Reitz Or Wrong: An Industrial, Environmental, And Political Analysis Of Evansville’S “Lumber Baron”, Jarrod Koester Jan 2020

Reitz Or Wrong: An Industrial, Environmental, And Political Analysis Of Evansville’S “Lumber Baron”, Jarrod Koester

Undergraduate Honors Thesis Collection

For nearly two centuries, the history of Evansville, Indiana has remained incomplete as historians and the general public have not recognized some of the key factors responsible for the city’s famed past. The generally accepted history of Evansville, the state’s third-largest city, conveys valiant tales of industrialization, transportation, and successful entrepreneurs who overcame insurmountable odds and left everlasting impressions on the people of the region. While the once-prosperous city was a significant national port and participated heavily in transatlantic and transcontinental trade, Evansville’s historical significance has diminished over the course of the twentieth century. What were once bustling factories, streams …

Legal Complexities Of The Sex Trafficking Of Minors, Christie Mccormick Jan 2020

Legal Complexities Of The Sex Trafficking Of Minors, Christie Mccormick

Master's Theses and Doctoral Dissertations

Among human rights abuses in modern society, the trafficking of women and children for labor, prostitution, and other forms of sexual exploitation is one of the greatest. While a large amount of time and financial support has gone into efforts to suppress trafficking and shelter its victims, there has not been enough done to tackle this problem. Before reaching the age of 18, it is predicted that 80% of adolescents in the United States will have traded money for sex. Many adolescent girls who have been trafficked in the commercial sex industries are subject to serious criminal penalties for prostitution-related …

On The Road Again: Revisiting State Laws That Unreasonably Restrict Drivers With Epilepsy And Burden The Physicians Who Treat Them, Katrina E. Luffy Jan 2020

On The Road Again: Revisiting State Laws That Unreasonably Restrict Drivers With Epilepsy And Burden The Physicians Who Treat Them, Katrina E. Luffy

Loyola University Chicago Law Journal

When a driver with epilepsy experiences a seizure behind the wheel, she is more likely than not to cause an accident. Consequently, all fifty states and the District of Columbia have statutes, regulations, and policies governing drivers with epilepsy and the physicians who treat them. Although these laws aim to protect the states' interest in public safety, many of them are premised on the inaccurate assumption that drivers with epilepsy have higher crash rates than the general population. They provide blanket restrictions for a highly individualized disorder and ignore evidence that drivers with other disorders or diseases should be of …

From A 'Super Spreader Of Mers' To A 'Super Stopper' Of Covid-19: Explaining The Evolution Of South Korea's Effective Crisis Management System, Seung-Youn Oh Jan 2020

From A 'Super Spreader Of Mers' To A 'Super Stopper' Of Covid-19: Explaining The Evolution Of South Korea's Effective Crisis Management System, Seung-Youn Oh

Political Science Faculty Research and Scholarship

COVID-19 has placed global and national leadership under a serious stress test by threatening lives and livelihoods on an unprecedented scale. South Korea emerged as one of the first countries to flatten the transmission curve despite its high population density and proximity to China, without imposing the aggressive lockdowns or complete travel bans that China and many other countries adopted. This paper explores two questions. First, what kind of institutional and legal foundations explain South Korea’s strong public health response to the pandemic? Second, from a historical perspective, South Korea evaded the worst of the SARS outbreak in 2003 yet …

Korematzu, Hirabayashi, And The Second Monster, Eric L. Muller Jan 2020

Korematzu, Hirabayashi, And The Second Monster, Eric L. Muller

Faculty Publications

It is a trope at least as old as Beowulf: the unexpected second monster. Beowulf arrives in Heorot to take on Grendel, the demon who has been terrorizing the Ring-Danes’ mead-hall. He bests the monster in battle and Grendel slinks off, one-armed and bloodied, to die. The Ring-Danes honor Beowulf with a great banquet; he has slaughtered their nemesis and there is much to celebrate. Full of mead and a newfound sense of safety, the revelers drift off to sleep. That is when a terrible new monster bursts upon the scene—Grendel’s mother, the beast that brought Grendel into the …

