Online Dispute Resolution For Smart Contracts, Amy J. Schmitz, Colin Rule
Online Dispute Resolution For Smart Contracts, Amy J. Schmitz, Colin Rule
Journal of Dispute Resolution
Smart contracts built in the blockchain are quietly revolutionizing traditional transactions despite their questionable status under current law. At the same time, disputes regarding smart contracts are inevitable, and parties will need means for dealing with smart contract issues. This Article tackles this challenge, and proposes that parties turn to online dispute resolution (“ODR”) to efficiently and fairly resolve smart contract disputes. Furthermore, the Article acknowledges the benefits and challenges of current blockchain ODR start-ups, and proposes specific ideas for how designers could address those challenges and incorporate ODR to provide just resolutions that will not stymie efficiencies of smart …

What American Legal Education Can Learn From The 'Harry Potter' Series, Sarah Gerwig-Moore
What American Legal Education Can Learn From The 'Harry Potter' Series, Sarah Gerwig-Moore
Articles
Both legal education and a Hogwarts magical education involve a new way of seeing the world—an immersive and intense process requiring, in many ways, a transformation. Students need a new wardrobe for both law school and wizarding school—and an awful lot of puzzling and expensive textbooks. Both Hogwarts and law school have been accused of operating entirely apart from reality. One of these criticisms may be valid. ...
This lighthearted comparison to the Harry Potter stories can perhaps join other voices to help make a serious and important case for practical legal education. There are few principled reasons for not …

Assuring Financial Stability For Survivors Of Domestic Violence: A Judicial Remedy For Coerced Debt In New York’S Family Courts, Megan E. Adams
Assuring Financial Stability For Survivors Of Domestic Violence: A Judicial Remedy For Coerced Debt In New York’S Family Courts, Megan E. Adams
Brooklyn Law Review
Domestic violence is a national crisis impacting more than one in three women and one in four men. Abuse is often experienced in nonviolent forms, including emotional, verbal and economic abuse. This note focuses on the harms of economic abuse and, specifically, coerced debt. As society’s understanding of the nuances of domestic violence deepens, many states, including New York, have recognized economic abuse as a unique harm and have empowered family courts to adjudicate such abuse. While promising, many states have yet to devise a suitable remedy for such harm. This critical gap leaves far too many survivors of abuse …

Understanding The Impact Of Social Location And English As A Second Language On Service Needs And Outcomes Of Intimate Partner Violence Victims, Christina Vosky Soibatian
College of Science and Health Theses and Dissertations
Victims of intimate partner violence have various needs due to abuse (e.g. safety, housing, gaining employment). Domestic violence programs play a crucial role in helping victims address their complex needs through services such as advocacy, legal support, counseling, and immediate housing. In an effort to better understand diverse victims’ needs and help-attained in domestic violence program settings, a study was conducted of 464 female victims across 15 domestic violence services agencies throughout a major Midwestern metropolitan area. Victims completed surveys six months after beginning services. The current study examined victims’ profiles across various needs upon their entry to services to …

The Triumph Of The Southern Man: Dowell, Shelby County, And The Jurisprudence Of Justice Lewis F. Powell, Jr., Earl M. Maltz
Duke Journal of Constitutional Law & Public Policy
The year 2018 has witnessed widespread celebrations of the life and legacy of Dr. Martin Luther King, Jr., who was assassinated fifty years ago in Memphis, Tennessee. Yet if Dr. King were alive today, he would no doubt be dismayed by the path taken by the Supreme Court’s treatment of race-related issues in recent years. Not only has the Court abandoned the quest for school desegregation, but the 2013 decision in Shelby County v. Holder substantially reduced the effectiveness of the Voting Rights Act of 1965, which was the most important legislative monument to Dr. King’s efforts.
By contrast, these …

Concerns About Ice Detainee Treatment And Care At Four Detention Facilities, John V. Kelly
Concerns About Ice Detainee Treatment And Care At Four Detention Facilities, John V. Kelly
United States Department of Homeland Security
In response to concerns raised by immigrant rights groups and complaints to the Office of Inspector General (OIG) Hotline about conditions for detainees held in U.S. Immigration and Customs Enforcement (ICE) custody, we conducted unannounced inspections of four detention facilities to evaluate their compliance with ICE detention standards.
Overall, our inspections of four detention facilities revealed violations of ICE’s 2011 Performance-Based National Detention Standards, which set requirements for facilities housing detainees. This report summarizes findings on our latest round of unannounced inspections at four detention facilities housing ICE detainees. Although the conditions varied among the facilities and not every problem …

The Death Penalty: The Law Lords Alter Course In The Commonwealth Caribbean, Harold A. Young J.D./Llb, Phd
Journal of International and Global Studies
This article is a critical examination of the decisions of the Judicial Council of the Privy Council (JCPC) in death penalty appeals from the Commonwealth Caribbean from 1966 to 2008. It contributes to our understanding of how court rulings may be influenced by specific aspects of the judicial environment, which is shaped by the majority party in parliament, whose prime minister selects judges and which may make substantive changes in the law. In a quantitative examination of death penalty appeals, I find an increased likelihood that the court will set aside the death penalty when the judicial environment changes.

