The International Bar Association And Trade In Legal Services: Meta Law-Making In International Economic Law?, David Collins
The International Bar Association And Trade In Legal Services: Meta Law-Making In International Economic Law?, David Collins
Indian Journal of International Economic Law
This article presents the International Bar Association as a highly-influential but often overlooked non-state actor through the lens of its involvement in the standardization of Mutual Recognition Agreements for legal services. Not only do most MRAs contemplate the active involvement of professional bodies such as law societies and bar associations in their construction and monitoring, but the IBA’s guidelines for MRAs also inform the content of these agreements, facilitating the practice of international law by a more highly mobile profession. This, in turn, underpins the capacity of the community of international lawyers to exercise their technical expertise to influence other …

Janus's Two Faces, Kate Andrias
Janus's Two Faces, Kate Andrias
Articles
In ancient Roman religion and myth, Janus is the god of beginnings, transitions, and endings. He is often depicted as having two faces, one looking to the future and one to the past. The Supreme Court’s Janus v AFSCME case of last Term is fittingly named.1 Stunning in its disregard of principles of stare decisis, Janus overruled the forty-yearold precedent Abood v Detroit Board of Education. 2 The Janus decision marks the end of the post–New Deal compromise with respect to public sector unions and the FirstAmendment.Looking to the future, Janus lays the groundwork for further attack on labor rights—as …

The Cognitive Dissonance Between The Rule Of Law And Rural Realities: Reading Gillian Hadfield’S Rules For A Flat World In The Context Of Rural Identity And Politics, Danielle M. Conway
Faculty Scholarly Works
Rural communities – as well as other marginalized communities – see their access to legal infrastructure declining, so much so that they feel disconnected from the rule of law. Current complex law and legal infrastructure focus on big “I” innovation, which is hyper-transactional and benefits the few. Rural communities, and others, would find law and legal infrastructure more relevant if they focused more on small “i” innovation, which centers on negotiating real, societal relationships.

Code Of Silence, Melissa Mortazavi
Code Of Silence, Melissa Mortazavi
Cardozo Law Review
To read the literature on professional responsibility is to inhabit a world focused on what is said explicitly about what it means to be a lawyer: the aspirations of the canons, the commands of the Model Rules of Professional Responsibility, the clarifications of court and ethics opinions, and the guidance of the Restatement. However, it often neglects what is not said: spaces where silence reigns. This Article takes a different approach; it listens to the taciturn.
This Article draws insight from when the bar chooses to be silent in the face of widely known violations of the law of lawyering. …
When Objective Price Information Is Not Available: Impact Of Unpublished Or Missing Prices On The Purchase Journey For High Costs, High Involvement Products, Thomas J. Dammrich
When Objective Price Information Is Not Available: Impact Of Unpublished Or Missing Prices On The Purchase Journey For High Costs, High Involvement Products, Thomas J. Dammrich
College of Business Theses and Dissertations
Every model of the consumer purchase journey includes an evaluation phase, during which consumers search for product attributes including price. While much has been written about search, knowledge uncertainty, and the role of price in continued search and purchase intent, very little, if any, empirical work has been done to understand the impact on the path to purchase when objective price is not available. This study undertakes a field experiment with random assignment in a natural setting to examine the impacts on consumer behavior related to continued search, lead generation and purchase intent when objective price is not available. The …
Reforming Recidivism: Making Prison Practical Through Help, Katelyn Copperud
Reforming Recidivism: Making Prison Practical Through Help, Katelyn Copperud
The Scholar: St. Mary's Law Review on Race and Social Justice
While Texas has long been recognized as “Tough Texas” when it comes to crime, recent efforts have been made to combat that reputation. Efforts such as offering “good time” credit and more liberal parole standards are used to reduce the Texas prison populations. Although effective in reducing prison populations, do these incentives truly reduce a larger issue of prison overpopulation: recidivism?
In both state and federal prison systems, inmate education is proven to reduce recidivism. Texas’s own, Windham School District, provides a broad spectrum of education to Texas Department of Criminal Justice inmates; from General Education Development (GED) classes to …

Suffer The Little Children To Come: The Legal Rights Of Unaccompanied Alien Children Under United States Federal Court Jurisprudence, Claire Nolasco, Daniel Braaten
Criminology and Criminal Justice Faculty Publications (Archived)
This article analyses United States (US) federal court jurisprudence to determine the legal rights of unaccompanied alien children (UAC) in various stages of immigration enforcement proceedings. After briefly discussing statistics on UAC in the US, it explains the legal context of US laws governing unaccompanied minors. Through examining 40 cases decided by the 12 US Circuit Courts of Appeals and various federal district courts, the article specifies how these courts interpreted and expanded on the procedural legal rights of UAC upon apprehension by immigration officials, during placement or detention decisions of the Office of Refugee Resettlement (ORR), prior to voluntary …
Nonpayment Analysis For San Luis Obispo's Small Construction Firms, Connor D. Sullivan
Nonpayment Analysis For San Luis Obispo's Small Construction Firms, Connor D. Sullivan
Construction Management
The role of the small subcontractor often goes under-represented and over looked in the construction world, despite the high portion of the industry that is employed in this sector. This paper attempts to bring a problem that the small subcontractors face, non- and under-payment by its general contractor or owner. At what lengths will a small subcontractor with a very limited resource set go to receive missed payments? How often will they involve attorneys in disputes? Is the continued use of collections agencies worth the commission they charge? The number of subcontractors who will leave large sums of money un-contested …
Simplified Courts Can't Solve Inequality, Colleen F. Shanahan, Anna E. Carpenter
Simplified Courts Can't Solve Inequality, Colleen F. Shanahan, Anna E. Carpenter
Utah Law Faculty Scholarship
State civil courts struggle to handle the volume of cases before them. Litigants in these courts, most of whom are unrepresented, struggle to navigate the courts to solve their problems. This access-to-justice crisis has led to a range of reform efforts and solutions. One type of reform, court simplification, strives to reduce the complexity of procedures and information used by courts to help unrepresented litigants navigate the judicial system. These reforms mitigate but do not solve the symptoms of the larger underlying problem: state civil courts are struggling because they have been stuck with legal cases that arise from the …

