Crime And Punishment In Gold Country : A Historical Case-Study, Shih-Chun Steven Chien, Lawrence M. Friedman

Law Faculty Articles and Essays

Rural life, small town life, is not and has never been idyllic. It has always had its share of pathology, sometimes deep pathology. Small town life is not necessarily traditional life, close-knit family life, neighborly life. That kind of life certainly exists; but America was never a traditional society in that sense. Its small towns were full of strangers. The population of El Dorado County, small as it was, had been growing rapidly. Like America in general, El Dorado County had its share of anomie; rootless men (and women), without strong relationships: ships without anchors, driftwood on the sea of …

Investigating Student Service Member And Veteran Support In Higher Education, Andrew Robert Mcdonough Apr 2019

Investigating Student Service Member And Veteran Support In Higher Education, Andrew Robert Mcdonough

Masters Theses

Since the passing of the Post-9/11 Veterans Educational Assistance Act, more than 817,000 service members have participated in higher education. In this time, little research has been done to study student veterans as a unique college population; and to gauge whether the current best practices to support these students are impactful and effective. The purpose of this study is to further the scholarship on student veterans by investigating the transition into higher education and the factors that influence their engagement with academia. Both survey and interview data were collected to inform this research. 45 survey responses and 4 interview conversations …

Unpacking The Cultural Relevance Of The High School Experiences Of African-American Males, Damiso A. Josey

All Theses And Dissertations

Despite the vast research on cultural competence and student engagement, little is known about the perspectives of the Black male students who have graduated from any New Jersey public schools This qualitative, phenomenological, multi-case study examines the experiences of Black male students who have been educated predominantly by White educators. The gap in the literature highlights the need for researchers and educators to examine teacher cultural competence from the students’ perspective as it impacted student engagement in the educational process. Student disengagement is a factor in school dropout and a racial/cultural gap exists between Black male students and educators not …

Influencing Developmental Pathways: A Church-Based Prevention Program Of Youth Gang Involvement In Large U.S. Cities, Abigail Lokkesmoe Apr 2019

Influencing Developmental Pathways: A Church-Based Prevention Program Of Youth Gang Involvement In Large U.S. Cities, Abigail Lokkesmoe

Senior Honors Theses

Youth gang involvement and resulting engagement in delinquent acts is a widespread societal problem in large cities across America, which affects the lives and well-being of hundreds of people every day. There are two main approaches to understanding the factors or causes behind this involvement. The risk-protective model holds that behavior is the result of the sum total of influences that risk factors have on increasing the likelihood of the behavior and protective factors have on decreasing the likelihood of the behavior. A number of risk factors exist for youth gang involvement, with the principal domains being individual, family, community, …

Pretrial Publicity And Juror Decisionmaking: Effects Of Inadmissible Evidence And Coverage Of Its Exclusion From Trial, Rebecca Rhein Apr 2019

Pretrial Publicity And Juror Decisionmaking: Effects Of Inadmissible Evidence And Coverage Of Its Exclusion From Trial, Rebecca Rhein

Honors Theses

The courts have long been concerned that exposure to media coverage regarding a case making its way through the judicial process (i.e., pretrial publicity [PTP]) may influence jurors’ decisionmaking in court. Indeed, empirical research over the past two decades has shown that PTP can influence juror decisions. PTP often contains descriptions of evidence or factors that are ultimately deemed inadmissible at trial (e.g., confession evidence), but no research to date has examined what occurs when confessions are reported to the public but later deemed inadmissible. We examined these issues using a 2 (Interrogation Quality: High vs. Low) x3 (Exclusion: Technicality …

Opioid Policing, Barbara Fedders Apr 2019

Opioid Policing, Barbara Fedders

Indiana Law Journal

This Article identifies and explores a new, local law enforcement approach to alleged drug offenders. Initially limited to a few police departments, but now expanding rapidly across the country, this innovation takes one of two primary forms. The first is a diversion program through which officers refer alleged offenders to community-based social services rather than initiate criminal proceedings. The second form offers legal amnesty as well as priority access to drug detoxification programs to users who voluntarily relinquish illicit drugs. Because the upsurge in addiction to —and death from—opioids has spurred this innovation, I refer to it as “opioid policing.” …

