-malarial campaigns and works best when there is thorough knowledge about an Anopheles vector’s biology and behavior in a given region. To fully eradicate malaria, new vector control strategies must be developed that exploit the behaviors of different vector species. One promising strategy to target vectors that primarily bite outdoors and display generalist feeding behaviors (zoophagic) is the use of veterinary systemic parasiticides. Veterinary parasiticides …

Maximum Carbon Dioxide Capture, Sequestration And Maximum Carbon Dioxide Beneficial Reuse At The Optimal Cost Efficiency For The Power Generation Sector To Address Global Temperature Rise, Michael Dean Garcia

Theses and Dissertations

Global Climate Change is arguably one of the most important global crises of our times. Global Climate Change is the result of increasing global ambient temperatures around the world. These increased temperature changes have been impacting all aspects of human life and activity as wells as impacting all biological and physical systems of Earth. The primary cause of Global Climate Change are anthropogenic emissions of carbon dioxide and other Greenhouse Gases. Fossil fuel combustion is a primary source of these emissions. The initiation of anthropogenic Global Climate Change has been scientifically traced back to the Industrial Revolution. From the Industrial …
