Patents In Paradise: The Evolution Of Patent Law In The Cayman Islands, Andrew W. Torrance, Andrew P. Morriss, Lisa C. Friedman

Journal of Intellectual Property Law

This study examines the Cayman Islands’ unique position in the global intellectual property (IP) landscape, contrasting its success as an exporter of financial and legal services with the inherently domestic nature of patent protection. We hypothesize that due to this limitation, the Cayman Islands functions as a strategic, cost-effective jurisdiction for augmenting patent protection initially obtained elsewhere. Our research provides the first comprehensive analysis of Caymanian patents, and through a quantitative examination of patent family data—including filing trends, economic valuation, geographic distribution, and assignee profiles—we find strong empirical evidence to support this thesis.

Significant administrative overhead is often encountered in operational environments due to fragmented, manual processes for tracking diverse work types and managing project lifecycles. Reliance on individual effort across disparate applications leads to inconsistent execution and limited visibility into workflows. To address these limitations, a method is disclosed for context-aware workflow automation utilizing generative artificial intelligence. Techniques are grounded in a curated organizational knowledge base containing standard operating procedures and best practices. Digital interactions are analyzed to derive project context, triggering automated cross-application actions such as drafting project artifacts, identifying stakeholders, and populating tracking tools. Mediation offers a flexible alternative to court for resolving housing disputes, allowing parties to address a wider range of issues and solutions without the delays and formalities of the judicial system. The Housing Mediation Program (HMP or Program) was established in FY2021 as part of the Eviction Diversion Initiative (EDI), a coordinated state and federal response to the housing challenges caused by the COVID-19 pandemic. Protecting religious liberty can present difficult challenges when religious liberty conflicts with laws prohibiting discrimination. Balancing religious liberty and nondiscrimination requires courts to accurately apply the U.S. Supreme Court’s complex First Amendment jurisprudence, including cases that address compelled speech, expressive association, and church autonomy. Amidst all the complexity, protection for religious liberty can get lost in translation. One important venue where protection can get lost in translation is in religious liberty cases decided by state supreme courts. Human trafficking in Nepal is closely linked to labor migration, gender inequality, and weak state capacity. In this context, non-governmental organizations play a key role in anti-trafficking efforts. This capstone project examines Maiti Nepal’s approach to prevention, rescue, and rehabilitation, with focus on its work at border points and internal facilities provided to human trafficking victims. The study analyzes how Maiti Nepal functions as a quasi-state actor by addressing gaps in Nepal’s anti-trafficking framework, highlights challenges associated with limited inconsistent funding, uneven resource distribution, and support for survivors. Indigent appellate advocacy has long been confined to a narrow, technocratic model—one that prioritizes legal expertise over client autonomy and treats appellate cases solely as isolated legal battles rather than opportunities for systemic change. Unlike their trial-level counterparts, appellate attorneys representing indigent clients have received little scholarly attention, leaving critical questions about client participation, ethical representation, and social justice largely unexplored.

This Article challenges the status quo, arguing that appellate attorneys should rethink their role in ways that empower clients and confront the broader injustices shaping their cases. Non-Audit Services And Knowledge Spillover: Evidence From Audit Hours And Billing Rates, Jaeyoon Yu, Yongsuk Yun, Yoonseok Zang

Using audit hours from firms listed on the Korea Exchange as a direct proxy for audit effort, this study examines whether non-audit services (NAS) purchased from audit firms improve audit efficiency. Our results reveal that the ratio of NAS fees to total fees paid to audit firms is associated with lower audit hours and audit fees, but it is not significantly related to audit billing rates. The reduction in audit effort associated with NAS is more pronounced when NAS provided are audit-related, and for clients who hire Big 4 auditors, have short-tenured auditors, and report a profit. Since its public release in November 2022, OpenAI's Generative AI (GenAI) has been met with varied responses, from widespread individual adoption to institutional caution. This phenomenon is evident among Egyptian public policy makers, where some institutions quickly embraced GenAI, while others have been slow to integrate it. The adoption of GenAI among these professionals is influenced by multiple factors, with institutional factors and budget constraints being the most significant. A lawyer and client must be able to communicate about the client’s legal affairs in confidence for the lawyer to be able to meaningfully advise the client, hence courts’ recognition of the attorney-client privilege. Fundamentally, the very term “attorney-client privilege” seemingly requires a lawyer’s participation in a communication for the privilege to attach. But, in fact, lawyers need not always participate in client communications for the attorney-client privilege to shield the communications from discovery. The Appellate Term affirmed the Civil Court's denial of the tenant's motion for summary judgment on an overcharge counterclaim for the period March 2017 to March 2019. The court held that Part F of the Housing Stability and Tenant Protection Act of 2019 (HSTPA), which extended the statute of limitations for overcharge claims to six years, does not apply retroactively to claims that accrued before the HSTPA's effective date in June 2019, even if not yet pending. The Appellate Term reversed a Civil Court order that dismissed a holdover petition based on a defective notice of petition. The tenant had moved to dismiss, arguing the notice failed to conform to the mandatory form under 22 NYCRR § 208.42(b). The Appellate Term held that while non-conformity may be jurisdictional, here the notice was substantially compliant with the spirit and intent of the sample notice. Minor differences pertained to form, not substance, and did not prejudice the tenant's rights. The case was remitted for the Civil Court to determine the remaining branches of the tenant's motion.

Between 1964 and 1973, women’s representation in full-time law school programs rose fivefold, from 3.7% to 20.1%. This paper examines whether Vietnam War draft policy contributed to this increase. In 1968, men enrolled in law school lost eligibility for 2-S student deferments, threatening law schools’ tuition revenues and incentivizing schools to admit more women to stabilize enrollment. To test this mechanism, we construct a school-by-year dataset of enrollment counts split by women/men and full-time/part-time status. Using a uniform adoption difference-in-differences design, we find that women’s representation rises by 2 percentage points in full-time programs relative to part-time programs (which were …

The court awarded a 100% rent abatement for May-November 2024 due to rent-impairing violations under MDL § 302-a, specifically a leaky roof in common areas. The landlord's claim of denied access was rejected as the violations were in areas under its control. Additionally, the court found the landlord engaged in harassment, directed HPD to place a Class C violation, ordered the landlord to cease harassing conduct, and imposed a $5,000 civil penalty.