Auditing Predictive Policing, Jeremiah Scanlan Apr 2019

Auditing Predictive Policing, Jeremiah Scanlan

Brigham Young University Prelaw Review

Predictive policing technology has been adopted by police departments in major cities throughout the US, and while its use continues to spread, the legal implications of its use have not been thoroughly examined. Predictive policing algorithms may be biased against minorities and other vulnerable groups, which may lead police departments to pursue policing strategies that harm these groups. This article proposes that legislatures should fill the current gap in legal oversight by requiring external audits of predictive policing algorithms as used by police departments. These audits would examine the algorithms for bias using up-to-date technological tools and release the results …

The War On Drugs And The Case For Rehabilitation, Christopher Johnson, Jackson Hoopes Apr 2019

The War On Drugs And The Case For Rehabilitation, Christopher Johnson, Jackson Hoopes

Brigham Young University Prelaw Review

From slavery to Jim Crow to current issues with mass incarceration, America has a long-standing history with oppression and racial prejudice. While it’s easy for many to think racism, particularly at an institutional level, to be a thing of the past, a variety of evidences speak to the contrary. With President Nixon’s War on Drugs, criminality became federally sanctioned way to oppress minorities through sentencing discrepancies in crack and powdered cocaine. In conjunction with that, the privatization of prisons has led to the Prison Industrial Complex, further incentivizing incarceration as a means of industry and commerce. Now we are faced …

Respect The Hustle: Necessity Entrepreneurship, Returning Citizens, And Social Enterprise Strategies, Priya Baskaran Apr 2019

Respect The Hustle: Necessity Entrepreneurship, Returning Citizens, And Social Enterprise Strategies, Priya Baskaran

Maryland Law Review

This Article will address a pervasive and growing problem for returning citizens—high rates of economic insecurity—and, as a novel solution, propose the creation of Economic Justice Incubators (“EJIs”) as a new, municipally-led social enterprise strategy. Mass incarceration is a national problem and requires comprehensive criminal justice reform. In contrast, the reentry process is locally focused due to a complex web of collateral consequences arising from state and local laws. An estimated 641,000 people return home from prison each year, many to economically distressed communities. Once released, the terms of their parole and the collateral consequences associated with their conviction restrict …

Media Killed The Serial Killer Star, Brooke Ingala Apr 2019

Media Killed The Serial Killer Star, Brooke Ingala

Criminal Justice

This work examines the influences the media had in the “serial killer era” of the late 1960s into the late 1980s. While serial killers have made headlines in America since the 1896 capture of H. H. Holmes (Brown et al, 2015), the two-decade long hangover after the 1960s brought a rise of these violent offenders the likes of which had never been seen (Aamodt, M. G. 2016). This work defines the era as beginning with the Manson murders in 1969 and ending with the Columbine high school massacre of 1999 (Aamodt, M. G. 2016). This research explores the …

An “Sdvcj Fix”—Paths Forward In Tribal Domestic Violence Jurisdiction, Joshua B. Gurney Apr 2019

An “Sdvcj Fix”—Paths Forward In Tribal Domestic Violence Jurisdiction, Joshua B. Gurney

UC Law Journal

Domestic violence has riddled the indigenous communities of the United States for decades. Within this problem lies another—non-Indians perpetrate crimes of domestic violence against Indian women at disproportionately high rates. Exacerbating this issue is the complicated web of criminal jurisdiction split between federal, state, and tribal governments. To ostensibly solve the problem, Congress enacted the Violence Against Women Reauthorization Act of 2013. The Act contained an important provision that returned criminal jurisdiction to tribes, called “Special Domestic Violence Criminal Jurisdiction.”

