No Means No And More Elementary Grammar: Moving Towards A More Codified Approach To Sexual Harassment Law, Maxwell Collins, Holly Castleton Apr 2019

No Means No And More Elementary Grammar: Moving Towards A More Codified Approach To Sexual Harassment Law, Maxwell Collins, Holly Castleton

Brigham Young University Prelaw Review

Because of social developments like the #MeToo movement, problems with gender issues in the law have moved to the forefront of legal discussions. This article uses state and federal codes, statutes, and case precedent to examine contemporary sexual harassment law. We identify issues surrounding investigating and prosecuting credible sexual harassment allegations. We examine the issues surrounding the sentencing of those convicted of sexual harassment. Finally, we argue that the decision to enact mandatory minimum sentences as a deterrent for future sex crimes is misguided and counterproductive, and we propose a more codified and nuanced approach to sentencing. This will provide more …

Implementation Of An Evidenced-Based Intervention For Pain Management In Lumbar Spine Surgery, Mary R. Draper Apr 2019

Implementation Of An Evidenced-Based Intervention For Pain Management In Lumbar Spine Surgery, Mary R. Draper

Doctoral Projects

Introduction: Spinal surgeries are among the top procedures responsible for the highest degree of post-surgical pain. Opioids are the mainstay of current pain management practices in the post-operative period. In light of the opioid epidemic, increased opioid tolerance, and changes in legislation, there is a calling for alternative strategies in managing acute and chronic pain. The purpose of this project is to answer the following question: Does implementation of an evidence-based intervention for preoperative administration of gabapentin reduce patients’ perception of pain and reduce opioid consumption in those who experience lumbar spine surgery?

Objectives: The goal of this project is …

Deputizing Family: Loved Ones As A Regulatory Tool In The "Drug War" And Beyond, Matthew J.B. Lawrence Apr 2019

Deputizing Family: Loved Ones As A Regulatory Tool In The "Drug War" And Beyond, Matthew J.B. Lawrence

Faculty Scholarly Works

Many laws use family members as a regulatory tool to influence the decisions or behavior of their loved ones, i.e., they deputize family. Involuntary treatment laws for substance use disorder are a clear example; such laws empower family members to use information shared by their loved ones to petition to force their loved ones into treatment without consent. Whether such deputization is helpful or harmful for a patient’s health is a crucial and dubious question discussed in existing literature, but use of family members as a regulatory tool implicates important considerations beyond direct medical impacts that have not been as …

State Of Domestic Violence Content In Msw Curriculum In The U.S. Perspectives On Social Work, Abha Rai, Yoon Joon Choi, Lalit Khandare Apr 2019

State Of Domestic Violence Content In Msw Curriculum In The U.S. Perspectives On Social Work, Abha Rai, Yoon Joon Choi, Lalit Khandare

Social Work: School of Social Work Faculty Publications and Other Works

Domestic violence remains a serious concern in the U.S. and stopping family violence is one of the 12 grand challenges for social work. Further, the core values of our profession are deeply rooted in social justice, dignity and worth of the person and importance of human relationships. This makes the preparedness of social work students to address domestic violence crucial. Social work students need to be provided with support to work with survivors, perpetrators and their families, while engaging in prevention of domestic violence. The present study explores the extent to which domestic violence content is covered within MSW curriculum …

Beyond The Employment Dichotomy: An Examination Of Recidivism And Days Remaining In The Community By Post-Release Employment Status, Amanda Marie Bunting, Michele Staton, Erin Winston, Kevin Pangburn Apr 2019

Beyond The Employment Dichotomy: An Examination Of Recidivism And Days Remaining In The Community By Post-Release Employment Status, Amanda Marie Bunting, Michele Staton, Erin Winston, Kevin Pangburn

Behavioral Science Faculty Publications

Criminological research has tended to consider employment in a dichotomy of employed versus unemployed. The current research examines a sample of individuals 1-year post-release to assess the extent to which four distinct employment categories (full-time, part-time, disabled, and unemployed) are associated with reincarceration and days remaining in the community. Findings indicate disabled individuals remain in the community longer and at a higher proportion compared with other employment categories. Furthermore, unique protective and risk factors are found to be associated with each employment category while some risk factors (e.g., homelessness) highlight the importance of addressing reentry barriers regardless as to employment …

Density And Mass Effect On The Development Of Phormia Regina, Brandon H. Strauss Apr 2019