White Privilege: What It Is, What It Is Not, And How It Shapes American Discussions Of Policing And Historical Iconography, Neil H. Buchanan Jan 2020

White Privilege: What It Is, What It Is Not, And How It Shapes American Discussions Of Policing And Historical Iconography, Neil H. Buchanan

UF Law Faculty Publications

What is White privilege? In this Essay, I explore the privileges that White men take for granted in dealing with the police, even as I acknowledge that the most privileged Americans are still potentially subject to arbitrary and unaccountable police abuses. I also examine the debate over changing the names of places in the United States, as well as taking down the statues of the people who have long been treated as heroes, including the founding generation. The common thread between these two topics is that privilege allows White people not even to notice when they receive favorable treatment. They …

Children’S Equality Rights: Every Child’S Right To Develop To Their Full Capacity, Nancy E. Dowd Jan 2020

Children’S Equality Rights: Every Child’S Right To Develop To Their Full Capacity, Nancy E. Dowd

UF Law Faculty Publications

Children are born equal. Yet as early as eighteen months, hierarchies emerge among children. These hierarchies are not random but fall into patterns by race, gender and class. They are not caused nor voluntarily chosen by children or their parents. The hierarchies grow, persist, and are made worse by systems and policies created by the state, perpetuating the position of the privileged and continuing the disadvantage of the subordinated. Children’s equal right to develop to their capacity is severely undermined by policies and structures that hamper and block the development of some by creating barriers and challenges or failing to …

Minding The Gaps In Regulation Of Do-It-Yourself Biotechnology, Barbara J. Evans Jan 2020

Minding The Gaps In Regulation Of Do-It-Yourself Biotechnology, Barbara J. Evans

UF Law Faculty Publications

This Symposium confronts the reality that genetic technologies – not just genetic tests, but tools for altering plant, animal, and human genomes – are rapidly becoming and indeed already are consumer technologies. People can experiment with and apply these technologies in disintermediated formats, potentially without the involvement of national research funding agencies, professional scientists, physicians, genetic counselors, regulators, and traditional medical product manufacturers. The framework of 20th -century medical product and practice regulations assigned each of these parties a role in promoting ethical, safe, and effective biomedical research and health care. Do-it-yourself biotechnology (DIYbio), which includes direct-to-consumer (DTC) and do-it-yourself …

Children's Equality: The Centrality Of Race, Gender, And Class, Nancy E. Dowd Jan 2020

Children's Equality: The Centrality Of Race, Gender, And Class, Nancy E. Dowd

UF Law Faculty Publications

Hierarchies among children dramatically impact their development. Beginning before birth, and continuing during their progression to adulthood from birth to age 18, structural and cultural barriers separate and subordinate some children, while they privilege others. The hierarchies replicate patterns of inequality along familiar lines, particularly those of race, gender, and class, and the intersections of those identities. These barriers, and co-occurring support of privilege for other children, emanate from policies, practices, and structures of the state, including education, health, policing and juvenile justice, and limited social welfare. Reimagining Equality: A New Deal for Children of Color takes on the task …

Preparing Commercial Space For Safety Management System Implementation, Brian Eugene Teske Jan 2020

Preparing Commercial Space For Safety Management System Implementation, Brian Eugene Teske

Theses and Dissertations

In 2014 The commercial space company, Scaled Composites, suffered a catastrophic event during a test flight, killing one astronaut. Several recommendations for the Federal Aviation Administration, Office of Commercial Space Transportation emerged from the National Transportation Safety Board. One recommendation was the introduction of a safety management system (SMS) as a safety protocol and became the genesis of this research project. This study has two purposes. The first purpose is to investigate whether the attributes of safety management system theory (SMST) exist in commercial space organizations. The second purpose is to explore the characteristics of high reliability theory (HRT) to …

Part 5: Virginia's Opioid Epidemic Continues And Covid-19 May Be Making It Worse, Dragas Center For Economic Analysis And Policy, Old Dominion University

State of the Commonwealth Reports

In 2017, we explored the rising toll of the opioid epidemic in Virginia and the United States. While COVID-19 has garnered much of the attention in 2020, the opioid epidemic continues in the Commonwealth. We revisit the evidence and consider whether the pandemic and social distancing measures have affected opioid overdoses in Virginia.