Special Domestic Violence Criminal Jurisdiction, by most accounts, has been a resounding success. But it suffers from critical limitations, namely, …

The Mass Murder Of The European Jews And The Concept Of ‘Genocide’ In The Nuremberg Trials: Reassessing Raphaël Lemkin’S Impact, Alexa Stiller Apr 2019

The Mass Murder Of The European Jews And The Concept Of ‘Genocide’ In The Nuremberg Trials: Reassessing Raphaël Lemkin’S Impact, Alexa Stiller

Genocide Studies and Prevention: An International Journal

Nuremberg’s prosecutors prominently used Lemkin’s genocide concept. They also dealt in detail with the mass murder of Europe’s Jews. However, for them ‘genocide’ and the Holocaust were not congruent. They used different definitions of Lemkin’s concept and interpreted the relationship between the mass murder of the European Jews and the entire mass violence of the Nazis differently. Lemkin had little influence on the application of his concept in the Nuremberg trials between 1945 and 1949. The implementation of the 1948 United Nations Genocide Convention put an end to the broad use of the original concept from 1944. Although both Lemkin …

Implementation Of Tracking System For Sexual Assault Kits In South Dakota, Regan Enos Apr 2019

Implementation Of Tracking System For Sexual Assault Kits In South Dakota, Regan Enos

Honors Thesis

The average number of sexual assaults occurring in South Dakota from 2012 thru 2017 was 759. Yet, there is no data collection system to track sexual assault exam kits. The main aspects of this paper are identifying the issue of sexual assault exam data collection in South Dakota and providing possible solutions to this issue. The recommendations provided are based off of a national review and analysis of successful programs currently in practice in other states, as well as public health theories for implementation of a new product or innovation. The process of how the national review was carried out …

Greek Tragedy At Marion Correctional: An Exploration Of Directing Theatre In Prison, Elise G. Woods Apr 2019

Greek Tragedy At Marion Correctional: An Exploration Of Directing Theatre In Prison, Elise G. Woods

Undergraduate Honors Thesis Projects

In this project, I describe and analyze forces of freedom and coercion through the process of directing Trojan Women by Euripides at Marion Correctional Institution. This analysis documents each stage of the theatrical process—from project proposal to final performance and discussion—through ethnographic, arts-based research using personal observations, primary accounts from performers and audience members, and secondary sources. By exploring the experience of directing Trojan Women in the prison setting, I analyze forces of coercion and freedom in both theatre-making practices and prison. As a result, I assert the uniquely positive aspects and productive utilization's of coercion through theatre in a …

The Faculty Landing Page: Easy Access To Both Faculty Administrators Schedules, Ryan Vanoss, Sydney Sprau, Charity Foster, Rachel Mckay, Madelyn Conklin

Liberal Studies Undergraduate Research

Despite the obvious successes that the Frederik Meijer Honors College has enjoyed in recent years, there are noticeable ways in which it can grow, the most visible of which, is the current agency that the students claim in the Honors College. Lack of student agency, or governance, is likely the manifestation of a deeper problem, however. We seek to solve the inability for the Honors College students and faculty/administration to develop rich and meaningful relationships, through which the students will be able to voice their concerns and thus help govern the Honors College. We believe that effective governance is built …

Access To Opportunity Project: Final Report, Shawn Flanigan, Emily Lieb, Lisa K. Bates, Raphael Bostic, Sheryl V. Whitney

Urban Studies and Planning Faculty Publications and Presentations

This project’s goal is to lift up promising approaches, suggest new strategies and encourage honest conversations that result in public policy solutions to income and racial segregation and poverty. The overarching question that motivates this work is:

  • What are effective policies and strategies that promote access to high-opportunity amenities for low-income families?

As a first step, the researchers surveyed efforts on the ground in the metropolitan areas encompassing Seattle, Washington; Portland, Oregon; and San Diego, California, to determine whether there were any candidates for deeper study. We selected these three metropolitan areas for several reasons. First, prior interaction revealed that …