Density And Mass Effect On The Development Of Phormia Regina, Brandon H. Strauss

School of Natural Resources: Dissertations, Theses, and Student Research

Forensic entomology is the application of the study of arthropods to the criminal justice system. This is primarily done through the development of a post mortem interval (PMI) based the insect evidence present. A practitioner must be able to determine the age of the insect through temperature data. One factor influencing the temperature dependent development is gregarious behavior. Current literature describes a faster development rate due to an increase in feeding efficiency and temperatures produced by this aggregate. However, there is very little literature defining a minimum number needed to induce this effect and little to none on it for …

Crafted From Whole Cloth: Reverse Stash-House Stings And The Sentencing Factor Manipulation Claim, Molly F. Spakowski Apr 2019

Crafted From Whole Cloth: Reverse Stash-House Stings And The Sentencing Factor Manipulation Claim, Molly F. Spakowski

Buffalo Law Review

Kenneth Flowers is currently serving a mandatory minimum sentence of 120 months imprisonment stemming from a conviction of conspiracy to possess with intent to distribute five or more kilograms of cocaine. While the ten-year prison sentence is very real, the five-kilograms of cocaine is not, and never was. Mr. Flowers was caught-up in one of the elaborate and overused “reverse stash-house sting” operations employed by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”).

Mr. Flowers’ story is one of many similar cases resulting from the government operation conducted by the ATF known as a reverse stash-house sting operation. The …

Are Women Benching Themselves From The South Dakota Judiciary?, Marcus Ireland Apr 2019

Are Women Benching Themselves From The South Dakota Judiciary?, Marcus Ireland

Honors Thesis

The judicial branch is the only branch of government which has formal education requirements in South Dakota. Neither South Dakota’s executive branch nor legislative branch require any form of advanced education; however, the judiciary does require its judges have a law degree. As more women graduate law school, more women become competitive candidates for judicial positions. However, there exists a “gavel gap”, or an underrepresentation of females as judges in South Dakota. Women make up 49 percent of South Dakota’s state population and 34 percent of South Dakota’s attorney population; however, women only make up 19 percent of South Dakota’s …

Drug Testing In Juvenile Diversion Programs, Chelsea W. Harris M.A., Lindsey Wylie, Juvenile Justice Institute, University Of Nebraska At Omaha Apr 2019

Drug Testing In Juvenile Diversion Programs, Chelsea W. Harris M.A., Lindsey Wylie, Juvenile Justice Institute, University Of Nebraska At Omaha

Reports

Evidence-Based Practices Brief #3.

According to the Risk-Needs-Responsivity (RNR) framework1,2, juvenile diversion programs that individualize diversion plans will be more effective at reducing recidivism because the juvenile’s risk level and needs are being targeted.3 To follow RNR, programs should assess youth with a validated assessment tool and then match youth to services based on the risks and needs presented by the assessment tool.

In And Out Of Place: Civilization Interaction And The Making Of Australia In Oceania And Asia, Jeremy C. A. Smith Apr 2019

In And Out Of Place: Civilization Interaction And The Making Of Australia In Oceania And Asia, Jeremy C. A. Smith

Comparative Civilizations Review

The making of Euro-Australia occurred against the backdrop of two dimensions of its historical constitution. First, it occurred on the back of Britain’s entry into the Oceanian world and its intercivilizational encounters with Pacific cultures. The second dimension was the appropriation of the land of a complex and internally diverse Aboriginal civilization and suppression of its social world view. This was vital to a lasting sense of ambivalence in Australian identity and in the relations of the Commonwealth of Australia with island states in the Pacific. After Federation (1901), Australia became more independent in the context of devolution of the …

Multiple Identities: Touchstones In Terrorism, Democratic Institutions, And The Rule Of Law, Mary Frances Lebamoff Apr 2019

Multiple Identities: Touchstones In Terrorism, Democratic Institutions, And The Rule Of Law, Mary Frances Lebamoff

Comparative Civilizations Review

This paper explores the underlying, foundational politico-social theories and themes that relate closely to radicalization, terrorism, democracy and the rule of law. It examines factors (touchstones) critical to these areas (political violence, terrorism, rule of law and democracy, along with democratic institutions). Some of these touchstones include the ‘lenses’ of identities, tribalism, and contrasts between identities, including cultural, linguistic, socialization and civilizational aspects.

The Policing Of Prosecutors: More Lessons From Administrative Law?, Aaron L. Nielson Apr 2019

The Policing Of Prosecutors: More Lessons From Administrative Law?, Aaron L. Nielson

Dickinson Law Review (2017-Present)

On a daily basis, prosecutors decide whether and how to charge individuals for alleged criminal conduct. Although many prosecutors avoid abusing this authority, prosecutors’ discretionary decisions might result in biased enforcement, inappropriate leveraging of authority, and a lack of transparency. These problems also arise when agency enforcement officials decide whether to act on conduct that violates a legal prohibition.

