“The More Things Change, The More They Remain The Same:” Lawyer Ethics In The 21st Century, Gregory C. Sisk

St. Mary's Journal on Legal Malpractice & Ethics

At an accelerating pace since the recession, our legal profession has been undergoing structural changes in the delivery of many legal services. At the same time, longstanding principles of ethics continue to govern the day-to-day lives of practicing lawyers.

This article lays out four examples of how meaningful change in lawyer practice has been accomplished since the turn-of-the-century with continued adherence to bedrock professional concepts. First, the rules now embrace the multi-jurisdictional practice of law, while the disciplinary authority of each jurisdiction is emphatically confirmed and strengthened. Identifying Barriers In Black Communities That Hinder The Engagement In Lgbt Affirming Behaviors. Clinical Implications For Understanding Barriers To Attaining Adequate Social Support When Working With Lgbt People Of Color., Raven Howard

Institutional oppression and social inequality have been a topic of importance for decades within the literature. These adverse events may lead to many mental health problems, segregation between identity groups, and a hostile environment. This study aims to analyze the barriers in Black communities that may prevent Black communities from providing adequate social support or advocating for LGBT people of color. The primary question is: Does religious beliefs and levels of engagement in intergroup dialogue and intergroup contact impact the likelihood of engagement in LGBT affirming behaviors. Participants (n = 276) completed an anonymous online survey, and linear regression results …

This research is about trafficking (TPPO) against Indonesian migrant fishers (known as ABKI) which have been attracting the attention of many parties in the last few years. The Indonesia’s Anti Trafficking Law No.21-year 2007 has not yet explicitly regulated about this form of trafficking. However, in the general, the law mentions that human trafficking practice is a modern form of human slavery. Extra Law Prices: Why Mrpc 5.4 Continues To Needlessly Burden Access To Civil Justice For Low- To Moderate-Income Clients, R. Matthew Black

Washington and Lee Journal of Civil Rights and Social Justice

Whether alternative business structures might improve access to justice for low- to moderate-income clients remains a contentious matter.8 Because alternative business structures are generally unavailable, lawyers rely on 501(c)(3) non-profit status and sliding-scale fee structures to reach an underserved market of low-to moderate-income clientele. Nevertheless, use of a sliding- scale fee structure is rare—perhaps because it fails to maximize law firm profits. A sliding-scale fee structure also does not assist clients who need legal services, but do not qualify for LSC-funded programs and are unable to pay even a portion of subsidized legal fees.

Prisoners In The Face Of Gladiators: Providing A Sword And Shield To Aliens In Removal Proceedings Through Court-Appointed Counsel, Kevin Gardner

To an outside observer, immigration courts may appear identical to criminal courts. However, there is one critical distinction. In criminal court, defendants have a well-established right to court-appointed counsel if they cannot afford a lawyer. But there is no such right for aliens with removal orders. If they cannot afford an attorney, or if they do not have the good fortune to find a pro bono attorney, they must fight their case alone against an experienced government attorney. My dissertation explores the legal boundaries of copyright law in the wake of artificial intelligence (AI) technology. In building the theoretical foundations for my dissertation, I go through several key phases. First, I highlight important historical events and milestones in AI. I further develop the philosophical debate on AI legal personhood and deliberate whether we are approaching a singularity the next stage of AI evolution.
