The "Matthew Effect" In Punishment: : Do Previous Sanctions Foster More Sanctions In The Future?, Yinzhi Shen Jan 2020

The "Matthew Effect" In Punishment: : Do Previous Sanctions Foster More Sanctions In The Future?, Yinzhi Shen

Legacy Theses & Dissertations (2009 - 2024)

Societal response to crime is a topic at the heart of criminology. In contrast to a vast literature on the hidden social consequences of formal sanctions on individuals, family and communities, few studies have examined the ramifications of a formal sanction on future interactions with the criminal justice system over the individual life course. Applying a cumulative disadvantage (CDA) perspective, my dissertation contributes to the understanding of whether and how a prior punishment affects an individual’s trajectory of future punishments over the life course. Theoretically, I elaborated two conceptualizations of CDA processes and highlighted the overlooked value of applying CDA …

Constitutionally Unaccountable: Privatized Immigration Detention, Danielle C. Jefferis Jan 2020

Constitutionally Unaccountable: Privatized Immigration Detention, Danielle C. Jefferis

Indiana Law Journal

For-profit, civil immigration detention is one of this nation’s fastest growing industries. About two-thirds of the more than 50,000 people in the civil custody of federal immigration authorities find themselves at one point or another in a private, corporate-run prison that contracts with the federal government. Conditions of confinement in many of these facilities are dismal. Detainees have suffered from untreated medical conditions and endured months, in some cases years, of detention in environments that are unsafe and, at times, violent. Some have died. Yet, the spaces are largely unregulated. This Article exposes and examines the absence of a constitutional …

National Cybersecurity Innovation, Tabrez Y. Ebrahim Jan 2020

National Cybersecurity Innovation, Tabrez Y. Ebrahim

Faculty Scholarship

National cybersecurity plays a crucial role in protecting our critical infrastructure, such as telecommunication networks, the electricity grid, and even financial transactions. Most discussions about promoting national cybersecurity focus on governance structures, international relations, and political science. In contrast, this Article proposes a different agenda and one that promotes the use of innovation mechanisms for technological advancement. By promoting inducements for technological developments, such innovation mechanisms encourage the advancement of national cybersecurity solutions. In exploring possible solutions, this Article asks whether the government or markets can provide national cybersecurity innovation. This inquiry is a fragment of a much larger literature …

The Incomplete Record In New York State Rifle & Pistol Association V. City Of New York, Eric J. Mogilnicki, Alexander Schultz Jan 2020

The Incomplete Record In New York State Rifle & Pistol Association V. City Of New York, Eric J. Mogilnicki, Alexander Schultz

SMU Law Review Forum

A Second Amendment case now pending at the Supreme Court, New York State Rifle & Pistol Ass’n v. City of New York, tests the extent to which New York City may limit the movement of guns along city streets. The briefing in that case is, however, incomplete. Second Amendment jurisprudence calls for an examination of historical analogues to the firearms regulation at issue. Here, the New York State Rifle and Pistol Association asserted that there are none. This Article identifies numerous historical analogues to the City’s transportation restrictions, most of which were not identified in the briefing before the …

Sdma-Based Distributed Device Discovery For D2d Communication, Muddasir Rahim, Muhammad Awais Javed, Ahmad Naseem Alvi Jan 2020

Sdma-Based Distributed Device Discovery For D2d Communication, Muddasir Rahim, Muhammad Awais Javed, Ahmad Naseem Alvi

Turkish Journal of Electrical Engineering and Computer Sciences

Device-to-device (D2D) communication is an important technique to improve capacity of future wireless networks. Cellular communications, internet of things and intelligent transport systems are key areas that could benefit from reduced end-to-end delay provided by D2D communication. Efficient device discovery is an important precondition to enable D2D communication. In this paper, we propose a space division multiple access (SDMA)-based distributed device discovery protocol in which user equipments (UEs) periodically transmit discovery beacons to each other. The proposed protocol reduces contention in the discovery beacons by allocating resource blocks to the UEs based on their location. Simulations results show that the …

Immigration, Fatima Jaramillo Jan 2020

Immigration, Fatima Jaramillo

Nebraska College Preparatory Academy: Senior Capstone Projects

Immigrants want nothing but the best, not only for themselves, but for their families. Immigrants are those who choose to take the greatest risks and put their sweat and tears into everything they do because they keep reaching for the happy ending, instead of worrying about the obstacles that come with immigrating.

In the United States the true definition that government gives an immigrant is: “An alien who has been granted the right by United States Citizenship & Immigration Services (USCIS) to reside permanently in the United States and to work without restrictions in the United States.”

Immigrants struggle with …

Exit Here: Strategies For Dealing With Aging Dams And Reservoirs, Henry H. Hansen, Emily Forzono, Alisha Grams, Lindsay Ohlman, Christine Ruskamp, Mark A. Pegg, Kevin L. Pope

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

Aging infrastructure is prevalent throughout the world, but water control management structures, specifically dams, are of growing concern. Dams and their corresponding reservoirs have inherent, but separate, lifespans. The proportion of dams around the world that continue operation beyond their intended lifespans is growing at an alarming rate. Society will not only have to navigate the tradeoffs associated with the deterioration of services provided by reservoirs and dams, but also impending structural failures. Society is nearing a critical pinch point where we will have to decide how to deal with dams and reservoirs at scales that range from a single …

Effects Of Ethnicity And Type Of Crime On Juvenile Offenders’ Recidivism Risk, Larry E. Taylor

Walden Dissertations and Doctoral Studies

Juvenile crime in the United States has been a persistent social problem that has reached epidemic proportions. The purpose of this between-subjects, comparative quantitative study was to examine the relationship between recidivism risk and the type of crime, ethnicity, and race of the juvenile. Social learning theory was used to guide the study. Archival data of 59,653 cases were collected from Inter-University Consortium Political and Social Research. Correctional Offender Management Profiling for Alternative Sanctions was used to assess the dependent variable recidivism risk. The independent variables were ethnicity and type of crime of the offender reported in the Transcript of …

Drug Control Officers' Perception Of Nigeria's Narcotics Control Policy, Olufemi Ajayi Jan 2020

Drug Control Officers' Perception Of Nigeria's Narcotics Control Policy, Olufemi Ajayi

Walden Dissertations and Doctoral Studies

The Nigerian government’s cannabis prohibition policy has failed to achieve the suppression of supply and reduction of demand for drugs. The purpose of this qualitative case study was to explore the policy implementation experiences of Nigeria’s drug control officers regarding Nigeria’s drug control policies. The theoretical foundation was social construction theory. Data were collected from reviews of public documents and in-depth interviews with 15 active or retired drug control officers. Data were sorted, organized, and coded through directed content analysis to identify themes. The themes that emerged included defective nature and content of the policy, poor policy implementation, and unfavorable …

Principles Of Home Rule For The Twenty-First Century, Richard Briffault, Nestor M. Davidson, Paul A. Diller, Sarah Fox, Laurie Reynolds, Erin A. Scharff, Richard Schragger, Rick Su

Faculty Scholarship

The National League of Cities’ “Principles of Home Rule for the Twenty-First Century” updates the American Municipal Association’s 1953 “Model Constitutional Provisions for Municipal Home Rule.” The AMA approach was widely adopted, but those provisions are now over 65 years old and intervening social, demographic, economic, and political changes necessitates a new approach to the legal structure of state-local relations. The NLC’s approach is organized around four basic principles, which are cashed-out in a model constitutional home rule provision, with commentary. The first principle states that a state’s law of home rule should provide local governments the full capacity to …
