Gun Owners Support The Right Not To Bear Arms, Ian Ayres, Fredrick E. Vars Jan 2020

Gun Owners Support The Right Not To Bear Arms, Ian Ayres, Fredrick E. Vars

Emory Law Journal

Donna’s Law would allow individuals who fear suicide to prevent their own impulsive gun purchases. Research shows that many people would sign up, and versions of Donna’s Law have passed in Washington State and Virginia. This study is the first to assess public support for enacting Donna’s Law. We find broad support overall, including majority support among Republicans and gun owners. There is room for consensus around this voluntary measure to reduce gun suicide.

Grounded: How The 737 Max Crashes Highlight Issues With Faa Delegation And A Potential Remedy In The Federal Tort Claims Act, Drew H. Nunn

Journal of Air Law and Commerce

The over-delegation by the Federal Aviation Administration (FAA) of new aircraft design certification authority to the very companies seeking such certification has led to a stunning lack of oversight and bending to private economic interests. Congressional action must be taken to ensure that aircraft certification authority, if delegated to private entities, is not delegated to any entities with ties to the companies seeking certification, and FAA oversight must be tightened.

This Comment analyzes whether the Federal Tort Claims Act could provide a potential avenue for plaintiffs to challenge the FAA as it relates to its oversight and delegation to The …

Why Is There So Much Pre-Retirement Liquidity In The U.S. Pension System?, Kathryn L. Moore, John Turner

Law Faculty Books and Chapters

Some analysts argue that there is a retirement savings crisis in the United States. While the extent of the crisis is contested, most analysts agree that retirement savings in this nation is inadequate. Although the reasons for the retirement savings shortfall are many and complex, this paper focuses on one factor that leads to inadequate retirement savings in the United States: pre-retirement liquidity or leakage.

Pre-retirement liquidity or leakage refers to the ability of individuals to withdraw money from their retirement savings account prior to retirement and use that money for nonretirement purposes. The Employee Benefit Research Institute (EBRI) writes, …

A Quantitative Study Of Denver's Breed-Specific Legislation, Sloane M. Hawes, Devrim Ikizler, Katy Loughney, Aurora Temple Barnes Esq., Justin F. Marceau, Philip Tedeschi, Kevin N. Morris

Animal Law Review

In August of 1989, the City and County of Denver, Colorado enacted legislation that prohibits the presence of all ‘pit bull-type dogs’ (PBTDs) within the city limits. In Denver, PBTDs are defined as: American pit bull terrier, American Staffordshire terrier, or Staffordshire bull terrier. In the thirty years the ‘pit bull ban’ has been in place, the City and County of Denver and its animal control agency, Denver Animal Protection, have committed substantial resources to removing PBTDs from the community, including patrolling communities and responding to complaints made by neighbors, conducting thorough breed evaluations of suspected PBTDs, and kenneling PBTDs …

An Examination Into Fusion Centers Impact On Information Sharing Post 9/11, Racquel Nicola Palmer

Walden Dissertations and Doctoral Studies

The aftermath of the 9/11 attacks on the United States resulted in the introduction of the National Fusion Center Network. This effort seeks to empower National Security by effectively sharing information between various law enforcement organizations. Since the establishment of the Network, information that addresses the Networks' standard operating procedures and existing barriers to share information effectively has been lacking. This caused many criticisms as to whether the network is in fact effective in fulfilling its mandate to effectively share information between the various law enforcement agencies. Utilizing Bandura's cognitive theory of behavioral change, this phenomenological study identifies the strategies …

Driverless Finance, Hilary J. Allen Jan 2020

Driverless Finance, Hilary J. Allen

Scholarly Articles in Law Reviews & Journals

While safety concerns are at the forefront of the debate about driverless cars, such concerns seem to be less salient when it comes to the increasingly sophisticated algorithms driving the financial system. This Article argues, however, that a precautionary approach to sophisticated financial algorithms is justified by the potential enormity of the social costs of financial collapse. Using the algorithm-driven fintech business models of robo-investing, marketplace lending, high frequency trading and token offerings as case studies, this Article illustrates how increasingly sophisticated algorithms (particularly those capable of machine learning) can exponentially exacerbate complexity, speed and correlation within the financial system, …

Due to its large OL student population, Penn State’s School of Public Affairs had (unintended) applicable crisis contingency protocols in place prior to the COVID-19 outbreak. With the support of our college’s Center for Teaching Excellence, many traditional F2F residential courses had already been set up on our learning management system (LMS), Canvas. As a result, many of our school’s traditional students and faculty had a handle on using Canvas and remote learning technology. The center enhanced and focused its services to faculty as COVID-19 evolved (Center for Teaching Excellence, 2020). As the COVID-19 crisis hit Penn State during the …

The Effects Of Gun-Free Zones And Mass Shootings, Melissa Gonzalez Rock Jan 2020

The Effects Of Gun-Free Zones And Mass Shootings, Melissa Gonzalez Rock

Walden Dissertations and Doctoral Studies

There has been an increase in the number of mass school shootings even though there are policies in place such as the Gun-Free School Zone Act (GFSZA) to stop such crimes from occurring. Although there is a divide between supporters of these policies and those who want them revamped or removed, all want the same result: to end mass school shootings. The debate between those who wish to leave policies such as the GFSZA in place and those who seek to replace them with new policies that allow guns on campus for various personnel has strong advocates on both sides. …

Internet Of Things Based Wireless Sensor Network And Advanced Machine Learning Models For Precision Agriculture, Ahmed El-Magrous Jan 2020

Internet Of Things Based Wireless Sensor Network And Advanced Machine Learning Models For Precision Agriculture, Ahmed El-Magrous

Electronic Theses and Dissertations

Recent studies assumed that the world population would reach 10.3 billion by 2070. This will require more land for housing; simultaneously resulting in a loss of land for agricultural purposes. However, the new generations also need food, and the lack of new agrarian land is a critical reason that leads researchers and producers to improve daily agriculture practices by using precision agriculture concepts and technologies to increase yield and crop quality. This work represents the design, development, and testing of a customizable and cost-effective Weather-Soil Sensor Station (W-SSS) for use in Precision Agriculture based on high accuracy sensors, wireless communication, …

A "Dignified Life" And The Resurgence Of Social Rights, Thomas M. Antkowiak Jan 2020

A "Dignified Life" And The Resurgence Of Social Rights, Thomas M. Antkowiak

Northwestern Journal of Human Rights

The international human rights movement and its institutions have faced searing criticism that they have abandoned social, economic, and cultural rights (“social rights”). While favorable treaties and constitutions have proliferated over the last decades, grave poverty, inequality, and disease still run rampant across the globe. Many have attributed the latest rise of demagogues and terrorist groups to this widespread social disenfranchisement.

The supranational human rights courts have historically avoided social rights enforcement due to limited subject-matter jurisdiction. Yet more recently the Inter-American Court of Human Rights introduced a conceptual breakthrough to assess social rights, which was affirmed by the U.N. …
