Migration, Multilingualism And Adaptation: Language As Social Capital In A Present-Day Mexican Ethnic Enclave In The U.S., Citlali Ochoa Jul 2019

Migration, Multilingualism And Adaptation: Language As Social Capital In A Present-Day Mexican Ethnic Enclave In The U.S., Citlali Ochoa

College of Liberal Arts & Social Sciences Theses and Dissertations

As the Spanish language continues to thrive in the U.S., so do the linguistic needs of immigrants. This study investigates, from a sociolinguistic perspective, the Spanish language within a Mexican immigrant enclave in Chicago, Illinois. Language use was investigated within four business and translators there in. It aims to uncover valuable insight into the understanding of the specific linguistic use of the businesses within this enclave and how it may, or may not, be contributing to the language maintenance and language shifts of the Spanish language in the U.S. The study also examines the effects of globalization and immigration policies …

Protecting Native Women From Violence: Fostering State-Tribal Relations And The Shortcomings Of The Violence Against Women Act Of 2013, Dayna Olson Jul 2019

Protecting Native Women From Violence: Fostering State-Tribal Relations And The Shortcomings Of The Violence Against Women Act Of 2013, Dayna Olson

UC Law Constitutional Quarterly

Native American women face violence at astronomically high rates compared to any other ethnic group in the United States. These staggering statistics are laregly the result of conflicting criminal jurisdiction between tribal, state, and federal prosecutors. As a result, crimes of intimate partner violence that take place on tribal reservations often go unpunished, leaving these women with little to no recourse. In 2013, President Obama signed the reauthorization of the Violence Against Women Act. This landmark legislation created the Special Domestic Violence Criminal Jurisdiction, which gave Native American tribes the authority to prosecute a narrow set of non-tribal members for …

Mind The Gap: Bringing Technology To The Mediation Table, Alyson Carrel, Noam Ebner Jul 2019

Mind The Gap: Bringing Technology To The Mediation Table, Alyson Carrel, Noam Ebner

Journal of Dispute Resolution

As technology impacts every aspect of our lives, all professions are exploring how to benefit from use of technology. Mediation is no exception. Since the mid-1990s, the field has explored applying technology to resolve conflict. At an early point this exploration narrowed in on substituting physical convening with wholly-online processes. Conflating “technology” with “online,” however, left an entire practice area unaddressed, a gap we need to mind: application of technology to support traditional, in-person mediation processes. Indeed, today, most mediation processes are largely bereft of technology. This Article suggests that by not minding the gap, traditional mediation forgoes opportunities to …

How The Boogeyman Saved Brett Kavanaugh, Cathren Page Jul 2019

How The Boogeyman Saved Brett Kavanaugh, Cathren Page

Articles

We love to hate these boogeymen. When the societal narrative creates these invisible boogeymen, people can pour their rage against sexual abuse into these faceless antagonists. At the same time, the enraged survivors and protectors avoid conflicts with family, neighbors, colleagues, and social acquaintances who might actually commit or enable sexual abuse. We can dodge sticky questions regarding how a churchgoer, a judge, or an Ivy Leaguer could have committed a heinous act. The survivors can avoid all the victim-blaming backlash, threats of violence, and invalidation that accompanies reporting a sexual offense. Moreover, having less power on their own, survivors …

Do Accounting Firm Consulting Revenues Affect Audit Quality? Evidence From The Pre- And Post-Sox Eras, Ling Lei Lisic, Linda A. Myers, Robert Pawlewicz, Timothy A. Seidel Jul 2019

Do Accounting Firm Consulting Revenues Affect Audit Quality? Evidence From The Pre- And Post-Sox Eras, Ling Lei Lisic, Linda A. Myers, Robert Pawlewicz, Timothy A. Seidel

Accountancy Faculty Publications

In recent years, public accounting firms have experienced a steady increase in the proportion of their revenues generated from consulting services. Although growth in consulting revenue following the Sarbanes‐Oxley Act (SOX) has been generated primarily from services provided to nonaudit clients, regulators have expressed concerns about the potential implications of this increase for audit quality. In contrast, accounting firms assert that the expertise developed by their consulting professionals helps them to provide better quality audits. We examine the relation between the proportion of accounting firm consulting revenue to total revenue and audit quality and investor perceptions of audit quality. Because …

Roadmap To Strengthen Contractual Enforcement And Ease Of Doing Business In India, Prof. (Dr.) Sairam Bhat, Vikas Gahlot