An inherent tension between the desire to avoid overburdening the system and the need to prevent inconsistent decision-making exists in the exercises of both prosecutorial discretion and regulatory enforcement discretion. It is clear from the similarities between the two that administrative …

Prosecutorial Misconduct: Mass Gang Indictments And Inflammatory Statements, K. Babe Howell Apr 2019

Prosecutorial Misconduct: Mass Gang Indictments And Inflammatory Statements, K. Babe Howell

Dickinson Law Review (2017-Present)

This Article examines inflammatory statements by prosecutors in the context of mass gang indictments. I contend that inflammatory remarks not only harm the justice system and defendants, particularly minorities, but also that, when prosecutors craft and repeat hyperbolic narratives about vicious gang wars, prosecutors may come to believe the narratives and become effectively blinded to the fact that these narratives are improper, unfair, and untrue. First, I review the professional rules, standards, and case law that prohibit. Then, drawing on press releases and trial transcripts from two mass gang indictments in New York City, I demonstrate how prosecution statements exaggerate …

Prosecutorial Discretion: The Difficulty And Necessity Of Public Inquiry, Bruce A. Green Apr 2019

Prosecutorial Discretion: The Difficulty And Necessity Of Public Inquiry, Bruce A. Green

Dickinson Law Review (2017-Present)

Prosecutors’ discretionary decisions have enormous impact on individuals and communities. Often, prosecutors exercise their vast power and discretion in questionable ways. This Article argues that, to encourage prosecutors to use their power wisely and not abusively, there is a need for more informed public discussion of prosecutorial discretion, particularly with regard to prosecutors’ discretionary decisions about whether to bring criminal charges and which charges to bring. But the Article also highlights two reasons why informed public discussion is difficult—first, because public and professional expectations about how prosecutors should use their power are vague; and, second, because, particularly in individual cases, …

Decarcerating America: The Opportunistic Overlap Between Theory And (Mainly State) Sentencing Practice As A Pathway To Meaningful Reform, Mirko Bagaric, Daniel Mccord Apr 2019

Decarcerating America: The Opportunistic Overlap Between Theory And (Mainly State) Sentencing Practice As A Pathway To Meaningful Reform, Mirko Bagaric, Daniel Mccord

Buffalo Law Review

Criminals engender no community sympathy and have no political capital. This is part of the reason that the United States has the highest prison population on earth, and by a considerable margin. Incarceration levels grew four-fold over the past forty years. Despite this, America is now experiencing an unprecedented phenomenon whereby many states are now simultaneously implementing measures to reduce prison numbers. The unusual aspect of this is that the response is neither coordinated nor consistent in its approach, but the movement is unmistakable. This ground up approach to reducing prison numbers suffers from the misgiving that it is an …

The Implications Of Inequality For Fiscal Federalism (Or Why The Federal Government Should Pay For Local Public Schools), Brian Highsmith Apr 2019

The Implications Of Inequality For Fiscal Federalism (Or Why The Federal Government Should Pay For Local Public Schools), Brian Highsmith

Buffalo Law Review

In designing public policy, a question of first principle is the degree to which government services—and the mechanisms of collecting revenue to finance those services—should be centralized within and across political systems. To inform their assessments of where redistribution should properly occur, public finance researchers have, to date, worked backwards from different assumptions about the mobility of residents within the political community. Scholars have disagreed about the viability of local governments’ efforts to redistribute wealth—with traditionalists arguing that these efforts are made impossible by residential mobility, and recent reformists countering that limitations on mobility indeed allow for limited redistribution at …

International Inequality Or American Atrocity?: A Comparative Investigation Of Indigent Legal Representation In The United States And The European Union, Sydney Wilson Apr 2019

International Inequality Or American Atrocity?: A Comparative Investigation Of Indigent Legal Representation In The United States And The European Union, Sydney Wilson

Honors Thesis

Criminal justice systems across the globe are faced with multifaceted monetary limitations. The European Union and United States have similar overarching provisions ensuring that indigent defendants are guaranteed the right to counsel in legal proceedings with the possibility of infringing on their liberties. On the whole, they leave the decisions pertaining to each jurisdictions’ system up to the individual governments. This practice allows for differing systems, quality, and problems. The differences between the individual countries in the EU and in the states in America are not as vast as initially believed; therefore, the problems pertaining to indigent representation affect more …
