Examining Whether Survivors Of Domestic Violence Perceive Ifps As More Helpful Than Other Available Support Resources, Aleidys Lopez Romero

USF Tampa Graduate Theses and Dissertations

Injunctions for protection (also known as restraining orders or civil protection orders) are often used by survivors as a line of defense against continued instances of physical violence or stalking by abusers (Houseman et al., 2024). This study aims to fill these gaps by examining whether survivors of domestic violence perceive IFPs as more helpful than other available support resources. Understanding this process may offer important insights into IFP accessibility, survivor perspectives, and/or alternative resources that may be equally, if not more, helpful to survivors than IFPs. Grounded in Gondolf & Fisher’s (1988) Survivor Hypothesis and Kimberlé Crenshaw’s (1989) Structural …

All Decisions

A landlord commenced a nonpayment proceeding against a tenant. The tenant moved to dismiss, arguing the predicate rent demand was fatally defective because it demanded rent for a period already paid through ERAP, representing approximately 13.8% of the total arrears. The court found that a rent demand failing to credit ERAP funds for designated months does not state the approximate good faith rent owed, which is a condition precedent for a non-payment proceeding. Thus, the court granted the tenant's motion, dismissing the proceeding without prejudice, as a defective rent demand cannot be amended.

Lessons From The Making Of Modern Property: Reinventing Roman Law In Europe And Its Peripheries, 1789–1950, Laura S. Underkuffler

Texas A&M Journal of Property Law

This article examines the evolution and reinvention of Roman law concepts in shaping modern property law across Europe and its peripheries between 1789 and 1950. Focusing on Anna di Robilant’s analysis, it explores how nineteenth-century jurists utilized the ideal of dominium—property as an individual’s absolute entitlement—to respond to the social and economic upheavals of the era. While this model emphasized personal autonomy, freedom, and equality, it was inherently in tension with the demands of collective needs and societal change. The article discusses the practical and philosophical clashes between dominium and the social function of property, tracing the historical debates and …

Ethics Of Artificial Intelligence For Lawyers: Resistance Is Futile: Candor, Supervision, And Fees, Cliff Mckinney Mar 2026

Ethics Of Artificial Intelligence For Lawyers: Resistance Is Futile: Candor, Supervision, And Fees, Cliff Mckinney

Arkansas Law Notes

In Star Trek: The Next Generation, the Borg deliver their iconic warning to every species they encounter: “Resistance is futile.” The line resonates because it conveys the inevitability that once the Borg arrive, escape is no longer an option.

For lawyers, the duties of candor, supervision, and fairness in fees are just as inescapable. ABA Formal Opinion 512 (“ABA Opinion”) makes clear that, regardless of how powerful artificial intelligence becomes, it cannot relieve attorneys of their obligation. Attorneys must verify what they file, oversee how their colleagues use the technology, and ensure that clients are charged fairly. This installment examines …

Ethics Of Artificial Intelligence For Lawyers: You Will Be Assimilated: Best Practices For Lawyers Using Artificial Intelligence, Cliff Mckinney

Arkansas Law Notes

In Star Trek: The Next Generation, the Borg, a species augmented with artificial intelligence, give a chilling ultimatum to every civilization they encounter: “You will be assimilated.” The warning is terrifying because it suggests not destruction, but absorption with the loss of independence to a relentless collective.

For lawyers, the rise of artificial intelligence carries a similar threat of assimilation. Artificial intelligence is already entering law practice, whether lawyers welcome it or not. The real question is not if lawyers will be assimilated into a future integrated with artificial intelligence, but how they will use these tools without sacrificing judgment, …

The U Visa At 25: Legislative Missteps, Bureaucratic Neglect, And Geographic Roulette, Jason A. Cade Mar 2026

The U Visa At 25: Legislative Missteps, Bureaucratic Neglect, And Geographic Roulette, Jason A. Cade

Scholarly Works

A quarter century ago, Congress created the U visa with dual goals: protecting immigrant crime victims and facilitating law enforcement cooperation by removing deportation barriers to crime reporting. Yet the program as implemented has fallen dramatically short of these aims. This Essay provides the first comprehensive analysis of the U visa's structural failures at its twenty-fifth anniversary. Two fundamental design flaws plague the program. First, Congress capped U visas at 10,000 annually-far below actual need-while the immigration agency has consistently failed to implement congressionally-authorized interim protections. The result is that, as of 2025, applicants wait five years for work authorization …

Immigration’S Prejudice Problem, S. Ellie Norton Mar 2026

Immigration’S Prejudice Problem, S. Ellie Norton

Nevada Law Journal

With immigration enforcement sharply rising, noncitizens increasingly face deportation with few constitutional protections. Yet many remain at least entitled to a fundamentally fair hearing before an immigration court. Even before the current administration, however, immigration courts had become notorious for systematically violating noncitizens’ due process rights. And while other scholars have suggested broadscale reforms to tackle this problem, statutory and regulatory change has become all but unachievable. This Article offers a new and timely solution: reforming the framework for direct review of immigration court due process violations. In most jurisdictions, noncitizens asserting these violations must prove on appeal not only …

