Inescapable Surveillance, Matthew Tokson Nov 2020

Inescapable Surveillance, Matthew Tokson

Utah Law Faculty Scholarship

Until recently, Supreme Court precedent dictated that a person waives their Fourth Amendment rights in information they disclose to another party. The Court reshaped this doctrine in Carpenter v. United States, establishing that the Fourth Amendment protects cell phone location data even though it is revealed to others. The Court emphasized that consumers had little choice but to disclose their data, because cell phone use is virtually inescapable in modern society.

In the wake of Carpenter, many scholars and lower courts have endorsed inescapability as an important factor for determining Fourth Amendment rights. Under this approach, surveillance that people cannot …

Black-Swan Type Catastrophes And Antifragility/Supra-Resilience Of Urban Socio-Technical Infrastructures, S. A, Timashev

Engineering Management & Systems Engineering Faculty Publications

This paper may be one of the first attempts dealing with the problem of creating, providing and maintaining antifragility of systems of interdependent urban critical infrastructures (CI) in the wake of black-swan type technological, ecological, economic or social catastrophes occurring in a municipality. A synonym is offered to describe antifragility from a positive psychology perspective, formulating the problem as the supraresilience problem. A brief description is given of the developed innovative approach for creating a supraresilient city/region using black-swan catastrophe and the antifragility concepts. Resilience metrics are formulated as well as methods of assessing damage, interdependence of infrastructures and convergent …

Chemical and Biochemical Engineering Faculty Research & Creative Works

Poly (methyl methacrylate) (PMMA) bone cement is used as a minor void filler in revision total knee arthroplasty (rTKA). The application of PMMA is indicated only for peripheral bone defects with less than 5 mm depth and that cover less than 50% of the bone surface. Treating bone defects with PMMA results in complications as a result of volumetric shrinkage, bone necrosis, and aseptic loosening. These concerns have driven the development of alternative bone cements. We report here on novel modified glass polyalkenoate cements (mGPCs) containing 1, 5 and 15 wt% calcium sulfate (CaSO4) and how the modified …

Every 40 seconds, someone in the United States has a heart attack (Heart Disease and Stroke Statistics 2017). Students may experience or be affected by several incidences of heart attacks throughout their life. As such, students should be aware of the risk factors and learn the underlying reasons for a heart attack.

Most students believe they are too young for a heart attack and think symptoms will appear gradually (Roth and Gotter 2018). Heart disease in younger individuals is appearing more frequently due to obesity, tobacco and alcohol us-age, stress, and race (Napoli 2019). In this article, we describe how …

Dosage control of reactive oxygen and nitrogen species (RONS) is critical to low-temperature plasma applications in cancer therapy. Production of RONS by atmospheric pressure, nonequilibrium plasmas in contact with liquid may be modulated via plasma conditions including plasma treatment time and pulse voltage and repetition frequency. In this study, a terephthalic acid-based probe was used to measure hydroxyl radicals [OHaq] in water exposed to plasma and to demonstrate that the OHag concentration increases linearly with treatment time. Fluorometric measurements of hydrogen peroxide concentration in plasma-activated water show a linear relationship between the H2O2 production …

Illegal killing of nongame wildlife is a global yet poorly documented problem. The prevalence and ecological consequences of illegal killing are often underestimated or completely unknown. We review the practice of legal recreational shooting and present data gathered from telemetry, surveys, and observations on its association with illegal killing of wildlife (birds and snakes) within conservation areas in Idaho, USA. In total, 33% of telemetered long‐billed curlews (Numenius americanus) and 59% of other bird carcasses found with known cause of death (or 32% of total) were illegally shot. Analysis of spatial distributions of illegal and legal shooting is …

Community Context And Dispersal Stochasticity Drive Variation In Spatial Spread, Tad Dallas, Brett Melbourne, Alan Hastings

Faculty Publications

© 2020 British Ecological Society Dispersal is a key process in shaping species spatial distributions. Species interactions and variation in dispersal probabilities may jointly influence species spatial dynamics. However, many studies examine dispersal as a neutral process, independent of community context or intraspecific variation in dispersal behaviour. Here, we use controlled, replicated communities of two Tribolium species (T. castaneum and T. confusum) to examine how intraspecific variation in dispersal behaviour and community context influence dispersal dynamics in simple experimental landscapes composed of homogeneous habitat patches. We found considerable individual-level variation in dispersal probability that was unrelated to body size variation. …

The development of Edwardsiella-containing-vacuoles (ECV) and the ability of Edwardsiella ictaluri to survive and replicate within macrophages suggests a unique process relative to normal phagosomal/lysosomal maturation and programed cell death. Developing ECV showed that endosomal membrane markers Rab5, EEA1, and Rab7 were all detected in both the wild type (WT) and an E. ictaluri type-3 secretion system (T3SS) mutant, 65ST. Co-localization with Lamp1, however, was significantly lower in the WT. The host cell endoplasmic reticulum marker, calnexin, co-localized to 65ST ECV significantly more than WT ECV, while Golgi vesicle marker, giantin, …

