The Constitutionality Of Nationwide Injunctions, Alan M. Trammell Jan 2020

The Constitutionality Of Nationwide Injunctions, Alan M. Trammell

University of Colorado Law Review

Opponents of nationwide injunctions have advanced cogent reasons why courts should be skeptical of this sweeping remedy, but one of the arguments is a red herring: the constitutional objection. This Essay focuses on the narrow question of whether the Article III judicial power prohibits nationwide injunctions. It doesn't.

This Essay confronts and dispels the two most plausible arguments that nationwide injunctions run afoul of Article III. First, it shows that standing jurisprudence does not actually speak to the scope-of-remedy questions that nationwide injunctions present. Second, it demonstrates that the Article III judicial power is not narrowly defined in terms of …

Online Education Implementation Processes And The Preparedness Of Mid-Level Enrollment Management Practitioners To Develop Quality Services For Fully Online Students, Chiquita Lane Jan 2020

Online Education Implementation Processes And The Preparedness Of Mid-Level Enrollment Management Practitioners To Develop Quality Services For Fully Online Students, Chiquita Lane

Electronic Theses and Dissertations, 2020-2023

According to Zawacki-Richter, Backer, and Vogt (2009), literature focusing on student services falls into three general categories: learning theories and attrition research, student needs and satisfaction, and models for best practices. Research addressing the specific training needs of student affairs practitioners responsible for implementing and managing student support services for online students is not a major area of focus (Moore & Kearsley, 2012). Therefore, unlike the faculty and technology subsystems, the student affairs subsystem has not become securely anchored in delivering services to fully online students (Crawley & Howe, 2016; Moore, 2013; Moore & Kearsley, 2012). The lack of research …

Hey, You Got Business In My Engineering! : Collaborating To Support Entrepreneurship Research, Elizabeth Price Jan 2020

Hey, You Got Business In My Engineering! : Collaborating To Support Entrepreneurship Research, Elizabeth Price

Selected Works

This paper presents a case study of a mutually beneficial collaboration between an engineering librarian and a business librarian and provides suggestions for engineering librarians looking to form cross-disciplinary partnerships. While engineering and business students have different information needs, topics such as patents, manufacturing standards, and industry research are relevant to both areas. Collaboration between the librarians serving these programs is important to best support users. Yet at large universities, these librarians might be working on different teams and even in different buildings. Such was the case at one university, where the engineering librarian and the business librarian, and their …

“Don't Frack With Us!” An Analysis Of Two Anti-Pipeline Movements, Rachael Lucille Hood

Honors Papers

This study seeks to compare grassroots organizing efforts against two different fracked gas pipelines. Rooting my analysis in the theory of social movements, I focus on the role of the ideological grounding of the resistance movements, the composition of resistance coalitions formed, and the tactics and strategies employed in opposition to these pipelines. I find that a broad-based coalition with a focus on relationship-building is important to the success of the movement. Additionally, I determine that the presence and involvement of small, medium, and large nonprofits as well as the use of direct action strongly contribute to the success of …

Leadership Strategies For Reducing Regulatory Citations To Maintain Tax-Exempt Statuses In Nonprofit Organizations, Emmanuel Kamara

Walden Dissertations and Doctoral Studies

Abstract

Leaders of nonprofit organizations have challenging responsibilities of satisfying the

demands of all their stakeholders by obeying state and federal regulations.

Noncompliance of regulations can quickly cause a nonprofit organization to lose its tax

exempt status and become nonexistent; thus, it appears that most nonprofits are choosing

to prioritize compliance, while struggling to maintain focus on their mission and services.

Using the conceptual framework of transformational leadership and general system

theories, this case study was to explore strategies leaders of nonprofits organizations in

Pennsylvania that cater to the needs of people with disabilities use for decreasing

regulatory citations to …

Does State And Local Government Employment Promote Tax Revenue Stability? A Look At Kentucky Cities, William Ryan Pennington Jan 2020

Does State And Local Government Employment Promote Tax Revenue Stability? A Look At Kentucky Cities, William Ryan Pennington

MPA/MPP/MPFM Capstone Projects

Research shows that public sector jobs are more stable than private sector jobs. This study examines whether tax revenue volatility is affected by the concentration of a city’s economic base in state and local government employment. The relationship between public employment and revenue volatility has not been studied but is relevant as state and local governments have reduced their workforces in the post-Great Recession period. Using panel data on Kentucky cities, I find that the coefficient on state and local government employment concentration is inversely related to tax volatility but is not statistically significant in a fixed effects estimation.

Awareness, Empathy, And Intention: Creating Constructive + Responsive Structures Of Diversity, Equity, And Inclusion, Safa Arshadullah Jan 2020

Awareness, Empathy, And Intention: Creating Constructive + Responsive Structures Of Diversity, Equity, And Inclusion, Safa Arshadullah

Scripps Senior Theses

Diversity, equity, and inclusion (DE&I) are three concepts widely understood as integral to positive organizational development. In a capitalist world, these notions are purposefully ignored or superficially discussed for financial and social gain. Prioritizing empathy, compassion, equity, and inclusion as worthwhile endeavours resist those tokenizing and disingenuous systems. This thesis explores the current perfunctory treatment of DE&I in organizations and examines how to incorporate intentional and human-centered values into organizational culture through intersectional thinking, applied empathy, and organizational storytelling. Recognizing lived experiences and personal narratives as equally valuable to quantitative data, this study entrusts both the individual and the organization …

Broader-Based And Sectoral Bargaining Proposals In Collective Bargaining Law Reform: A Historical Review, Sara Slinn

All Papers

Labour legislation regulating Canada’s private sector has incorporated forms of broader-based or sectoral certification and bargaining (BBB) in varying degrees for decades, particularly in British Columbia and Quebec. However, BBB had not been the subject of significant post-war labour law reform discussion until the 1990s. This decade saw a wave of interest in introducing BBB arise across several jurisdictions. Originating in Ontario in the late 1980s, it spread to British Columbia as a key part of labour law reform discussions in the early and late 1990s and became a minor issue in the federal labour law reform review process later …
