Changing The Age-Old Stigmatization Of Mental Health, Ashley E. Fontana
Changing The Age-Old Stigmatization Of Mental Health, Ashley E. Fontana
Senior Honors Projects
For years, the importance of mental health has been overlooked. In the past, individuals possessing unstable mental health were not only neglected, but were highly stigmatized. In the 20th century, these individuals were thought to have demonic roots—they were feared. The mentally ill have been institutionalized, deinstitutionalized, and institutionalized yet again. Some progress has been made in changing society’s perceptions and fierce stigmatization of mental health. There are many organizations in place today aimed at increasing awareness and reducing stigmatization, and they have helped, but not nearly enough. Mental health stigmatization has detrimental effects on those that fall victim to …

The Impact Of Prosecutorial Misconduct, Overreach, And Misuse Of Discretion On Gender Violence Victims, Leigh Goodmark
The Impact Of Prosecutorial Misconduct, Overreach, And Misuse Of Discretion On Gender Violence Victims, Leigh Goodmark
Dickinson Law Review (2017-Present)
Prosecutors are failing victims of gender violence as witnesses and when they become defendants in cases related to their own victimization. But it is questionable whether that behavior should be labeled misconduct. The vast majority of these behaviors range from misuses of discretion to things that some might consider best practices in handling gender violence cases. Nonetheless, prosecutors not only fail to use their discretion appropriately in gender violence cases, but they take affirmative action that does tremendous harm in the name of saving victims and protecting the public. The destructive interactions prosecutors have with victims of gender violence are …
Human Trafficking In Ghana: A Comparative Analysis, Erica Miller
Human Trafficking In Ghana: A Comparative Analysis, Erica Miller
Honors Thesis
In a comparative analysis of case study, this thesis focuses on the literature behind human trafficking in Ghana and three other comparative countries –Brazil, Indonesia, Cote d’Ivoire. These comparative countries were selected based on specific criteria such as the country’s GDP, the literacy rates of each country, the country’s level of development, and the total population below the poverty line within the country. Case study analysis is the primary focus of this thesis. In order to understand case study, a detailed examination of case studies and misconceptions surrounding case studies was used to understand the literature behind this comparison analysis. …
Health And Criminal Justice System Involvement Among African American Siblings, Amber L. Beckley, Rohan H. Palmer, Michael Rocque, Keith E. Whitfield
Health And Criminal Justice System Involvement Among African American Siblings, Amber L. Beckley, Rohan H. Palmer, Michael Rocque, Keith E. Whitfield
All Faculty Scholarship
Importance: Health disparities between African Americans and Whites have persisted in the United States. Researchers have recently hypothesized that the relatively poor health of African Americans may be caused, in part, by African American overrepresentation in the criminal justice system. Objectives: To test the hypothesis that criminal justice system involvement is associated with poor health and greater health risk when controlling for unobserved family factors through a discordant sibling design. Methods: Subjects were drawn from the Carolina African American Twin Study of Aging (CAATSA). Criminal conviction records were extracted from North Carolina's Department of Public Safety. Six measures of health …

How To Decrease The Immigration Backlog: Expand Representation And End Unnecessary Detention, Kara A. Naseef
How To Decrease The Immigration Backlog: Expand Representation And End Unnecessary Detention, Kara A. Naseef
University of Michigan Journal of Law Reform
This Note recommends federal policy reform and local implementation in order to decrease the immigration backlog and protect the rights of non-citizens in immigration proceedings. Although non-citizens hold many of the fundamental rights and freedoms enumerated in the Constitution, several core rights— including due process and the right to counsel—are not rigorously upheld in the context of immigration proceeding. By carefully regulating expanded access to representation and ending unnecessary immigration detention, the Executive Office of Immigration Review and Congress will ensure the swift administration of justice and protect non-citizens under the federal government’s jurisdiction.
Tort Justice Reform, Paul David Stern
Tort Justice Reform, Paul David Stern
University of Michigan Journal of Law Reform
This Article calls for a comprehensive reform of public tort law with respect to law enforcement conduct. It articulates an effective and equitable remedial regime that reconciles the aspirational goals of public tort law with the practical realities of devising payment and disciplinary procedures that are responsive to tort settlements and judgments. This proposed statutory scheme seeks to deter law enforcement misconduct without disincentivizing prudent officers from performing their duties or overburdening them with extensive litigation. Rather than lamenting the dissolution of Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics or the insurmountability of qualified immunity, reform …
Down To The Last Strike: The Effect Of The Jury Lottery On Criminal Convictions, Scott Kostyshak, Neel U. Sukhatme
Down To The Last Strike: The Effect Of The Jury Lottery On Criminal Convictions, Scott Kostyshak, Neel U. Sukhatme
Georgetown Law Faculty Publications and Other Works
How much does luck matter to a criminal defendant in a jury trial? We use rich data on jury selection to causally estimate how parties who are randomly assigned a less favorable jury (as proxied by whether their attorneys exhaust their peremptory strikes) fare at trial. Our novel identification strategy uniquely captures variation in juror predisposition using data unobserved by the econometrician but observed by attorneys. Criminal defendants who lose the “jury lottery” are more likely to be convicted than similarly-situated counterparts, with a significant increase (18-20 percentage points) for Black defendants. Our results are robust to alternate specifications and …

A Blade of Grass
Issue 2: Who?
"This issue looks at the power of relationships formed when artists become allies to and co-authors with people whose expertise comes from another source than art.
A Blade of Grass provides resources to artists who demonstrate artistic excellence and serve as innovative conduits for social change. They evaluate the quality of work in this evolving field by fostering an inclusive, practical discourse about the aesthetics, function, ethics and meaning of socially engaged art that resonates within and outside the contemporary art dialogue."

