Treating Outer Space Like A Place: A Case For Rejecting Other Domain Analogies, Elizabeth Mendenhall
Treating Outer Space Like A Place: A Case For Rejecting Other Domain Analogies, Elizabeth Mendenhall
Marine Affairs Faculty Publications
The creation and augmentation of the outer space governance regime during the twentieth century was guided by the use of analogies with other planetary domains. These analogies compare the “target” domain of outer space with various “source” domains, especially airspace, the seabed, the high seas, and Antarctica. These analogies, highlighted at different times to provide guidance on the regulation of existing and emerging space activities, shaped the fundamental principles and rules of the Outer Space Treaty. A survey of contemporary literature demonstrates that analogies continue to be used to structure thinking about outer space activities. This paper argues that such …

We are going through an unprecedented period of political instability. With the rise of the alt-right and of xenophobic sentiment, and the fallout of neoliberal government policies, our political future is at stake. These times call for the type of critical theory and praxis that gave rise to the Frankfurt School in the 1920s and to the critical ferment of the 1970s. Yet, in the face of our crises today, contemporary critical theory seems disarmed.
Critical theory is in disarray because of a wave of anti-foundational challenges in the 1960s that shattered the epistemological foundations of the Frankfurt School. The …
Asymmetric Constitutional Hardball, Joseph Fishkin, David E. Pozen
Asymmetric Constitutional Hardball, Joseph Fishkin, David E. Pozen
Faculty Scholarship
Many have argued that the United States' two major political parties have experienced "asymmetric polarization" in recent decades: The Republican Party has moved significantly further to the right than the Democratic Party has moved to the left. The practice of constitutional hardball, this Essay argues, has followed a similar – and causally related – trajectory. Since at least the mid-1990s, Republican officeholders have been more likely than their Democratic counterparts to push the constitutional envelope, straining unwritten norms of governance or disrupting established constitutional understandings. Both sides have done these things. But contrary to the apparent assumption of some legal …
The Failed Application Of Just War Doctrine To Cyberwarfare, Dalton E. Runyon
The Failed Application Of Just War Doctrine To Cyberwarfare, Dalton E. Runyon
Research Papers
Just War Theory has not followed with the most recent evolution of warfare. The last iteration of Just War Theory was created by Michael Walzer following the evolution of the tools of war in World War II. The current status of jus ad bellum and jus in bello are only applicable to conventional warfare, as this paper will show. Many current problems exist when attempting to analyze cyber attacks including the necessity of a proper definition, the determination of use of force, and how cyber attacks can be addressed in the future. These problems must be addressed so states can …
"Contra Haereticos Accingantur": The Union Of Crusading And Anti-Heresy Propaganda, Bryan E. Peterson
"Contra Haereticos Accingantur": The Union Of Crusading And Anti-Heresy Propaganda, Bryan E. Peterson
UNF Graduate Theses and Dissertations
This study assesses the intersection of crusading and heresy repression in the late twelfth and early thirteenth centuries. The event that encapsulates this intersection was the Albigensian Crusade, a two-decades long conflict that befell the south of France, or Occitania. The papacy, aligned with northern lords and other willing Christians, took up arms to defend the Church from the Cathar heresy’s corrupting influence. This conflict marked a new development in Christian acts of violence. While the Church had crusaded against many different enemies—even branding some as heretics—before 1209, the Church had never called a crusade for the explicit purpose of …

Pedagogical Contraband: A Phenomenological Approach To Understanding Student Engagement During Simulations, Stephen Austin Henderson
Pedagogical Contraband: A Phenomenological Approach To Understanding Student Engagement During Simulations, Stephen Austin Henderson
Dissertations and Theses @ UNI
The purpose of this study is to explore the lived experiences of students who are taught using simulations in survey history courses. Although simulations have been studied in a variety of domains, few studies have examined the use of simulations to teach history. Further, most of the previous research on simulations has been quantitative in nature, and one goal of the proposed study is to go into greater depth than typically allowed for by quantitative methodologies and examine the lived experiences of students in a college-level history class who are participating in simulations. Results suggest that the five phases of …
Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn
Liberals Vs Romantics: Challenges Of An Emerging Corporate International Criminal Law, Carsten Stahn
Case Western Reserve Journal of International Law
Holding bystanders and corporate agents accountable for international crimes is often at the periphery of international criminal justice. Based on its liberal foundations, international criminal law has traditionally been strongly centered on individual agency. In the industrialist cases after World War II, individual criminal responsibility was used to demonstrate and sanction corporate involvement in crime. Ideas of corporate criminal responsibility have been voiced in the post-war era and in the context of the negotiations of the Statute. In recent years, they have witnessed a renaissance in several contexts: the jurisprudence of the Special Tribunal for Lebanon, the Malabo Protocol of …

The Fourth Industrial Revolution: The Implications Of Technological Disruption For Australian Vet, Pi-Shen Seet, Janice Jones, John Spoehr, Ann-Louise Hordacre

Much discussion has occurred about the impact that technological disruption will have on the Australian workforce. A recent paper by the National Centre for Vocational Education Research (NCVER), Skilling for tomorrow (Payton 2017), examines the various ways by which the growth in technological advance is reshaping the labour market, workforce and jobs. Despite uncertainty about the scale and nature of the effect, there is a growing consensus that Australia’s tertiary education system needs to change to meet the requirements of a future labour force focused on innovation and creativity. This research examines the relationship between emerging ─ or disruptive ─ …
Anzus And The Early Cold War: Strategy And Diplomacy Between Australia, New Zealand And The United States, 1945-1956, Andrew Kelly
Anzus And The Early Cold War: Strategy And Diplomacy Between Australia, New Zealand And The United States, 1945-1956, Andrew Kelly
Research outputs 2014 to 2021
The ANZUS Alliance was a defence arrangement between Australia, New Zealand and the United States that shaped international policy in the aftermath of the Second World War and the early stages of the Cold War. Forged by influential individuals and impacting on global events including the Japanese Peace Treaty, the Korean War and the Suez Crisis, the ANZUS Alliance was a crucial factor in the seismic changes that took place in the second half of the twentieth century.
In this compact and accessible study, Andrew Kelly lays out the tensions that underpinned the formation of the Alliance, as each power …