© 2020 John Wiley & Sons Ltd Aim: The processes that generate biodiversity occur at finer scales than are often studied, particularly in freshwater systems of the northern Neotropics. We investigate whether fine-scale biogeographic patterns are present within the larger Grijalva–Usumacinta Area of Endemism (AoE) —a region in Middle America where nearly 60% of freshwater fishes are endemic—and if present-day river basins are single historical units. Location: Northern Central America and southern Mexico. Taxon: Freshwater fishes (e.g., Cichlidae, Poeciliidae, Ostariophysi). Methods: We used fine-scale distributional data for freshwater fishes in northern Middle America (based on museum records and fieldwork) and …

Faculty Publications

Nut-based milks and yogurts are gaining popularity, but may not offer the same benefits as dairy yogurts to consumers. Cashew nuts often cause severe allergic reactions, and cashew nut allergens are stable to several types of processing. To compare its characteristics to dairy yogurt and characterize the effects of fermentation on the Ana o 1-3 cashew nut allergens, a commercial yogurt made from cashew nuts (Cashewgurt) was evaluated for microbiological, physiochemical, and immunological properties. Average counts for lactobacilli and Streptococcus thermophilus were greater than 10 million colony forming units per milliliter, indicating the capacity to provide a health benefit. Cashewgurt …

Plant architecture is critical for enhancing the adaptability and productivity of crop plants. Mutants with an altered plant architecture allow researchers to elucidate the genetic network and the underlying mechanisms. In this study, we characterized a novel nal1 rice mutant with short height, small panicle, and narrow and thick deep green leaves that was identified from a cross between a rice cultivar and a weedy rice accession. Bulked segregant analysis coupled with genome re-sequencing and cosegregation analysis revealed that the overall mutant phenotype was caused by a 1395-bp deletion spanning over the last two exons including the transcriptional end site …

The distributions of many sister species in the sea overlap geographically but are partitioned along depth gradients. The genetic changes leading to depth segregation may evolve in geographic isolation as a prerequisite to coexistence or may emerge during primary divergence leading to new species. These alternatives can now be distinguished via the power endowed by the thousands of scorable loci provided by second-generation sequence data. Here, we revisit the case of two depth-segregated, genetically isolated ecotypes of the nominal Caribbean candelabrum coral Eunicea flexuosa. Previous analyses based on a handful of markers could not distinguish between models of genetic exchange …

Viruses play an important role in the ecology and biogeochemistry of marine ecosystems. Beyond mortality and gene transfer, viruses can reprogram microbial metabolism during infection by expressing auxiliary metabolic genes (AMGs) involved in photosynthesis, central carbon metabolism, and nutrient cycling. While previous studies have focused on AMG diversity in the sunlit and dark ocean, less is known about the role of viruses in shaping metabolic networks along redox gradients associated with marine oxygen minimum zones (OMZs). Here, we analyzed relatively quantitative viral metagenomic datasets that profiled the oxygen gradient across Eastern Tropical South Pacific (ETSP) OMZ waters, assessing whether OMZ …

Planar Corrugated Electrode Configuration For Manipulation Of Micro-Scale Entities In Dielectrophoretic Microfluidic Devices, Alia Mohammed Alblooshi Nov 2020

Planar Corrugated Electrode Configuration For Manipulation Of Micro-Scale Entities In Dielectrophoretic Microfluidic Devices, Alia Mohammed Alblooshi

Mechanical Engineering Theses

This thesis conceptualizes the design of a planar electrode for employment in microfluidic devices to achieve dielectrophoretic focusing and separation of micro-scale entities. The planar electrode has corrugations with two such electrodes placed parallelly to form a pair and the electric field is generated between them; the presence of corrugations enhances the non-uniformity of the electric field. For purposes of 3D focusing, two pairs of electrodes are used with each pair on both sides of the microchannel. When the applied electric voltages are equal, the micro-scale entity is focused at the center of the microchannel and when the applied electric …

Forging A Path Towards Meaningful Digital Privacy: Data Monetization And The Ccpa, Rebecca Harris

Loyola of Los Angeles Law Review

The California Consumer Privacy Act (CCPA) was passed in response to a number of newsworthy data breaches with widespread impacts, and which revealed how little digital privacy consumers actually have. Despite the large market for consumer data, individual consumers generally do not earn money when their personal data are sold. Further, consumers have very little control over who collects their data, what information is collected, and with whom it is shared. To place control back in the hands of the consumer, affirmative consent should be required to collect and sell consumer’s data, and consumers should have the ability to sell …
