The Lost Lessons Of Shareholder Derivative Suits, Jessica Erickson Jul 2020

The Lost Lessons Of Shareholder Derivative Suits, Jessica Erickson

Washington and Lee Law Review

Merger litigation has changed dramatically. Today, nearly every announcement of a significant merger sparks litigation, and these cases look quite different from merger cases in the past. These cases are now filed primarily outside of Delaware, they typically settle without shareholders receiving any financial consideration, and corporate boards now have far more ex ante power to shape these cases. Although these changes are often heralded as unprecedented, they are not. Over the past several decades, derivative suits experienced many of the same changes. This Article explores the similarities between the recent changes in merger litigation and the longer history of …

What Makes A Culturally Responsive And Competent Teacher: Perspectives Of Millennials & Gen Z’S, Charlene Beckford

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The purpose of this study was to outline the characteristics of culturally responsive and competent teachers as perceived by millennials and Gen z’s. The literature asserts that effective culturally competent practices will improve student- teacher relationships in a cross-cultural setting which should have a direct effect on the decrease in office discipline referrals, increase academic gains and subsequent post- secondary success. Culturally relevant teaching practices can also positively affect student engagement (Howard, 2001). Therefore, there is an increased demand for culturally competent teachers (Marks, 2011). Some characteristics of culturally competent teachers and culturally relevant teaching practices found in the literature …

Does Marriage, Employment And Having Children Matter? A Secondary Analysis On Physical Activity Levels, Leisure Time Physical Activity, And Social Roles Among Women In The United States, Tramaine Paul Mcmullen

Theses and Dissertations

Background: Social roles, such as being married, employed, or having children, have been shown to have independent negative relationships with moderate to vigorous physical activity (MVPA) levels among women. Increasing the number of women with children that meets physical activity guidelines is critical to reduce chronic disease and early mortality in this population. However, few studies have examined the relationship between holding multiple social roles, MVPA, and leisure-time physical activity (LTPA) among women with children. The study had two aims: 1) to determine the relationship between objectively measured MVPA by social roles and 2) to examine the frequency of specific …

Experiences Of Graduate Level Students Of Color With Race In Psychology Diversity Courses, Lakesha Winley

Dissertations

The ethnoracial makeup of individuals entering fields of study such as psychology continues to change but the experiences of graduate level students of color in these programs is a phenomenon that has received little attention. When attempting to understand these experiences specific to racial content, the literature is almost nonexistent. This qualitative inquiry was designed in an attempt to understand, assess, and depict the experiences of students of color related to experiences of racial content in their American Psychological Association (APA) accredited graduate level diversity/multicultural psychology courses. The focus was on their reactions (e.g., emotional, physical, somatic) to class discourse, …

Beyond Borders: Pla Command And Control Of Overseas Operations, Dr. Phillip C. Saunders

Strategic Forums

China’s latest round of military reforms is driven primarily by Xi Jinping’s ambition to reshape the People’s Liberation Army (PLA) to improve its ability to win informationized [xinxihua, 信息化] wars and to ensure that it remains loyal to the Chinese Communist Party (CCP). The reforms are unprecedented in their ambition and in the scale and scope of the organizational changes. Virtually every part of the PLA now reports to different leaders, has had its mission and responsibilities changed, has lost or gained subordinate units, or has undergone a major internal reorganization. The relationships between and among the Central Military Commission …

Metacritiques Of Upper Echelons Theory: Verdicts And Recommendations For Future Research, Brett H. Neely Jr., Jeffrey B. Lovelace, Amanda P. Cowen, Nathan J. Hiller

Department of Management: Faculty Publications

After more than 35 years, Hambrick and Mason’s upper echelons theory (UET) stands as one of the most influential perspectives in management research. However, as the literature and its attendant reviews have become more numerous and specialized, discussion of the fundamental conceptual and methodological critiques leveled against research utilizing the UET perspective has grown fragmented. As such, the first aim of the present review is to identify and synthesize a set of common critiques levied against UET research. In doing so, we unpack important nuance within each critique while establishing a common vocabulary to facilitate greater consistency in how these …

An Engine Of Change? The Affordable Care Act And The Shifting Politics Of Demonstration Projects, Philip Rocco, Andrew S. Kelly Jul 2020

An Engine Of Change? The Affordable Care Act And The Shifting Politics Of Demonstration Projects, Philip Rocco, Andrew S. Kelly

History Faculty Research and Publications

The Patient Protection and Affordable Care Act (ACA) made a number of institutional investments intended to expand the federal government’s ability to scale successful demonstration projects into national policy. This article considers how the ACA has reshaped the politics of programmatic innovation in Medicare and Medicaid. A qualitative synthesis of demonstration results suggests that, although the ACA has removed several important veto points to the expansion of successful demonstration projects, numerous barriers to the scaling of reforms remain. These barriers include procedures and techniques that make it difficult to certify the “success” of demonstrations yet make their limitations highly legible. …

The necessity to implement evidence-based programs to support the healthy development of youth and families is becoming part of national policy. Organizations that are not “ready” to do so will likely lose resources, disallowing them to serve as they have set out to do. Consequently, the current survey study draws from a national sample of Cooperative Extension personnel in 2009 to examine characteristics within their organizational context that facilitate successful change related to youth/family programming. Data were collected from 946 4-H/youth development or Family and Consumer Sciences employees at all levels. Self-reported indices of each state organization’s openness to change, …