Clinical Mediation: Advocating For A New Role, Dominique S. Hammonds, Nickolas A. Jordan, Jessica L. Block
Journal of Counselor Preparation and Supervision
Mediation training standards are inconsistent and fail to focus on the pivotal skill set of addressing, understanding, and working with underlying emotions that shape conflict and may prevent mutual goal attainment. The purpose of this article is to explore skills essential to counseling and mediation and advocate for the potential benefits of formally training counselors to facilitate the process of mediation and conflict resolution.
Solidarity Economy Lawyering, Renee Hatcher
Solidarity Economy Lawyering, Renee Hatcher
Tennessee Journal of Race, Gender, & Social Justice
This essay explores lawyering in the solidarity economy movement as an emergent approach to progressive transactional lawyering. The solidarity economy movement is a set of value-driven theories and practices that seeks to transform the global economy into a just economy that centers the needs of people and the planet. While the solidarity economy movement has been established for several decades in other parts of the world, the solidarity economy movement in the United States emerged in 2007. Over the last decade the movement has grown and gained significant momentum, with the rise of solidarity economy organizations and initiatives, as well …

Illness And The American Workplace: Issues And Implications For Employers And Employees, Victoria R. Dolan
Illness And The American Workplace: Issues And Implications For Employers And Employees, Victoria R. Dolan
Student Theses and Dissertations
This project aims to identify American employee experiences and existing workplace policies and cultures surrounding illness, disability, and sick leave. This approach was taken in order to closely examine what looks to be working well for companies and workers, and what could benefit from a more human centric approach in regards to workplace policy and employee support programs. The study of employee experiences in particular represents a gap in the current scholarly literature regarding illness and illness policy in the American workplace, and more accurately represents the experiences for both employees and employers. Furthermore, it assists with distinguishing the types …

Fighting Back Against Criminalization Of Homelessness: Martin V. City Of Boise Case Study, Kaitlyn Dey
Fighting Back Against Criminalization Of Homelessness: Martin V. City Of Boise Case Study, Kaitlyn Dey
University Honors Theses
As of 2018, Boise, Idaho is the fastest growing city in the entire United States. As the city continues to grow housing and homelessness is becoming a greater concern. The means of addressing homelessness in Boise, however, has relied heavily on criminalization. In 2009, a plaintiff filed a lawsuit against the City of Boise challenging city bans on camping and sleeping in public. The case, Martin v. City of Boise (formerly Bell v. City of Boise), has set a precedent across the country regarding criminalization of homelessness, positing the laws as a violation of the Eighth Amendment. This thesis uses …

How We Live Today And Other Stories, Gregory W. Rohloff
How We Live Today And Other Stories, Gregory W. Rohloff
LSU New Orleans Theses and Dissertations
How We Live Today is a collection of stories about family connections and the process of making amends to keep a family whole. The families are not just traditional families, but also arrangements constructed out of necessity, circumstance, or convenience. The title story tells how a man ends a lengthy divide with a stepmother for the sake of her, his son, and ultimately himself. We see adolescents do the right thing in their circumstances at the risk of losing peer standing or to avert future social damage. An older golfer encourages a younger golfer, easing guilt but realizing that respect …
Searching The Legacy Of The Reformation For Lutheran Responses To Modern Family Law, Marie A. Failinger
Searching The Legacy Of The Reformation For Lutheran Responses To Modern Family Law, Marie A. Failinger
Concordia Law Review
This article builds upon historical work on changes in the law of marriage, divorce and the family after the Reformation, and describes how modern Lutheran theology, formed during the Reformation, evaluates modern trends in American family law. From the key Lutheran theological insight that God is creatively ordering human activity as a partner with human beings, the Lutheran tradition approaches issues such as no-fault divorce and same-sex marriage with both trust and challenge.

Developments in Blockchain, smart contract, and decentralized application (“dApps”) technology have enabled new types of software that can improve efficiency within law firms by increasing speed at which attorneys may draft and execute contracts. Smart contracts and dApps are self-executing software that reside on a blockchain. Custom smart contracts can be built in a modular manner in order to emulate contracts that are commonly generated and executed in law firms. Such contracts include those for the transfer of services, goods, and title. This article explores exactly how implementations of smart contracts for law firms may look.