Regulating Wage Theft, Jennifer J. Lee, Annie Smith
Regulating Wage Theft, Jennifer J. Lee, Annie Smith
Washington Law Review
Wage theft costs workers billions of dollars each year. During a time when the federal government is rolling back workers’ rights, it is essential to consider how state and local laws can address the problem. As this Article explains, the pernicious practice of wage theft seemingly continues unabated, despite a recent wave of state and local laws to curtail it. This Article provides the first comprehensive analysis of state and local anti-wage theft laws. Through a compilation of 141 state and local anti-wage theft laws enacted over the past decade, this Article offers an original typology of the most common …
Legal Intelligence Through Artificial Intelligence Requires Emotional Intelligence: A New Competency Model For The 21st Century Legal Professional, Alyson Carrel
Georgia State University Law Review
The nature of legal services is drastically changing given the rise in the use of artificial intelligence and machine learning. Legal education and training models are beginning to recognize the need to incorporate skill building in data and technology platforms, but they have lost sight of a core competency for lawyers: problem-solving and decision-making skills to counsel clients on how best to meet their desired goals and needs. In 2014, Amani Smathers introduced the legal field to the concept of the T-shaped lawyer. The T-shaped lawyer stems from the concept of T-shaped professionals who have a depth of knowledge in …

Legal Analytics, Social Science, And Legal Fees: Reimagining "Legal Spend" Decisions In An Evolving Industry, Nancy B. Rapoport, Joseph R. Tiano Jr.
Georgia State University Law Review
To give you a feel for the power of legal analytics, imagine that you are the managing partner of a law firm. With a good set of algorithms and the push of a few buttons, you can make sure that you’ve delegated each part of an assignment to the professional with the exact combination of experience, talent, and diligence to maximize your firm’s client satisfaction and profitability. The client will be pleased both with the work product and its efficiency—and will pay your full bill without any grumbling or request for a reduction of the fees. The client will even …
The Model Rules Of Autonomous Conduct: Ethical Responsibilities Of Lawyers And Artificial Intelligence, Ed Walters
The Model Rules Of Autonomous Conduct: Ethical Responsibilities Of Lawyers And Artificial Intelligence, Ed Walters
Georgia State University Law Review
Practitioners use artificial-intelligence (AI) tools in fields as varied as finance, medicine, human resources, marketing, sports, and many others. Now, for the first time, lawyers are beginning to use similar tools in the delivery of legal services. Where once lawyers may have only used AI for electronic discovery (eDiscovery), today they are using AI for legal research, drafting, contract management, and litigation strategy. The use of AI to deliver legal services is not without its detractors, and some have suggested that the use of AI may take the jobs of lawyers—or worse, make lawyers obsolete. Others suggest that using AI …
Automation & Predictive Analytics In Patent Prosecution: Uspto Implication & Policy, Tabrez Y. Ebrahim
Automation & Predictive Analytics In Patent Prosecution: Uspto Implication & Policy, Tabrez Y. Ebrahim
Georgia State University Law Review
Artificial-intelligence technological advancements bring automation and predictive analytics into patent prosecution. The information asymmetry between inventors and patent examiners is expanded by artificial intelligence, which transforms the inventor– examiner interaction to machine–human interactions. In response to automated patent drafting, automated office-action responses, “cloems” (computer-generated word permutations) for defensive patenting, and machine-learning guidance (based on constantly updated patent-prosecution big data), the United States Patent and Trademark Office (USPTO) should reevaluate patent-examination policy from economic, fairness, time, and transparency perspectives. By conceptualizing the inventor–examiner relationship as a “patenting market,” economic principles suggest stronger efficiencies if both inventors and the USPTO have better …
Where Do We Go From Here? Transformation And Acceleration Of Legal Analytics In Practice, Patrick Flanagan, Michelle H. Dewey
Where Do We Go From Here? Transformation And Acceleration Of Legal Analytics In Practice, Patrick Flanagan, Michelle H. Dewey
Georgia State University Law Review
The advantages of evidence-based decision-making in the practice and theory of law should be obvious: Don’t make arguments to judges that seldom persuade; Jurisprudential analysis ought to align with sound social science; Attorneys should pitch legal work to clients that demonstrably need it. Despite the appearance of simplicity, there are practical and attitudinal barriers to finding and incorporating data into the practice of law.
This article evaluates the current technologies and systems used to publish and analyze legal information from a researcher’s perspective. The authors also explore the technological, economic, political, and legal impediments that have prevented legal information systems …