Standardization Roadmap For Unmanned Aircraft Systems, Version 2.0, Kristine Kiernan, Robert Joslin, John Robbins

Publications

This Standardization Roadmap for Unmanned Aircraft Systems, Version 2.0 (“roadmap”) is an update to version 1.0 of this document published in December 2018. It identifies existing standards and standards in development, assesses gaps, and makes recommendations for priority areas where there is a perceived need for additional standardization and/or pre-standardization R&D.

The roadmap has examined 78 issue areas, identified a total of 71 open gaps and corresponding recommendations across the topical areas of airworthiness; flight operations (both general concerns and application-specific ones including critical infrastructure inspections, commercial services, and public safety operations); and personnel training, qualifications, and certification. Of that …

Selecting Scrutiny In Compelled-Speech Cases Involving Non-Commercial Expression: The Formulaic Landscape Of A Strict Scrutiny World After Becerra And Janus, And A First Amendment Interests-And-Values Alternative, Clay Calvert

Fordham Intellectual Property, Media and Entertainment Law Journal

This Article examines how courts select the standard of scrutiny—strict, intermediate, or something akin to rational basis—in compelled-speech disputes following the United States Supreme Court’s 2018 rulings in National Institute of Family and Life Advocates v. Becerra and Janus v. American Federation of State, County, and Municipal Employees. The compelled-speech doctrine provides individuals and entities with a qualified First Amendment right not to be forced by the government to convey messages under certain circumstances. This principle sometimes is referred to as an unenumerated First Amendment right not to speak. The Article concentrates on compelled-speech mandates involving non-commercial expression in …

Examining The Creation Of Information Privacy Culture In Healthcare Organizations To Achieve Collective Hipaa Compliance Practice, Osborne Obeng Jan 2020

Examining The Creation Of Information Privacy Culture In Healthcare Organizations To Achieve Collective Hipaa Compliance Practice, Osborne Obeng

CCAC Theses and Dissertations

The digitization and transfer of patient records has increased the risk of patient data being improperly handled by healthcare organizations. In light of this growing concern, the United States government and state authorities have implemented various regulations to mitigate the privacy concerns. Beside privacy regulations, healthcare organizations have been forced by other pressures such as organization’s competitive pressures, resources, ethical responsibilities, and legitimacy to implement privacy safeguards. However, surveys show that healthcare organizations fail to achieve information privacy compliance. This study examined the creation of information privacy culture from the different occupational communities in healthcare organizations to help achieve information …

Boots And Bail On The Ground: Assessing The Implementation Of Misdemeanor Bail Reforms In Georgia, Andrea Woods, Sandra G. Mayson, Lauren Sudeall, Guthrie Armstrong, Anthony Potts

Faculty Publications By Year

This Article presents a mixed-methods study of misdemeanor bail practice across Georgia in the wake of reform. We observed bail hearings and interviewed system actors in a representative sample of fifty-five counties to assess the extent to which pretrial practice conforms to legal standards clarified in Senate Bill 407 and Walker v. Calhoun. We also analyzed jail population data published by county jails and by the Georgia Department of Community Affairs. We found that a handful of counties have made promising headway in adhering to law and best practices, but that the majority have some distance to go. Most …

Pretrial Detention In The Time Of Covid-19, Jenny E. Carroll Jan 2020

Pretrial Detention In The Time Of Covid-19, Jenny E. Carroll

Articles

COVID-19 has shone a light on the preexisting flaws in the criminal justice system. This Essay focuses on one of the challenges the criminal justice system faces in light of COVID-19: that of a pretrial detention system that falls more harshly on poor and minority defendants, swells local jail populations, is fraught with bias, produces unnecessarily high rates of detention, and carries a myriad of downstream consequences, both for the accused and the community at large. Long before the first confirmed case, United States' jails were particularly susceptible to contagions. The COVID-19 crisis exacerbates this problem creating an acute threat …
