Family Law And The New Access To Justice, Rebecca Aviel Apr 2018

Family Law And The New Access To Justice, Rebecca Aviel

Fordham Law Review

This Article explores whether the optimistic prospect suggested by this experience—of reform that promotes rather than inhibits access-to-justice values—is inherently limited to family law. Does the experience with family court reform offer insights that transfer to other contexts, or is family law simply too exceptional? On the one hand, family law disputes are unique in some truly important ways. It is difficult, for example, to conceive of a convincing analogue for postdivorce parenting, and what we mean by “justice” can be fundamentally different for domestic-relations litigants than for others. On the other hand, reform in family court has been driven …

The Aftermath Of War: Improving Psychosocial Measures To Address Trauma In Child Refugees In The Schengen Zone, Nivedha Meyyappan

Independent Study Project (ISP) Collection

With the large number of refugee children currently displaced due to war and conflict, there is a necessity to look into alleviating any resulting trauma so that these children don’t face further social or health effects later in life. The study focuses on how to improve psychosocial care for child refugees in the Schengen zone suffering from war trauma. Through a combination of research done using existing literature and interviews with experts, there were three main findings on improving psychosocial support for this population. Sailing Under False Colors: The Continuing Presence Of Negligence Principles In "Strict" Products Liability Law, Richard C. Ausness Apr 2018

Sailing Under False Colors: The Continuing Presence Of Negligence Principles In "Strict" Products Liability Law, Richard C. Ausness

Law Faculty Scholarly Articles

Dean Prosser, in his celebrated article, The Assault Upon the Citadel, compared the assault on warranty law's privity requirement to an attack on a stoutly defended fortress during the Middle Ages. Since that time, another conflict has arisen among students of products liability, namely whether product sellers should be subject to strict liability or whether certain aspects of this field should instead be controlled by negligence principles. However, unlike the assault some sixty years ago on the privity requirement, this present conflict bears a greater resemblance to the protracted trench warfare of World War I than it does to the …

Spiritual Warfare: A Strategic Guide, Lance T. Beauchamp

Faculty Publications and Presentations

10 Finally, be strengthened by the Lord and by His vast strength. 11 Put on the full armor of God so that you can stand against the tacticsof the Devil. 12 For our battle is not against flesh and blood, but against the rulers, against the authorities, against the world powers of this darkness, against the spiritual forces of evil in the heavens (Eph 6:10–12).[1]

This is a passage most of us are familiar with and perhaps we have heard a message or two on the armor of God from the following verses in Ephesians 6 but do we …

“Encroachments And Oppressions”: The Corporatization Of Procedure And The Decline Of Rule Of Law, J. Maria Glover Apr 2018

“Encroachments And Oppressions”: The Corporatization Of Procedure And The Decline Of Rule Of Law, J. Maria Glover

Georgetown Law Faculty Publications and Other Works

This Article begins by providing a brief account of the corporatization of procedure through judicial decision-making and noting some of the detrimental effects it has had on the preservation of rule of law and access to justice. Part II goes on to explore how the judiciary does not retain full control over procedure and how corporate entities have little care for whether a procedural reform simply cuts back at litigation or goes further and cuts back at judicial power and the judicial role itself. To illustrate these points, Part II examines the most recent attempt at "procedural reform" by corporate …

When Necessary Is Not Enough: A Study In The Effectiveness Of U.S. Military Force To Combat Terrorism In The Middle East, Lora Christine Vonderhaar Apr 2018

When Necessary Is Not Enough: A Study In The Effectiveness Of U.S. Military Force To Combat Terrorism In The Middle East, Lora Christine Vonderhaar

Honors Theses

This thesis will examine the relationship between the number and size of U.S. military bases in the Middle East and instances of terrorism in the same region. It seeks to analyze the complex set of impacts that U.S. military presence has on the area and determine if U.S. presence is overall more helpful or harmful to the situation on the ground. While size and number of U.S. bases is not a perfect measure of U.S. presence, it is a fair representation and a useful empirical starting point. This thesis will focus specifically on terrorism as a non-state actor and not …

One Peninsula, Many Spains: An Inquiry On Memory, Historiography, And The Legacy Of The Spanish Civil War From 1930 To The Present, Adrian Rios

Honors Projects

In this essay, I analyze the events of the Spanish Civil War and their ramifications through the lens of cultural memory and historiography. I argue that ideas of memory are crucial to how societies and individuals understand history and that the Spanish Civil War had a tremendous impact on the Spanish people and significantly affected the memory not only of witnesses of the conflict, but to their descendants. This essay utilizes primary and secondary sources to understand the function of memory and varied responses to the Spanish Civil War. The essay begins with a brief historical overview of the conflict …

Punishment As Pedagogy: An Exploration Of The Disciplinary Alternative School, Kaitlyn J. Selman Apr 2018

Punishment As Pedagogy: An Exploration Of The Disciplinary Alternative School, Kaitlyn J. Selman

Sociology & Criminal Justice Theses & Dissertations

As school districts across the US attempt to reduce their reliance on exclusionary punishment—and declining suspension and expulsion rates are heralded as signs of success—understanding the complexities of education and carcerality remains an urgent matter. Through a critical content analysis of a number of sources, including existing historical and ethnographic research, code of conduct handbooks, school websites, news articles, and data reports, this dissertation foregrounds an institution that is framed as an “alternative” to exclusionary punishment, yet is motivated by the same carceral logics that have long-haunted the school’s practice of managing students.

Chapter I introduces relevant literature on disciplinary …

The Politics Of Access: Examining Concerted State/Private Enforcement Solutions To Class Action Bans, Myriam E. Gilles Apr 2018

The Politics Of Access: Examining Concerted State/Private Enforcement Solutions To Class Action Bans, Myriam E. Gilles

Articles

Procedural and substantive constraints on the ability of ordinary people to access the civil justice system have become all too commonplace. The “justice gap” owes much to cuts in funding for legal aid and court administration, heightened pleading standards, ever-rising costs of discovery, increasingly restrictive views on standing to sue, and the co-opting of small claims court by businesses seeking to collect debts, among other obstacles in the path to the courthouse. But the most consequential impediment, surely, is the enforcement of mandatory arbitration clauses with class action bans, which bar consumers and employees from bringing or being represented in …

Mobile Bullying Among Rural South African Students: Examining The Applicability Of Existing Theories, Michael Eddie Kyobe Prof., Lucas Mimbi Dr, Phillimom Nembandona, Sive Mtshazi

The African Journal of Information Systems

Mobile bullying, which is one form of cyberbullying, is escalating in schools in South Africa. Research can contribute to better understanding of the nature of this aggression, and provide guidance in determining appropriate interventions and administration of justice. However, studies into cyberbullying tend to focus mainly on the urban environment. Rural South Africa involves a large percentage of mobile phone users and experiences in relatively different cultural and social-economic conditions. Lack of research on rural mobile bullying calls into question the applicability of existing theories of crime and cyberbullying to the rural context and their effectiveness in guiding legal and …

The Next Recruits: 16–18-Year-Olds And The United States' War On Terror, Mary E. Moyer

Capstone Collection

For many who experienced it directly or indirectly, 9/11 marked a dramatic shift as the United States processed the attacks and went from a country at peace to a country at war. Though the attacks themselves were geographically targeted, 9/11 was a nationally traumatic event and resulted in the formation of a collective memory and national narrative across the country. With the War on Terror, the military became synonymous with patriotism, as leaders and the media invoked the trauma of Pearl Harbor and the glories of World War II. Military records from the time describe patriotism as the motivation behind …