Regional Research Institute for Human Services
The Count provides important information on the people who were counted living unsheltered, in emergency shelter, and in transitional housing (collectively the “HUD homeless” or “literally homeless” population) the night of Jan. 23, 2019. As always, the date of the Count and the definition of homelessness that determines who is counted were set by the U.S. Department of Housing and Urban Development (HUD).
The Regional Research Institute of Human Services at Portland State University (PSU) led the unsheltered portion of the Count, which is referred to as the unsheltered count. At our request, PSU staff also conducted a separate count …

Perspectives On Community Policing Of Durban Juveniles Living On The Streets, Dena Cheng
Perspectives On Community Policing Of Durban Juveniles Living On The Streets, Dena Cheng
Independent Study Project (ISP) Collection
The aim of this project is to critically analyze the structure and performance of the South African Police Service (SAPS) at the nexus of juvenile criminal justice and homelessness. Facing issues of social discord, legitimacy, and patterns of corruption following the era of apartheid, SAPS plays a critical role in both preventing as well as eliminating crime. Therefore, this project focuses on a particularly marginalized community, under-aged street children, since the treatment of youth crime and/or criminality in Durban serves as a microcosm of a larger system of practices implemented by SAPS. Through in-depth interviews with local social workers, a …
Criminalizing The Other: Exploring The Impact Of The Netherlands' Adaptation Of Prosecutorial Guidelines On Sentencing Disparities, Alia Nahra
Independent Study Project (ISP) Collection
This research explores the impact of the 2015 institution of prosecution guidelines in the Netherlands. Prior to this switch, the Openbaar Ministerie operated using a punishment point system, which provided a mathematical formula with which to decide sanctions. Though the motivation of this change was to make the overall system more efficient and enable individual prosecutors to consider each case in a customizable and more equitable form, this research demonstrates that the change has served instead as a perpetuator (and in some cases, facilitator) of the persistent ethnic and gender biases already at work in the Netherlands. The social and …

Supplying Slaves: The Disguise Of Greener Pastures: An Exploratory Study Of Human Trafficking In Uganda, Kyla Johnson
Independent Study Project (ISP) Collection
The purpose of this study was to evaluate labor migration in Uganda with a specific focus on the role labor recruitment agencies play in transporting people and how certain circumstances such as lack of knowledge of safe migration can leave people vulnerable to human trafficking. Labor externalization is beneficial specifically for developing countries because it provides jobs for the robust and available labor in these countries. Nonetheless, when reports appear that young girls are stranded abroad in the middle east after being taken there for work, labor recruitment agencies are first to receive the blame. Although Uganda issued a ban …

Acculturation: Friend Or Foe Of The Career Aspirations And Educational Aspirations And Expectations Of Hispanic Youth?, Kyhara Nathalia Aguilera
Acculturation: Friend Or Foe Of The Career Aspirations And Educational Aspirations And Expectations Of Hispanic Youth?, Kyhara Nathalia Aguilera
Sociology & Criminal Justice Theses & Dissertations
The modern American Dream says that anyone can be successful if they obtain higher education. Unfortunately, this system does not always meet the needs of our increasingly diverse society. Hispanic immigrant students face a hardship in pursuit of their education and career aspirations because many of them experience acculturation related stresses. This study seeks to investigate the role that acculturation plays in the career aspirations and educational aspirations and expectations of Hispanic students. I go beyond the current literature by exploring how acculturation is a significant factor in determining educational and career aspirations. Specifically, I examine whether different levels of …

Teachers' Perspectives On Their Role In Fostering Supportive Relationships With Their Students, Jamee S. Carroll
Teachers' Perspectives On Their Role In Fostering Supportive Relationships With Their Students, Jamee S. Carroll
Dissertations (1934 -)
Adolescence is a critical developmental period when the risk for developing several mental health disorders and problem behaviors increases. Promoting resilience, which describes healthy functioning in the presence of adversity, can be beneficial to this population (Masten, 2014). Supportive relationships with caring, competent adults contribute to the promotion of resilience in adolescents. Research demonstrates that teachers can serve in this role (Yeung & Leadbeater, 2010). While there is evidence in the literature regarding the benefits of supportive teacher-student relationships for positive youth outcomes and school climate, there is little empirical research on the factors that serve to cultivate these relationships. …
Guilty Pleas Of Youths And Adults: Differences In Legal Knowledge And Decision Making, Tina Zottoli, Tarika Daftary Kapur
Guilty Pleas Of Youths And Adults: Differences In Legal Knowledge And Decision Making, Tina Zottoli, Tarika Daftary Kapur
Department of Psychology Faculty Scholarship and Creative Works
Few studies have examined differences in the guilty plea decisions of youth and adults. In interviews with 64 youth (X = 15.9, SD = 1.2) and 56 adults (X = 38.5, SD = 11.5) who pleaded guilty to felonies in New York City, we found important differences between the youths and adults in their understanding of the plea process, the factors they considered when making decisions, and their rationales for their decisions. Youth were less likely to recognize that a guilty plea resulted in a criminal record and to understand the trial process, and they reported having considered fewer potential …
Disparities In Sentencing: The Impact Of Race, Gender And Mental Health, Briana Paige
Disparities In Sentencing: The Impact Of Race, Gender And Mental Health, Briana Paige
Sociology & Criminal Justice Theses & Dissertations
The purpose of this study is to examine the effect that race and mental health play on sentence length in the United States. Mentally ill people are gradually being confined in prisons across the United States and there is an absence of literature that looks at the interaction of race and mental health in regards to sentencing. The focal concerns perspective provides the theoretical framework that guides this study. Multiple linear regressions were used to examine both state and federal prison inmates to examine the effect race, mental health and other extra-legal factors play on sentence length. Results show that …