National Law School Journal

Ease of doing business is the flagship project of the World Bank which has garnered positive response from different stakeholders over the years. India is also taking its Ease of Doing Business ranking very seriously with several reforms being introduced to improve it. However, contract enforcement has been the Achilles’ heel of India’s Ease of Doing Business rankings. In the present article, an attempt has been made to draw a short and concise roadmap for strengthening contractual enforcement in India and improving the Ease of Doing Business rankings. Radical reforms bringing paradigm shifts, such as that brought by the Specific …

Investigation Of Sexual Offences Against Women In India – A Review Of Legal Procedural Mandates And Directives, Dr Nagarathna A Jul 2019

Investigation Of Sexual Offences Against Women In India – A Review Of Legal Procedural Mandates And Directives, Dr Nagarathna A

National Law School Journal

While the number of reported cases of sexual offences against women in India is increasing, as per official records, including that of the recently published report of the NCRB, the number of cases that result in timely and successful investigation which is crucial for successful prosecution are very few. A victim of such offence often faces difficulties, including getting the FIR registered on time and getting the criminal process initiated. This not only affects the following criminal process, but also curtails her access to justice, including legal remedies available in the form of medical treatment, counselling and compensation. Additionally, criminal …

E-Nudging Justice: The Role Of Digital Choice Architecture In Online Courts, Ayelet Sela Jul 2019

E-Nudging Justice: The Role Of Digital Choice Architecture In Online Courts, Ayelet Sela

Journal of Dispute Resolution

Justice systems around the world are launching online courts and tribunals as a means to improve their efficiency, increase access to justice, and ameliorate the quality of proceedings. These online courts and tribunals are publicly administered judicial online dispute resolution (ODR) systems that enable litigants, lawyers, judges and court personnel to complete all litigation related activities, from filing through final disposition, on a dedicated digital platform. Online courts are envisioned as a promising response to many challenges that civil justice systems face, including those stemming from voluminous case filings, procedural complexity, limited accessibility, high costs of litigation, and the ubiquity …

License To Hack, Dyane O'Leary Jul 2019

License To Hack, Dyane O'Leary

Suffolk University Law School Faculty Works

Legal hackathons are exploding in popularity. “Hacking” is a term often associated with illegal behavior but a hackathon is something different. At a hackathon, lawyers, technologists, data scientists, public interest organizations, law students, and just about anyone who is interested converge in a friendly, time-pressured competition aimed at solving some defined problem. For more than a decade, different industries have looked to hackathons as a source of new ideas. Today, the legal industry uses hackathons to spark creation of innovative tools to chip away at the access to justice crisis and improve the delivery of legal services.

Singapore, Tan K. B. Eugene Jul 2019

Singapore, Tan K. B. Eugene

Research Collection Yong Pung How School Of Law

The Singapore Government recognises and is committed to legal aid as an integral part of access to justice. Sixty years ago in 1958, Singapore was the first country in Southeast Asia to enact a legal aid scheme, which provided for the establishment of the Legal Aid Bureau (LAB) to provide civil legal aid to persons of limited means. Over the course of independent Singapore’s history, legal aid as part of the overall access to justice has broadened significantly. Members of Parliament make regular calls for more people to qualify and receive government-funded legal aid. The government regards access to justice …

The Singapore International Commercial Court: The Future Of Litigation?, Man Yip Jul 2019

The Singapore International Commercial Court: The Future Of Litigation?, Man Yip

Research Collection Yong Pung How School Of Law

The Singapore International Commercial Court (‘SICC’) was launched on 5 January 2015, at the Opening of Legal Year held at the Singapore Supreme Court. What prompted the creation of SICC? How is the SICC model of litigation different from litigation in the Singapore High Court? What is the SICC’s track record and what does it tell us about its future? This article seeks to answer these questions at greater depth than existing literature. Importantly, it examines these questions from the angle of reimagining access of justice for litigants embroiled in international commercial disputes. It argues that the SICC’s enduring contribution …

Designing And Implementing A State Court Odr System: From Disappointment To Celebration, David Allen Larson Jul 2019

Designing And Implementing A State Court Odr System: From Disappointment To Celebration, David Allen Larson

Journal of Dispute Resolution

State court systems rather suddenly are showing a tremendous interest in adopting court-integrated ODR systems. I have been involved with ODR system design for almost twenty years, and for the great majority of that time all the significant progress came from independent private sector alternative dispute resolution providers such as Modria (now part of Tyler Technologies Inc) and SmartSettle, or business-specific embedded systems like the one for eBay. Courts systems now are increasingly interested in ODR, which is significant because sustainability has been one of the greatest challenges for private independent ODR providers. The financial support that a judicial system …