Chicana Professionalism: Embracing Greñas, Glitter & Boots, Luz E. Herrera

Faculty Scholarship

The current political moment, where immigrant identity is scapegoated and academic freedom is threatened, requires an affirmation of personal identity, a recognition of personal struggle, and a celebration of resilience. This Essay embraces the ideas that professional identity development is temporal and that the current conceptualization of professionalism requires embarking on a reflection journey that addresses the dissonance between personal conscience and professional duty.   Part I briefly revisits the work of Professor Margaret E. Montoya, one of the first Chicana law professors that describes the formation of her professional identity as a law student. It explores the status of Latinas …

The Pro Bono Industrial Complex, Tanina Rostain Mar 2026

The Pro Bono Industrial Complex, Tanina Rostain

Georgetown Law Faculty Publications and Other Works

Recent settlements between corporate law firms and the Trump Administration, consisting of donations totaling nearly $1billion in free representation, have brought law firm pro bono to the fore. Pro bono has been institutionalized in corporate law firms since the turn of the 21st century. Pro bono evangelists and corporate law firms contend that pro bono increases access to justice and protects individual rights. Scholarship on pro bono has not challenged these claims, focusing instead on managerial and organizational incentives that could increase the number of hours corporate firms devote to pro bono. Given the prominence of corporate law firm …

Beyond Precedent: Leveraging Non-Precedential Writings In Pursuit Of Social Justice Advocacy, Marissa C. Meredith

Marquette Benefits and Social Welfare Law Review

The role of law in society is complex and often intersects with evolving societal norms, politics, technology, etc. Despite this complexity, students, especially our current Gen-Z students, enroll in law school, hoping to enact positive change within their communities through the legal system. As noted by recent studies, law students' reasons for attending law school have shifted from a “desire to have a challenging and rewarding career” to a focus on “helping others or uplifting their communit[ies]” and addressing “social justice” issues. With this change in purpose, students' expectations about the education they will receive in law school have shifted, …

Law's Penal-Professional World Order, Pilar Margarita Hernández Escontrías Mar 2026

Law's Penal-Professional World Order, Pilar Margarita Hernández Escontrías

Fordham Law Review

The attorney discipline regime has been propagandized as a necessary mechanism to police poor attorney conduct to protect the public. According to this myth, professional associations investigate attorney misconduct and impose sanctions, thus protecting the “noble profession” from attorneys who would tarnish its reputation. Violations of ethics rules lead to investigation, prosecution, and punishment by the state bar. In structure and language, state bars and judicial officers replicate the state in their use of disciplinary frameworks and regimes.

The self-regulating bar is a form of punitive governance used by the state to control entry into and expulsion from the profession. …

Answering Your Most-Asked Dental Benefit Questions, William Sullivan Jd, James Budd Mpp

The Journal of the Michigan Dental Association

This column examines the increasing federal scrutiny of non-compete agreements by the Federal Trade Commission (FTC). It notes that both the Trump and Biden administrations have prioritized curtailing the misuse of these agreements, particularly in healthcare. The article provides practical steps for employers to audit existing agreements for reasonableness and individualization. It encourages exploring alternatives such as non-solicitation and confidentiality clauses and stresses the importance of documenting the legitimate business interests that justify any remaining non-compete requirements to withstand future regulatory scrutiny.

Considering Barriers To Funding Fiscal Sponsorship: Insights From Sponsor And Project Leaders, Elliot M. Zettas, Todd L. Ely, Fredrik O. Andersson

The Foundation Review

This study explores barriers to funding fiscal sponsorship based on interviews with 68 leaders of sponsors and sponsored projects. Findings reveal that funders’ limited understanding and restrictive policies contribute to negative sentiment and reduced grant access for sponsored initiatives.

Despite fiscal sponsorship’s administrative efficiencies and mission-focused benefits, funders often perceive sponsored projects as less legitimate, misunderstand sponsor roles, and resist covering sponsor cost allocations when framed as fees. Structural complexities — such as shared EINs and geographic mismatches — further impede eligibility for funding.

This article concludes with actionable recommendations for funders and sponsors, including staff education, updated grant guidelines, …

The legal profession is at a crossroads, caught between intensifying fears of AI-driven displacement and a generational opportunity for transformation. This Article provides a practical framework for navigating the shifting terrain.

Situating legal innovation within a multi-century arc of technological change, the Article draws on management and strategy scholarship to develop two core organizing models: the Legal Services Value Chain and the Innovation Frontier. The value chain disaggregates the lifecycle of a legal matter into five distinct nodes of activity, providing a map for subsequent analyses

Building on that foundation, the Innovation Frontier traces LegalTech’s evolution from 2000s-vintage e-discovery to …