Physicochemical, Spectroscopic Properties, And Diffusion Mechanisms Of Small Hydrocarbon Molecules In Mof-74-Mg/Zn: A Quantum Chemical Investigation, Gemechis Degaga

In petroleum refining industries, the fracturing process allows for the cracking of long-chain hydrocarbons into a mixture of small olefin and paraffin molecules that are then separated via the energetically and monetarily demanding cryogenic distillation process. In an attempt to mitigate both energetic and capital consumptions, selective sorption of light hydrocarbons by tunable sorbents, such as metal-organic frameworks (MOFs), appears to be the most promising alternative for a more efficient gas separation process. MOFs are novel porous materials assembled from inorganic bricks connected by organic linkers. From a crystal engineering stand point, MOFs are advantageous in creating a range …
A New Method For Detecting Jittered Pri In Histogram-Based Methods, Mostafa Bagheri, Mohammad Hossein Sedaaghi
A New Method For Detecting Jittered Pri In Histogram-Based Methods, Mostafa Bagheri, Mohammad Hossein Sedaaghi
Turkish Journal of Electrical Engineering and Computer Sciences
Histogram-based methods are among the best methods for deinterleaving, because of their easy implementation. However, they have a basic defect when they encounter a jittered pulse repetition interval (PRI). Jittered PRI is one of the most sophisticated patterns for electronic warfare (EW) receivers. In jittered PRI, the time among successive pulses varies in a totally random manner; thus its detection is very complicated. In this paper we present a new method for extracting jittered PRI from histogram-based methods. Simulation results demonstrate excellent performance of the proposed method in normal as well as hard circumstances where a higher missing pulse rate …
Ganesh Sitaraman’S Idealized American History, David B. Lyons
Ganesh Sitaraman’S Idealized American History, David B. Lyons
Faculty Scholarship
A popular theme among patriots is to celebrate America’s special virtues, which distinguish it radically from European models. Ganesh Sitaraman tells us that political constitutions have generally been designed to prevent socially destabilizing class warfare between the rich, who seek greater domination, and the poor, who would like to redistribute the former’s wealth. America’s Constitution is distinctive because it was consciously designed for a society in which the middle class is large enough to preserve social stability. That is why Sitaraman calls it a “middle-class constitution.”

Between the foundation of Constantinople as capital of the eastern half of the Roman Empire in 330 CE and its sack by the Fourth Crusade in 1204 CE, the Byzantine Empire underwent a full cycle from political-economic stability, through rural insecurity and agrarian decline, and back to renewed prosperity. These stages plausibly correspond to the phases of over-extension (K), subsequent release (Ω) and recovery (α) of the Adaptive Cycle in Socio-Ecological Systems. Here we track and partly quantify the consequences of those changes in different regions of Anatolia, firstly for rural settlement (via regional archaeological surveys) and secondly for land …
Pig Trauma Models: A Civilian Perspective On Ar-15 Post-Cranial Skeletal Trauma, Lauren M. Kenney
Pig Trauma Models: A Civilian Perspective On Ar-15 Post-Cranial Skeletal Trauma, Lauren M. Kenney
Graduate Student Theses, Dissertations, & Professional Papers
In the last decade, our country has seen an unprecedented wave of terror that has been punctuated by increasing events of gun-related violence. Consequently, the use of firearms against civilians or upon targets containing civilians has inevitably had a direct impact on the health of the individuals affected, and in many cases these events have concluded with mass number fatalities. The driving force for this research falls to the lack of available literature regarding traumatic skeletal injuries associated with high-velocity firearms outside of realm of the military. The effects of these types of weapons on civilians, which result from their …
Automated Identification Of Digital Evidence Across Heterogeneous Data Resources, Hussam J Mohammed
Automated Identification Of Digital Evidence Across Heterogeneous Data Resources, Hussam J Mohammed
School of Engineering, Computing and Mathematics Theses
Digital forensics has become an increasingly important tool in the fight against cyber and computer-assisted crime. However, with an increasing range of technologies at people’s disposal, investigators find themselves having to process and analyse many systems with large volumes of data (e.g., PCs, laptops, tablets, and smartphones) within a single case. Unfortunately, current digital forensic tools operate in an isolated manner, investigating systems and applications individually. The heterogeneity and volume of evidence place time constraints and a significant burden on investigators. Examples of heterogeneity include applications such as messaging (e.g., iMessenger, Viber, Snapchat, and WhatsApp), web browsers (e.g., Firefox and …
Continuous Identity Verification In Cloud Computing Services, Burhan Mollan Salih Al-Bayati
Continuous Identity Verification In Cloud Computing Services, Burhan Mollan Salih Al-Bayati
School of Engineering, Computing and Mathematics Theses
Cloud computing has become a hugely popular new paradigm for hosting and delivering services over the internet for individuals and organisations with low cost. However, security is a sensitive issue in cloud computing, as it its services remain accessible to anyone after initial authenticated login and for significant periods. This has led to an increase in the number of attacks on sensitive cus-tomer information. This research identified biometric approaches as a possible solution for security to be maintained beyond the point of entry. Specifically, behaviour profiling has been proposed and applied across various other applications in the area of Transparent …
